CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the Deputy Clerk as follows:
Present: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
Absent: None.
APPROVAL OF MINUTES:
On a motion by Mayor Pro Tern Kulchin, the Minutes of the following meetings were
approved as presented:
Minutes of the Special Meeting held August 24, 2010.
Minutes of the Regular Meeting held August 24, 2010.
PRESENTATIONS:
Gina McBride, Carlsbad Chamber of Commerce Board Chairwoman, presented the
2010 Starfish Leadership Award for Lifetime Achievement to Mayor Lewis.
Council Member Hall presented a proclamation recognizing Fall Prevention Week to
Recreation Area Manager Gail Lynn and Sandi Conti of the San Diego Fall Prevention
Taskforce.
Council Member Packard presented a proclamation recognizing Consititution Week to
Anne Barrett, Santa Margarita Chapter of the National Society of the Daughters of the
Revolution.
CONSENT CALENDAR:
Item #2 was pulled for discussion.
ACTION: On a motion by Mayor Pro Tem Kulchin, the Council affirmed the
action of the Consent Calendar, Item #1and Items # 3 through # 5
as follows:

WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.
1. AB #20.348 -ACCEPTANCE OF DONATION.
Council adopted RESOLUTION NO. 2010-217. accepting a donation from the
Pacific Library Partnership for the City Library Literacy Program to be
appropriated into the Library Budget.
2. AB #20.349 -ACCEPTANCE OF DONATIONS - Item pulled for discussion.
3. AB #20.350 -APPROVE STREET NAME CHANGE.
Council adopted RESOLUTION NO. 2010-219. approving a street name change,
renaming Four Seasons Point to Park Hyatt Point.
4. AB #20.351 - APPROVAL OF AGREEMENT AND ACCEPTANCE OF GRANT
AWARD.
Council adopted RESOLUTION NO. 2010-220. approving an agreement with,
and accepting a grant award from, the County of San Diego Aging and
Independence Services for congregate meals, home delivered meals and
transportation services for area seniors.
5. AB #20.352 -APPROVE THE CONSOLIDATED ANNUAL PERFORMANCE AND
EVALUATION REPORT.
Council adopted RESOLUTION NO. 2010-221. approving the 2009-2010
Consolidated Annual Performance and Evaluation Report for the Community
Development Block Grant Program.
DISCUSSION OF CONSENT CALENDAR ITEM :
2. AB #20.349 - ACCEPTANCE OF DONATIONS.
Mayor Pro Tern Kulchin acknowledged staff, volunteers and vendors for a successful
event.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council adopted
RESOLUTION NO. 2010-218. accepting cash donations and in-
kind donations of products and services in support of the Health
and Wellness Weekend held July 10 and 11, 2010.

ORDINANCES FOR INTRODUCTION:
6- AB #20.353 - ESTABLISH STOP CONTROL ON YOSEMITE STREET.
City Attorney Ron Ball titled the Ordinance.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council introduced
ORDINANCE NO. CS-107. amending Title 10, Chapter
10.28 of the Carlsbad Municipal Code to require stops on
Yosemite Street at its intersection with Valewood Avenue.
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
7. AB #20.354 - INCREASE SPEED LIMITS ON BATIQUITOS DRIVE.
City Attorney Ron Ball titled the Ordinance.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council introduced
ORDINANCE NO. CS-108. amending Title 10, Chapter
10.44, Section 10.44.520 of the Carlsbad Municipal Code, by
increasing the prima facie 40 mile per hour speed limit on
Batiquitos Drive from Poinsettia Lane to Golden Star Lane to
45 miles per hour and increasing the 35 mile per hour speed
limit on Batiquitos Drive from Golden Star Lane to Aviara
Parkway to 40 miles per hour.
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.

ORDINANCES FOR ADOPTION:
8. AB #20.355 - ESTABLISH PRIMA FACIE SPEED LIMIT UPON FARADAY
AVENUE.
City Attorney Ron Ball titled the Ordinance.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council adopted
ORDINANCE NO. CS-103: amending Title 10, Chapter
10.44 of the Carlsbad Municipal Code by the revision of
Section 10.44.320 to establish a 50 mile per hour prima facie
speed limit upon Faraday Avenue from Orion Street to the
east city limits.
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.

9. AB #20.356 -AMENDMENT TO CARLSBAD MUNICIPAL CODE TO RESTRICT
PARKING AT THE MONROE STREET POOL.
City Attorney Ron Ball titled the Ordinance.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council adopted
ORDINANCE NO. CS-104. amending Title 10, Chapter
10.40 of the Carlsbad Municipal Code by the revision of
Section 10.40.076 to restrict parking to current users of the
Monroe Street Pool between the hours of 5 a.m. and 11 p.m.
in the Monroe Street Pool parking lot; and
ORDINANCE NO. CS-105, amending Title 1, Chapter 1 of
the Carlsbad Municipal Code by the revision of Section
1.08.020 authorizing the City Manager to deputize
employees to issue parking citations for violations of the
Monroe Street Pool parking lot.
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
10. AB #20.357 - AMENDMENT TO THE CARLSBAD MUNICIPAL CODE TO GRANT
A ZONE CHANGE
City Attorney Ron Ball titled the Ordinance.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council adopted
ORDINANCE NO. CS-106. amending Title 21, Section
21.05.030 of the Carlsbad Municipal Code by the
amendment of the Zoning Map to grant a zone change, ZC
09-08, from Tourist Commercial, Qualified Development
Overlay Zone (C-T-Q) and Planned Industrial (P-M) to
General Commercial, Qualified Development Overlay Zone
(C-2-Q) on 16.65 acres of property generally located at the
southwest corner of Palomar Airport Road and El Camino
Real, in Local Facilities Management Zone 5.
AYES: Lewis, Kulchin, Hall, Packard and Blackburn.

