MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting)
DATE OF MEETING: June 5, 2012
TIME OF MEETING: 4:45 p.m.
PLACE OF MEETING: Planning Library, 1635 Faraday Avenue, Carlsbad,
California
CALL TO ORDER: Mayor Hall called the meeting to order at 4:45 p.m.
ROLL CALL was taken by the Assistant City Clerk, as follows:
Present: Council Members Hall, Kulchin, Blackburn, Douglas and Packard.
Absent: None.
PUBLIC COMMENT ON AGENDA ITEM:
None.
CLOSED SESSION:
Council adjourned into Closed Session at 4:45 p.m. pursuant to the following:
1. GOVERNMENT CODE SECTION 54946.8. To hold a closed session to instruct its
negotiators (Cynthia Haas, Deputy City Manager, David Hauser, Property and
Environmental Management Director, Joe Garuba, Municipal Property Manager and The
Irving Group negotiators, Craig Irving, President, Simon Terry-Lloyd, Vice President, and
Casey Kinslow, Chief Financial Officer) regarding purchase, sale, exchange or lease of
real property located and generally identified as:
Property Owner: City of Carlsbad
Location: Plaza Camino Real parking lot at 2525 El Camino Real
Negotiating Party: Jerry Engen
For Plaza Camino Real c/o Westfield, LLC
2. GOVERNMENT CODE SECTION 54956.9(a). As successor to the former Housing and
Redevelopment Commission, to hold a closed session regarding pending litigation as
follows:
Carlsbad Energy Center LLC's Application for Certification (AFC Docket No. 07-
AFC-6) to the California Energy Commission to develop a new thermal power
plant at the existing Encina Power Station in the City of Carlsbad.

RECONVENE:
The Council reconvened at 5:43 p.m. with all members present. Mayor Hall announced that -
Item #1 - the Council heard and considered the information and directed the City Attorney and
staff in what it believes to be in the best interests of the citizens of Carlsbad. No final action was
taken and it will be reported out at a future meeting when final action is taken.
Item #2 - the Council unanimously authorized to City Attorney to file a Petition for Review by the
California Supreme Court.
ADJOURNMENT:
By proper motion, the Special Meeting of June 5, 2012, was adjourned at 5:45 p.m.
