MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting)
DATE OF MEETING: June 28, 2011
TIME OF MEETING: 4:15 p.m.
PLACE OF MEETING: City Hall Conference Room 3, 1200 Carlsbad Village
Drive, Carlsbad, California
CALL TO ORDER: Mayor Hall called the meeting to order at 4:15 p.m.
ROLL CALL was taken by the Deputy City Clerk, as follows:
Present: Council Members Hall, Kulchin, Blackburn, Douglas and Packard.
Absent: None.
CLOSED SESSION:
Council convened at Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, CA 92008 at
4:18 p.m. with all members present. City Attorney Ron Ball advised that it had come to the
attention of the city after the posting of the regular and special agendas regarding the potential
commencement of construction by NRG on June 30, 2011. He further advised that the City
Council, by a two-thirds vote of its membership, or by unanimous vote of all members present
if less than full membership, could add this to the agenda pursuant to Government Code
Section 54954.2(b)(2). It was moved by Mayor Pro Tern Kulchin and seconded by Mayor Hall
to add this item to the City Council closed session agenda.
AYES: Hall, Kulchin, Blackburn, Douglas and Packard.
NOES: None.

To hold a closed session to authorize the commencement of litigation if necessary as
follows:
NRG commencement of construction of its power plant on Carlsbad Boulevard
on June 30, 2011.
RECONVENE:
Mayor Hall reconvened the City Council Closed Session Meeting at City Hall 3 Conference
Room, 1200 Carlsbad Village Drive, Carlsbad, CA 92008 at 4:24 p.m. with five members
present and announced that the Council, by unanimous vote, and authorized the City Attorney
to commence litigation, if necessary to enjoin commencement of construction by NRG on June
30, 2011 or without all necessary and proper legally required permits.

To hold a closed session to discuss employer-employee relations, salaries, salary
schedules and compensation in the form of fringe benefits regarding employees
represented by CPOA with designated staff as labor negotiators (Cynthia Haas, Deputy
City Manager, Julie Clark, Human Resources Director, Chuck McBride, Finance
Director, Cherri Abbot, Human Resources Manager, Debbie Porter, Senior
Management Analyst, Rebecca Melillo, Management Analyst, Cheryl Gerhardt, Human
Resources Department and Steve Berliner, Liebert Cassidy & Whitmore). If
circumstances necessitate the absence of a specified designated representative, an
agent or designee may participate in place of the absent representative so long as the
name of the agent or designee is announced at an open session held prior to the closed
session.

To hold a closed session to instruct its negotiators (Cynthia Haas, Deputy City Manager,
David Hauser, Property and Environmental Management Director and Joe Garuba,
Municipal Property Manager) regarding purchase, sale, exchange or lease of real
property located and generally identified as:
Property Owner: City of Carlsbad
Location: Plaza Camino Real parking lot at 2525 El Camino
Real
Negotiating Party: Greg Fitchitt and Robin Munro for Plaza Camino Real
c/o Westfield, LLC
If circumstances necessitate the absence of a specified designated representative, an
agent or designee may participate in place of the absent representative so long as the
name of the agent or designee is announced at an open session held prior to the closed
session.
4. GOVERNMENT CODE SECTION 54956.8
To hold a closed session to instruct its negotiator, Cynthia Haas, Deputy City Manager,
regarding purchase, sale, exchange or lease of real property located and generally
identified as:
Property Owner: San Diego Gas & Electric Company
Location: Corner of Cannon Rd and Carlsbad Blvd.
APN: 210-010-4 and 210-040-44
Negotiators: Pamela Fair, Vice President of Environmental, Safety and
Support Services for SDG&E.

session
The Council reconvened at 5:54 p.m. with five members present. Mayor Hall announced that
Council directed the City Attorney and staff on the matters in Items #2, #3 and #4.
ADJOURNMENT:
By proper motion, the Special Meeting of June 28, 2011 was adjourned at 5:56 p.m.
