HomeMy WebLinkAbout2010-10-05; City Council; Minutes (2)MINUTES MEETING OF: CITY COUNCIL (Regular Meeting) DATE OF MEETING: October 5, 2010 TIME OF MEETING: 6:00 p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m. ROLL CALL was taken by the Deputy Clerk, as follows: Present: Lewis, Kulchin, Hall, Packard and Blackburn. Absent: None. LEGISLATIVE INVOCATION: Pastor Dwayne Edwards gave the legislative invocation. PLEDGE OF ALLEGIANCE: Council Member Hall led the Pledge of Allegiance. STATEMENT REGARDING PUBLIC COMMENT: Following a request by Mayor Lewis, City Attomey Ron Ball explained proposed changes regarding public comment during Council meetings. CONSENT CALENDAR: ACTION: On a motion by Mayor Pro Tem Kulchin, Council affirmed the action of the Consent Calendar, Items #1 and #2 as follows: AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None. ABSENT: None. WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 1. AB #20.373 - NOTICE OF COMPLETION. Council adopted RESOLUTION NO. 2010-234. accepting the construction of the Las Encinas Creek bridge replacement as complete; and, directing the City Clerk to record a Notice of Completion, Project No. 3919. October 5, 2010 Carlsbad City Council Meeting Page 2 2. AB #20.374 - NOTICE OF COMPLETION. Council adopted RESOLUTION NO. 2010-235. accepting the construction of the Carlsbad Boulevard emergency rip rap repairs as complete; and, directing the City Clerk to record a Notice of Completion, Project No. 6032. ORDINANCE FOR ADOPTION: 3. AB #20.375 - INCLUSIONARY HOUSING City Attorney Ron Ball titled the Ordinance. ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted ORDINANCE NO. CS-109. approving minor changes to the City's inclusionary housing requirements found in the Carlsbad Municipal Code, Chapter 21.895, ZCA 10-03/CPA 10-02. AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None. ABSENT: None. PUBLIC COMMENT: The following people came forward to address Council in opposition of Proposition 23, which appears on the General Election ballot of November 2, 2010: Paige Decino, Carlsbad Peggy Dornish, Co-President ofthe North Coast League of Women Voters John Warren-Lyns, Carlsbad Don Christiansen, Carlsbad Lane Sharman, Solana Beach Council concurred to address Proposition 23 at a meeting to be determined prior to the election. ADJOURNMENT TO THE SPECIAL MEETING OF THE CARLSBAD MUNICIPAL WATER DISTRICT Mayor Lewis adjourned the meeting ofthe Carlsbad City Council at 6:21 p.m. with five Council Members present. RECONVENE CITY COUNCiL MEETING: Mayor Lewis reconvened the Council Meeting at 6:56 p.m. with five Council Members present. October 5, 2010 Carlsbad City Council Meeting Page 3 DEPARTMENTAL AND CITY MANAGER REPORTS: 6. AB #20.376 - CITY GOVERNMENT CHANNEL POLICY Communications Manager Kristina Ray presented the staff report and PowerPoint presentation (on file in the office of the City Clerk). Peggy Dornish, Co-President of the North Coast League of Women Voters, spoke in support ofthe revisions as presented. Tina Schmidt, Carlsbad, requested the proposed policy be amended as recommended but suggested that it includes other types of voter service announcements. Following a question from Council Member Packard, City Attorney Ron Ball clarified that taxpayer monies cannot be used to fund advocating a position or a candidate for election. ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted RESOLUTION NO. 2010-236. approving revisions to City Council Policy No. 75 revising the City Government Channel Policy, with the correction of 20 days to 25 days. AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None. ABSENT: None. PUBLIC COMMENT- CONTINUATION: Greg Thomson, Carlsbad, came fonward to request that Council sponsor a public forum on the 1-5 expansion project. City Manager Lisa Hildabrand stated she would attempt to set up a meeting with CalTrans to receive input from Carlsbad residents. In response to an inquiry from Council Member Hall, Community and Economic Development Director Gary Barberio outlined the contents of the documents currently under staff review for the City's response to CalTrans. Richard Shapiro, Oceanside, came fonward to address Council regarding public forum limitations and free speech. October 5, 2010 Carlsbad City Council Meeting Page 4 COUNCIL REPORTS AND COMMENTS: Mayor Lewis and Council Members reported on activities and meetings of some committees and sub-committees of Which they are members. Council Member Packard requested that Proposition 19, which is on the ballot for the forthcoming election, also be put on the agenda for further discussion. CITY MANAGER COMMENTS: None.
