MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting)
DATE OF MEETING: December 14, 2010
TIME OF MEETING: 4:00 p.m.
PLACE OF MEETING: City Hall Conference Room 3, 1200 Carlsbad Village Drive,
Carlsbad
CALL TO ORDER: Mayor Lewis called the Meeting to order at 4:00 p.m.
ROLL CALL was taken by the Deputy City Clerk, as follows:
Present: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
Absent: None.
CLOSED SESSION:
Council adjourned into Closed Session at 4:00 p.m. pursuant to the following:
1. GOVERNMENT CODE SECTION 54956.9(c). To hold a closed session to consider
initiation of litigation against the Environmental Protection Agency.
2. GOVERNMENT CODE SECTION 54956.9(a). To hold a closed session to discuss
pending litigation as follows:
Gaetani v. City, et a/. / Case No. 37-2009-00051045-CU-PA-NC
3. GOVERNMENT CODE SECTION 54956.8. To hold a closed session to instruct its
negotiators David Mauser, Property and Environmental Management Director, Elaine
Lukey, Environmental Manager, and Mike Grim, Senior Planner, regarding purchase of
real property located and generally identified as:
Property Owner: Cielo del Norte, LLC
Location: A.P.N. 223-081-51
A portion of undeveloped property located off the northern
terminus of Lone Jack Road in the San Dieguito
Community Plan area within the City of Encinitas.
Negotiating Parties: Scott Ferguson for Conservation Fund (Optionee);
Markus Spielberg for Center for Natural Lands
Management (Conservation Lands Manager)
If circumstances necessitate the absence of a specified designated representative, an agent or
designee may participate in place of the absent representative so long as the name of the agent or
designee is announced at an open session held prior to the closed session.
The Council reconvened at 5:35 p.m. with four members present.
Mayor Lewis announced that Council discussed whether or not to initiate litigation against the
Environmental Protection Agency and authorized the City Attorney, after completion of further
investigation, to file an action, if necessary. If an action is filed, it will be publicly reported at that
time.
The Council also received an update on the case entitled Gaetani v. City of Carlsbad and directed
its negotiators on the potential purchase of real property for the Habitat Management Plan.
There was no final action on the last two items and the public report of any final action will be
made at a later date.
ADJOURNMENT:
By proper motion, the Special Meeting of December 14, 2010 was adjourned at 5:39 p.m.
