CALL TO ORDER: Mayor Hall called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present: Council Members Hall, Kulchin, Blackburn, and Packard.
Absent: Douglas.
PLEDGE OF ALLEGIANCE:
Council Member Blackburn led the Pledge of Allegiance.
APPROVAL OF MINUTES:
On a motion by Mayor Pro Tem Kulchin, the minutes ofthe following meetings were unanimously
approved as presented:
Minutes ofthe Special Meeting held April 10, 2012.
Minutes ofthe Regular Meeting held April 10, 2012.
PRESENTATIONS:
Mayor Hall introduced P.J. Burn, from KGB Radio, who presented a proclamation on behalf of
California State Senator Joel Anderson to Carlsbad Police Officers in recognition of making a
terminally ill boy's dream come true (Josiah).
Council Member Blackburn presented a proclamation to Captain Neil Gallucci in recognition of Law
Enforcement Memorial Day.
Mayor Hall presented a proclamation to Members of the local chapter of the Military Order of the
Purple Heart recognizing Carlsbad as a Purple Heart City.
Council Member Packard presented a proclamation in recognition of Arbor Week to Parks and
Recreation Tree Supervisor Mike Bliss and CalFire Urban Forester Lynette Short. Ms. Short
presented a plaque to the City for the 2011 Tree City USA Award.
CONSENT CALENDAR:
ACTION: On a motion by Mayor Pro Tem Kulchin, the Council affirmed the action
of the Consent Calendar, Items #1 through #4 as follows:

WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.
1- AB #20.871 - APPROVE GRANT APPLICATION.
Council adopted RESOLUTION NO. 2012-088, approving the application for grant funding
from the California Office of Traffic Safety to conduct two sobriety checkpoints; and
authorizing the City Manager or her designee to execute the grant application forms.
2. AB #20.872 - AWARD OF CONTRACT.
Council adopted RESOLUTION NO. 2012-089. accepting bids and awarding a contract to
Palm Engineering Construction Company, Inc., forthe Northwest Quadrant Storm Drain
Improvement Program (Mountain View/Pacific Avenue, Roosevelt Street/Beech Avenue to
Laguna Drive, Madison Street/North of Grand Avenue and Harrison Street south of
Chinquapin Ave), Project 6608.
3. AB #20.873 - AWARD OF CONTRACT.
Council adopted RESOLUTION NO. 2012-090. accepting bids and awarding a contract for
construction of the 2012 Slurry Seal Project to Valley Slurry Seal, Project No. 6001-12SS.
4. AB #20.874 - APPROVE SHORT-TERM LEASE AGREEMENT.
Council adopted RESOLUTION NO. 2012-091. approving a short-term lease agreement with
Rehrig Pacific Company for temporary trash container storage at 2065 Camino Vida Roble
and 2075 Las Palmas Drive.

5. AB #20.875 - ESTABLISH ALL-WAY STOPS.
Deputy Transportation Director Bryan Jones gave the staff report and Power Point presentation, on
file in the office of the City Clerk.
Vanessa Forsythe, Carlsbad, came forward to address Council regarding the safety of children,
drivers who ignore stop signs, parking, visibility and access to the fields on school property.

ACTION: On a motion by Mayor Pro Tem Kulchin, Council introduced
ORDINANCE NO. CS-179. amending Title 10, Chapter 10.28
of the Carlsbad Municipal Code to require stops on Paseo Aliso at its
intersection with Via Adelfa.

6. AB #20.876 - ESTABLISH ALL-WAY STOPS.

ORDINANCE NO. CS-180. amending Title 10, Chapter 10.28
of the Carlsbad Municipal Code to require stops on Adams Street at its
intersection with Highland Drive.

7. AB # 20.877 - ESTABLISH ALL-WAY STOPS.
Council Member Packard stated that his vote reflected his belief that there were alternative ways to
resolve the issue at this intersection.
Assistant City Attorney Paul Edmonson titled the Ordinance.
ACTION: On a motion by Mayor Pro Tem Kulchin, Council introduced
ORDINANCE NO. CS-181, amending Title 10, Chapter 10.28
of the Carlsbad Municipal Code to require stops on Pio Pico Drive at its
intersection with Stratford Lane.
AYES: Hall, Kulchin and Blackburn.
NOES: Packard.

