MEETING OF: CITY COUNCIL (Regular Meeting)
DATE OF MEETING: June 8, 2010

CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the Deputy Clerk, as follows:
Present: Lewis, Kulchin, Hall, Packard and Blackburn.
Absent: None.
APPROVAL OF MINUTES:
On a motion by Mayor Pro Tern Kulchin, the minutes of the following meetings were
unanimously approved as presented:
Minutes of the Regular Meeting held May 18, 2010.
Minutes of the Special Meeting held May 18, 2010.
PRESENTATIONS:
Council presented a proclamation in recognition of 100 years of Scouting to Vic Enchelmayer,
Santa Margarita District Director of the Boy Scouts of America. Mr. Enchelmayer thanked
Council for the recognition and support.
Council invited representatives of North Coastal Prevention Coalition to come forward. Nicole
Pappas and Erica Leary, representing North Coastal Prevention Coalition, presented the Law
Enforcement and Community Involvement Award to Carlsbad Police Captain Neil Gallucci.
Ms. Leary stated that Captain Gallucci was chosen for this award because of his efforts
aimed at educating children about the dangers of under age drinking.
Council presented a proclamation in recognition of Historic Preservation Month. Historic
Preservation Commissioners Wendy Hinman, Joyce Smith, Raul Diaz and Tom Wachter
came forward and thanked Council for the recognition.
Council presented a proclamation in recognition of the 3rd Grade Art Contest winners.
Deputy Library Director Suzanne Smithson came forward to announce the winners of the
contest. Ms. Smithson stated that the winning artwork would be displayed at the Georgina
Cole Library.
CONSENT CALENDAR:
Item No. 4 was pulled for discussion.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council affirmed the action of
the Consent Calendar, Items 1, 2, 3 and 5 through 9 as follows:
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.

WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.
1. AB #20.258 - ACCEPTANCE OF GRANT.
Council adopted RESOLUTION NO. 2010-142. accepting a grant donation from North
Coastal Prevention Coalition.
2. AB #20.250 -APPROVAL OF RENEWAL OF EXCESS WORKERS' COMPENSATION
INSURANCE.
Council adopted RESOLUTION NO. 2010-131, authorizing the renewal of the city's
Excess Workers' Compensation Insurance coverage with the Safety National
Casualty Corporation.
3. AB #20.251 -APPROVAL OF CARLSBAD POLICE OFFICERS' ASSOCIATION M.O.U.
Council adopted RESOLUTION NOS. 2010-132 and 2010-133. approving a
Memorandum of Understanding between representatives of management and the
Carlsbad Police Officers' Association.
4. AB #20.249 - RESOLVING THE IMPASSE IN LABOR NEGOTIATIONS WITH THE
CARLSBAD POLICE OFFICERS' ASSOCIATION.
This item was pulled for discussion.
5. AB #20.252 -APPROVAL OF USED OIL PAYMENT PROGRAM APPLICATION.
Council adopted RESOLUTION NO. 2010-134. approving the used oil payment
program application and authorizing the appropriation of grant funds.
6. AB #20.253 -AWARD OF CONTRACT FOR CONSTRUCTION OF THE 2010
CONCRETE REPLACEMENT PROJECT.
Council adopted RESOLUTION NO. 2010-135. accepting bids and awarding a
contract for Construction of the 2010 Concrete Replacement to Crest Equipment Inc.,
Project No. 6013.
7. AB #20.254 -AWARD OF CONTRACT FOR CITYWIDE INDUCTIVE STREET LIGHT
REPLACEMENT.
Council adopted RESOLUTION NO. 2010-136. accepting bids and awarding a
contract for the city-wide inductive street light replacement project to Republic ITS,
Contract No. PWGS482.
8. AB #20.255 - CALL NOVEMBER 2010 GENERAL MUNICIPAL ELECTION.
Council adopted RESOLUTION NOS. 2010-137. 2010-138. and 2010-139. calling
and giving notice of the holding of the General Municipal Election in the City of
Carlsbad on Tuesday, November 2, 2010; and, requesting the Board of Supervisors
to consolidate the election with the statewide election being held November 2, 2010;
and, adopting regulations for candidates at the election.
9. AB #20.256 -TERMINATION OF DECLARATION OF LOCAL EMERGENCY.
Council adopted RESOLUTION NO. 2010-140. terminating the local emergency for
repair and stabilization of a roadfill failure along the number two lane of Carlsbad
Boulevard southbound southerly of the Encinas Creek Bridge, Project No. 6032.

