MEETING OF: CITY COUNCIL (Regular Meeting)
DATE OF MEETING: March 2, 2010

CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the Deputy Clerk, as follows:
Present: Lewis, Kulchin, Hall, Packard and Blackburn.
Absent: None.
LEGISLATIVE INVOCATION:
Pastor Chuck Butler of North Coast Calvary Chapel gave the legislative invocation.
PLEDGE OF ALLEGIANCE:
Council Member Packard led the Pledge of Allegiance.
APPROVAL OF MINUTES:
On a motion by Mayor Pro Tem Kulchin, the minutes of the following meetings were
unanimously approved as presented:
Minutes of the Special Meetings held February 9. 2010.
Minutes of the Special Meeting held February 16, 2010.
Minutes of the Regular Meeting held February 16, 2010.
PRESENTATIONS:
Council Member Hall presented a Retirement Proclamation to Anita Stafford in
recognition of her 23 years of service to the City.
Ms. Stafford thanked Council for the recognition.
Council Member Hall presented a Retirement Proclamation to Mary Sasso in
recognition of her 24 years of service to the City.
Ms. Sasso thanked Council for the recognition.
Council Member Packard presented Mandy Atkission, Executive Director of the Trauma
Intervention Program, with a Proclamation recognizing the program's 25th anniversary.
Ms. Atkission thanked Council for the recognition.

CONSENT CALENDAR:
ACTION: On a motion by Mayor Pro Tern Kulchin, Council affirmed the action
of the Consent Calendar, Items #1 and #2 as follows:
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.
1. AB #20.141 -ACCEPTANCE OF DONATIONS.
Council adopted RESOLUTION NO. 2010-039. accepting donations from Joanne
Grueskin and from the Friends of the Carlsbad City Library; and authorized the
appropriation of donated funds.
2. AB #20.142 - REQUEST FOR IN-KIND SERVICE ASSISTANCE.
Council adopted RESOLUTION NO. 2010-040. approving the donation of 'in-
kind' service assistance to the Special Olympics for the Law Enforcement Torch
Run on June 2, 2010; and authorized the appropriation of funds to cover the
service costs.
ORDINANCE FOR ADOPTION:
3. AB #20.143 - AMENDMENT TO THE CARLSBAD MUNICIPAL CODE
REGARDING APPLICATIONS FOR EMERGENCY PERMITS IN THE VILLAGE
REVIEW ZONE.
City Attorney Ron Ball titled the Ordinance.
ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted
ORDINANCE NO. CS-078, amending Carlsbad Municipal Code Sections
21.81.150(a) and (f) regarding applications for emergency permits in the
Village Review Zone.
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
PUBLIC HEARING:
4. AB #20.144 - AMENDMENT TO CARLSBAD MUNICIPAL CODE REGARDING
ENVIRONMENTAL IMPACT REPORT CONTRACTS.
City Attorney Ron Ball explained that this item was an amendment to the Municipal
Code and holding a public hearing was not required by law or the Municipal Code.

Principal Planner Chris DeCerbo gave the staff report and the PowerPoint Presentation
(on file in the Office of the City Clerk).
ACTION: On a motion by Mayor Pro Tern Kulchin, Council adopted
RESOLUTION NO. 2010-027. to amend Title 19, Chapter 19.04 of
the Carlsbad Municipal Code to allow the Planning Director to
retain an Environmental Impact Report consultant with approval
from the City Manager, without City Council approval, when the
applicant will be paying the City the cost for the preparation of the
EIR; and, to consider approving other minor amendments to clarify
procedural requirements for CEQA processing and to relocate
references to the Permit Streamlining Act found in the State's
Government Code to CMC Chapter 21.54 - Procedures, Hearings,
Notices and Fees, specifically 21.54.050 entitled Setting of Hearing.