ORDINANCES FOR ADOPTION:
8. AB #20.878 - LAND USE DECISION MAKING.
Assistant City Attorney Paul Edmonson titled the Ordinance.
ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted
ORDINANCE NO. CS-178. approving a Zone Code Amendment (ZCA
11-06) consisting of various amendments to the Zoning Ordinance (Title
21 ofthe Carlsbad Municipal Code) to improve the Development
Review Process (DRP).
AYES: Hall, Kulchin, Blackburn, and Packard.
NOES: None.

PUBLIC COMMENT:
Patty Johnson and Claudine Jones came fonA/ard to address Council regarding I heart Carlsbad
Schools Week.
Rick Clark, Carlsbad, came fon^/ard to address Council regarding RV parking on Avenida Encinas
and blighted foreclosed properties in the Waters End neighborhood.
PUBLIC HEARINGS:
9. AB#20,879 - WEED ABATEMENT.
Fire Battalion Chief William Anderson gave the staff report.
Mayor Hall opened the duly noticed Public Hearing at 7:09 p.m.
Seeing no-one wished to speak. Mayor Hall closed the Public Hearing at 7:09 p.m.
ACTION: On a motion by Mayor Pro Tem Kulchin, adopted
RESOLUTION NO. 2012-092. directing the Fire Chief to abate
nuisances by having weeds, rubbish and refuse removed from
identified parcels.
AYES: Hall, Kulchin, Blackburn, and Packard.
NOES: None.

ADJOURMENT TO THE SPECIAL MEETING OF THE CARLSBAD PUBLIC FINANCING
AUTHORITY BOARD
Mayor Hall adjourned to the Special Meeting of the Carlsbad Public Financing Authority Board at
7:14 p.m. with four Council Members present.

Mayor Hall reconvened the Carlsbad City Council Meeting at 7:19 p.m. with four Council Members
present.

DEPARTMENTAL AND CITY MANAGER REPORTS:
11. AB #20.880 - ESTABLISH GUIDELINES FOR THE MANAGEMENT OF THE SISTER CITY
PROGRAM.
Community Coordinator Colleen Finnegan gave the staff report and Power Point presentation, on file
in the office of the City Clerk.
Joanne Brook, Board of Directors, Carlsbad Sister City Ambassadors, Inc., came fonA/ard to address
Council thanking them for their consideration of this item.
ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted
RESOLUTION NO. 2012-093. adopting Council Policy No. 77,
establishing the guidelines for the management ofthe City's Sister City
Program; and, authorizing the Carlsbad Sister City Ambassadors, Inc.,
to conduct the Sister City Program for the City of Carlsbad.
AYES: Hall, Kulchin, Blackburn, and Packard.
NOES: None.

12. AB#20.881 - AWARD OF DESIGN BUILD CONTRACT FOR ALGA NORTE COMMUNITY

13. AB #20.882 - APPROVE AGREEEMENT FOR CONSTRUCTION MANAGEMENT OF ALGA
NORTE COMMUNITY PARK PHASE I.
14. AB#20.883 - APPROVE AGREEMENT FOR DESIGN COMPLIANCE OVERSIGHT ON ALGA
NORTE COMMUNITY PARK PHASE I.
Civic Projects Manager Patrick McGarry gave the staff report and Power Point presentation, on file in
the office of the City Clerk.
Property and Environmental Management Director David Hauser was in attendance to answer any
questions.

ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted
RESOLUTION NO. 2012-094. accepting bids and awarding the design
build contract to T. B. Penick & Sons, Inc. for design and construction of
Alga Norte Community Park, Phase I, Project No. 3837A; and
RESOLUTION NO. 2012-095. approving the agreement with Kitchell
CEM for construction management and observation services for Alga
Norte Community Park Phase I, Project No. 3837A; and
RESOLUTION NO. 2012-096. approving the agreement with Wimmer,
Yamada, and Caughey for design compliance oversight services for
Alga Norte Community Park, Phase I, Project No. 3837A.