DISCUSSION OF CONSENT CALENDAR ITEM:
4. AB #20,249 - RESOLVING THE IMPASSE IN LABOR NEGOTIATIONS WITH THE
CARLSBAD POLICE OFFICERS' ASSOCIATION.
Council Member Blackburn stated he was concerned that Carlsbad would be the first
municipality in the State to create a two-tiered retirement plan for Police personnel. He further
stated his concern that the two-tiered retirement plan would reduce future opportunities for
Carlsbad to hire experienced officers. Mr. Blackburn added that currently 60% of Carlsbad
Police officers were laterally hired.
Mayor Lewis stated that he supports the two-tiered retirement plan as a cost saving measure
for the City. He added that he believes that young people will want to work for Carlsbad, and
will be interested in managing their own finances to plan for retirement.
ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted
RESOLUTION NO. 2010-141. resolving the impasse and adopting
and implementing certain benefit terms and conditions for employees
represented by the Carlsbad Police Officers' Association.
AYES: Lewis, Kulchin, Hall and Packard.
NOES: Blackburn.
ABSENT: None.
ORDINANCE FOR INTRODUCTION:
10. AB #20,257 - ANIMAL NOISE ABATEMENT AND CONTROL CODE AMENDMENT.
Floyd Isley, Carlsbad, came forward to address Council. Mr. Isley spoke in support of the
Animal Noise Abatement and Control Code Amendment.
Dianna Isley, Carlsbad, came forward to address Council. Ms. Isley also spoke in support of
the Animal Noise Abatement and Control Code Amendment.
City Attorney Ron Ball titled the Ordinance.
ACTION: On a motion by Mayor Pro Tem Kulchin, Council introduced
ORDINANCE NO. CS-090, amending Title 7, Chapter 7.08, Section
7.08.010 of the Carlsbad Municipal Code to adopt by Reference Section
36.414(c)(6) of the San Diego County Code of Regulatory Ordinances
regarding animal noise abatement and control and amending Title 1,
Chapter 1.08, Section 1.08.010 of the Carlsbad Municipal Code
regarding designated penalties for violation.
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.

PUBLIC COMMENT:
Walt Meier, Carlsbad, came forward to address Council. Mr. Meier spoke against RV
parking along Carlsbad Blvd.
Glenn Bernard, Carlsbad, came forward to address Council. Mr. Bernard spoke in favor of
installing traffic roundabouts on La Costa Avenue.
DEPARTMENTAL AND CITY MANAGER REPORTS:
11. AB #20,259 - OPERATING BUDGET PRESENTATION
Acting Finance Director Kevin Branca, Finance Manager Judi Vincent, Senior Accountant
Helga Stover and Budget Accountant Cheryl Gerhardt presented a PowerPoint Presentation
(on file in the Office of the City Clerk).
Ms. Vincent explained that the results from recent negotiations with the Carlsbad
Firefighters' and Police Officers' Associations were not factored into the budget presented at
this meeting, but would be included in the budget to be presented to Council on June 29,
2010.
The following city staff gave an overview of their departments' accomplishments over the
past year and highlighted projects for 2011; Gary Barberio, Community and Economic
Development Director; John Coates, Parks and Recreation Director; Heather Pizzuto, Library
and Cultural Arts Director; Skip Hammann, Transportation Director; Glenn Pruim, Utilities
Director; Gary Morrison, Police Chief; and Kevin Crawford, Fire Chief.
RECESS:
Mayor Lewis declared a recess at 8:10 p.m. Council reconvened at 8:15 p.m., with five
members present.
In response to an inquiry from Mayor Pro Tern Kulchin, Chief Crawford explained that the
purpose of the Internal Efficiency Initiative is not only to find ways to improve efficiency, but
to also provide all members of the Fire Department with a better understanding of the costs
associated with operating a Fire Department. Chief Crawford also stated that as a result of
that initiative, Fire Station 3 is being rebuilt.
In response to an inquiry from Mayor Lewis, Mr. Branca stated that projections for PERS
retirement costs are included in the current budget calculations.
In response to an inquiry from Mayor Lewis, Mr. Pruim stated that projections from San Diego
County Water Authority and Metropolitan Water District are taken into consideration when
determining the need for water rate increases for Carlsbad Municipal Water District customers.
Council Member Packard stated concerns about the use of one-time funds to balance the
budget in Fiscal Year 2011-2012. Mr. Branca stated that Finance staff would make mid-
cycle adjustments as necessary to avoid using one-time funding.
Ms. Vincent announced that a Citizens' Budget Workshop would be held at 6 p.m. on
Thursday, June 10, 2010 at 1635 Faraday Avenue.
Council accepted the report and set a Public Hearing for June 29, 2010.
