HomeMy WebLinkAbout2011-03-22; City Council; Minutes (3)MINUTES MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting) DATE OF MEETING: March 22, 2011 TIME OF MEETING: 4:00 p.m. PLACE OF MEETING: City Hall Conference Room 3,1200 Carlsbad Village Drive CALL TO ORDER: Mayor Hall called the Meeting to order at 4:00 p.m. ROLL CALL was taken by the Deputy City Clerk, as follows: Present: Council Members Hall, Kulchin, Blackburn, Douglas and Packard. Absent: None. CLOSED SESSION: Council adjourned into Closed Session at 4:00 p.m. pursuant to the following: 1. GOVERNMENT CODE SECTION 54957.6. Conference with Labor Negotiators. The City Council, by motion, authorize a closed session to discuss employer-employee relations, salaries, salary schedules and compensation in the form of fringe benefits of its employees represented by CCEA and CFA with designated staff as labor negotiators (Cynthia Haas, Deputy City Manager, Julie Clark, Human Resources Director, Chuck McBride, Finance Director, Cherri Abbott, Human Resources Manager, Debbie Porter, Senior Management Analyst, Rebecca Melillo, Management Analyst, Cheryl Gerhardt, Human Resources Department, and Steven Berliner, Liebert Cassidy & Whitmore). If circumstances necessitate the absence of a specified designated representative, an agent or designee may participate in place of the absent representative so long as the name of the agent or designee is announced at an open session held prior to the closed session. 2. GOVERNMENT CODE SECTION 54956.9(b)(3)(C). The City Council, by motion, authorize a closed session to discuss significant exposure to litigation as follows: Based on existing facts and circumstances regarding receipt of a claim against the City of Carlsbad pursuant to the Tort Claims Act, which shall be available for public inspection pursuant to section 54957.5. Location: 3110-3130 Jefferson St. Property Owner: Larry and Cathie Hatter, Trustees March 22, 2011 Carlsbad City Council Special Meeting Page 2 3. GOVERNMENT CODE SECTION 54956.9(c). The City Council and the Board of Directors of the Carlsbad Municipal Water District, by motion, authorize a closed session to consider initiation of litigation against J-M Manufacturing Company Inc. The Council reconvened at 5:32 p.m. with five members present. Mayor Hall made the following announcement: Council heard the items and directed staff on Item #1. Council directed staff to settle the claim on Item #2. Regarding Item #3, the City Council met in closed session pursuant to Government Code section 54956.9(c) and unanimously authorized the City Attorney to join in or commence litigation against J-M Manufacturing, Inc. dba JM Eagle (USDC C.D. Cal. Case No. ED-CV06-0055-GW) currently pending in federal court or initiating state court proceedings.
