JOINT MEETING OF: THE CARLSBAD CITY COUNCIL AND HOUSING AND
REDEVELOPMENT COMMISSION
(Joint Special Meeting)
DATE OF MEETING: December 22, 2009

CALL TO ORDER: Mayor/Chair Lewis called the Joint Special Meeting to order at 6:23 p.m.
ROLL CALL: was taken by the City Clerk, as follows:
Present: Council/Commission Members Lewis, Kulchin, Hall and Blackburn.
Absent: Packard.
DEPARTMENTAL REPORT:
17.AB #20.085 - RESPONSE TO CALIFORNIA ENERGY COMMISSION'S FINAL STAFF
ASSESSMENT ON THE CARLSBAD ENERGY CENTER PROJECT.
Senior Planner Scott Donnell, and Municipal Projects Manager Joe Garuba and gave the staff report
and PowerPoint Presentation (on file in the office of the City Clerk).
Mr. Garuba also showed Council a video (not on file in the Office of the City Clerk) that depicted the
scope and size of the proposed power plant in relation to Caltran's future widening of Interstate 5.
Ronald Rouse, from Luce, Forward, Hamilton and Scripps representing Cabrillo Power came forward
to address the Council/Commission.
Mr. Rouse stated that NRG differs from the City's position on the California Energy Commission's
final staff assessment report. He referenced the San Diego County Air Pollution Control District recent
approval of compliance for the proposed power plant, and said the pollution emitted from the
proposed plant is below the standard set by this District. Mr. Rouse further added that the California
Energy Center Project allows for the concurrent requirement of three of the older existing power
plants and replacing them with cleaner technology.
Kasey Cinciarelli of Carlsbad came forward to address the Council/Commission. Ms. Cinciarelli stated
she would like to see the city take a balanced approach to the proposed project and consider the
benefits that will be applied to the region.
Council/Commission Member Blackburn asked about the air pollution and potential cancer risks.
Mr. Garuba stated that staff would return to Council in the future regarding air quality. He said that
the proposed power plant emissions are within the threshold, which is one per one million. Mr.
Garuba added that it is difficult to determine the cancer risk consequences.

ACTION: On a motion by Mayor Pro Tern/Vice Chair Kulchin, Council
adopted RESOLUTION NO. 2009-323. approving the determination
that the proposed Carlsbad Energy Center Project is inconsistent
with all applicable local and related land use laws, ordinances,
regulations, and standards and poses serious impacts to the health,
safety, and quality of life to the community at large; and,
ACTION: On a motion by Vice Chair/Mayor Pro Tem Kulchin, Commission
adopted RESOLUTION NO. 482. accepting the City Council's
determination that the proposed Carlsbad Energy Center Project is
inconsistent with applicable local and related land use laws,
ordinances, regulations, and standards and poses serious impacts
to the health, safety, and quality of life to the community at large,
and approving the determination that said project does not comply
with the South Carlsbad Coastal Redevelopment Plan.
AYES: Lewis, Kulchin, Hall and Blackburn.
NOES: None.
ABSENT: Packard.
