HomeMy WebLinkAbout2011-07-12; City Council; Minutes (2)MINUTES MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting) DATE OF MEETING: July 12, 2011 TIME OF MEETING: 4:15 p.m. PLACE OF MEETING: City Hall Conference Room 3, 1200 Carlsbad Village Drive, Carlsbad, California CALL TO ORDER: Mayor Hall called the meeting to order at 4:15 p.m. ROLL CALL was taken by the Deputy City Clerk, as follows: Present: Council Members Hall, Kulchin, Blackburn, Douglas and Packard. Absent: None. CLOSED SESSION: 1. GOVERNMENT CODE SECTION 54956.9(a). To hold a closed session to discuss regarding pending litigation as follows: Carlsbad Energy Center LLC's Application for Certification (AFC Docket No. 07- AFC-6) to the California Energy Commission to develop a new thermal power plant at the existing Encina Power Station in the City of Carlsbad. 2. GOVERNMENT CODE SECTION 54956.9(a) To hold a closed session to discuss pending litigation as follows: City of Carlsbad v. Environmental Protection Agency, Case No. 11-70147. 3. GOVERNMENT CODE SECTION 54956.8 To hold a closed session to instruct its negotiators (Cynthia Haas, Deputy City Manager, David Hauser, Property and Environmental Management Director and Joe Garuba, Municipal Property Manager) regarding purchase, sale, exchange or lease of real property located and generally identified as: Property Owner: City of Carlsbad Location: Plaza Camino Real parking lot at 2525 El Camino Real Negotiating Party: Jerry Engen for Plaza Camino Real c/o Westfield, LLC July 12, 2011 Carlsbad City Council Special Meeting Page 2 If circumstances necessitate the absence of a specified designated representative, an agent or designee may participate in place of the absent representative so long as the name of the agent or designee is announced at an open session held prior to the closed session. The Council reconvened at 5:54 p.m. with five members present. Mayor Hall made the following announcements - Item #1 - Council directed staff to intervene in the California Public Utilities Commission process. Item #2 - City is stopping litigation pending receipt of correspondence. Item #3 - Council directed staff and the City Attorney on the matter.