PUBLIC COMMENT:
At the request of Mayor Lewis, Council Member Hall gave a report on the status of the
I-5 North Coast Corridor Project (on file in the City Clerk's office).
Di'Ann Weimer, Friends of Aviara, thanked Council for clarification of the Minutes of the
City Council Meeting held August 24, 2010, with regard to the amendment to the zoning
map and the Palomar Commons Project.
Buzzl 857@yahoo.com addressed Council regarding human rights.
Glenn Bernard, Carlsbad, came forward to address Council. Mr. Bernard spoke about
solar energy and solar energy permits, and requested Council provide free solar permits
to Carlsbad residents.
Robert Perkins, Carlsbad, came forward to request Council's assistance in obtaining a
permit for searchlights for the Fright Institute located in the North County Plaza
Shopping Center during the month of October 2010.
City Manager Lisa Hildabrand stated staff would contact Mr. Perkins regarding his
request.
Dave Voss, Carlsbad, came forward to address Council regarding clean energy and
Proposition 23.
PUBLIC HEARING:
11. AB #20.358 - LA COSTA OAKS NORTH.
Assistant Planner Shelly Glennon presented the staff report and Powerpoint
presentation (on file in the City Clerk's office).
Jack Henthorn, representing Colridge Communities, presented their report and
Powerpoint presentation.
Mayor Lewis opened the Public Hearing at 7:03 p.m.
Seeing no one wishing to speak, Mayor Lewis closed the public hearing at 7:03 p.m.
ACTION: On a motion by Mayor Pro Tern Kulchin, Council adopted
RESOLUTION NO. 2010-222. approving a Planned
Development Permit Amendment for building floor plans,
elevations and plotting for the development of 67 single-
family detached homes within the Villages of La Costa Oaks
North, Neighborhood 3.3, generally located west of Rancho
Santa Fe Road, south of Melrose Drive and north of
Cadencia Street, PUD 05-12(8).

PUBLIC COMMENT: Continuation of the Public Comments
Don Christiansen, Carlsbad, came forward to address Council regarding clean
technology, renewable energy and Proposition 23.
COUNCIL REPORTS AND COMMENTS:
Mayor Lewis and Council Members reported on activities and meetings of some
committees and sub-committees of which they are members.
CITY MANAGER COMMENTS: None.
CITY ATTORNEY COMMENTS: None.

1-5 North Coast Corridor Project Update
As part of my role on SANDAG, I have been tracking the 1-5
widening project, which is officially called the 1-5 North Coast
Corridor Project.
Carlsbad's role
As with many large projects, there are a number of agencies
involved in the 1-5 project, and it can be confusing to know how
these decisions ultimately get made.
California Department of Transportation (Caltrans), a state
agency, will ultimately make the decision about how to proceed
with this project.
The City of Carlsbad and all the other cities along the affected
stretch of 1-5 can provide their input about what is being
proposed, but cities do not have the ultimate decision making
power.
Where we do have an opportunity to influence this project is
through our participation on SANDAG, the regional association of
governments. SANDAG controls the funding for this project.
I am the City of Carlsbad's representative on this board, and I will
have an opportunity to vote on the funding for this project
sometime in the future. However, Carlsbad is only one vote out of
the 18 cities represented by SANDAG.
Project background
Briefly, for those who might not be familiar with this project, it
proposes to improve traffic flow on 1-5 from La Jolla Village Drive
in San Diego to Harbor Drive in Oceanside/Camp Pendleton by
expanding the number of lanes and changing how the lanes are
used.
In Carlsbad, the project would substantially widen 1-5 to
accommodate up to six additional lanes of traffic, including two
HOV lanes in each direction and, in some locations, one auxiliary
lane in each direction.
Sound walls would also be built and existing bridges over the
freeway and lagoons would be replaced to accommodate the
widening.
In most cases, Caltrans is proposing to use its right of way, but in
some locations, particularly around onramps and off ramps, some
private property will be affected.
The project is sponsored by the California Department of
Transportation, the Federal Highway Administration and SANDAG,
our regional association of governments.
Last Thursday Caltrans held the last of five public meetings to
gather input on the draft environmental report for this project.
These meetings have been very well attended and, frankly, caused
some concern among the public who were just finding out about
what is being proposed.
I want to assure our residents that the city has a whole team of
experts looking at these plans and preparing our own detailed
response to what is being proposed.
We, along with many others, have also requested an extension of
the Oct. 7 deadline for comments.
The environmental documents are 9,000 pages of very technical
information, and we want to make sure that the public has ample
opportunity to review and understand what is being proposed.
How the public can provide input
I would encourage the public to weigh in on this project.
The best way to provide input is during the public review period
for the environmental review reports, called the Environmental
Impact Report/Environmental Impact Statement.
As I mentioned, the deadline for public comments is Oct. 7;
although, we have requested an extension.
Once the city completes our analysis, we will make that available
on our website.

Next steps
Once the public comment period closes, Caltrans will review all
the Input and choose a preferred alternative.
A final version of the environmental documents will be circulated
for review, and then Caltrans will decide whether or not to
formally approve the document.
After that the project will need to get a number of other permits,
including from the Coastal Commission.
Then the project will be designed and, ultimately, built according
to the final approved plans.
The plan is to start building the project in the south and work its
way north.
The soonest Carlsbad could see any construction would be within
the next five years, according to Caltrans. Construction would
occur in phases and is anticipated to fast through 2050.
