CITY COUNCIL (Regular Meeting)
DATE OF MEETING: July 24, 2012

CALL TO ORDER: Mayor Hall called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present: Council Members Hall, Kulchin, Blackburn, Douglas and Packard.
Absent: None.
APPROVAL OF MINUTES:
On a motion by Mayor Pro Tem Kulchin, the minutes of the following meetings were
unanimously approved as presented:

PRESENTATION:
Council Member Blackburn presented a proclamation in recognition of National Night Out,
August 7, 2012 to Capital Rowand and Lieutenant Mendes ofthe Carlsbad Police
Department.
PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION:
Mayor Hall announced that City Council as the Successor Agency to the former
Redevelopment Agency met in closed session on Tuesday, July 24, 2012 to discuss two
items. The first item discussed was concerning the City joining litigation against the County
of San Diego and the State of California commenced in the Sacramento Superior Court, if
necessary and appropriate, regarding Assembly Bill 1484. The City Council voted (4/1 -
Douglas absent) not to join the proceedings in this case at this time.
The second item discussed was labor negotiations with CCEA. The City Council heard
and considered the information and directed the City Attorney and staff in what it believes
to be in the best interests of the citizens of Carlsbad. No final action was taken and it will
be reported out at a future meeting when final action is taken.

CONSENT CALENDAR:
ACTION: On a motion by Mayor Pro Tem Kulchin, Council affirmed the action of
the Consent Calendar, Items #1 through #5 as follows:
AYES: Hall, Kulchin, Blackbum, Douglas and Packard.
NOES: None.
WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.
1. AB #20.969 - APPROVE WEED ABATEMENT COST ASSESSMENTS.
Council adopted RESOLUTION NO. 2012-183. approving the report ofthe Fire
Department showing the cost of weed abatement against each parcel, confirming
the cost, and providing for collection on the regular tax bill.
2. AB #20.970 - APPROVE REVISIONS TO THE CITY'S RECORDS RETENTION
SCHEDULE.
Council adopted RESOLUTION NO. 2012-184. approving revisions to the Records
Management 2012 Record Retention Schedule.
3. AB #20.971 - APPROVE AGREEMENT FOR AS-NEEDED STREET LIGHT REPAIR
AND MAINTENANCE SERVICES.
Council adopted RESOLUTION NO. 2012-185. approving the agreement with
Republic Intelligent Transportation Services (RITS) for as-needed street light repair
and maintenance services.
4. AB #20.972 - APPROVE OUT-OF-STATE TRAVEL REQUEST.
Council adopted RESOLUTION NO, 2012-186. approving the out-of-state travel
request for Police Department staff to grant final acceptance of the completed
BEARCAT armored vehicle in Pittsfield, Massachusetts, August 7 through August 9,
2012; and, authorizing the Finance Director to appropriate funds for the travel
request.
5. AB #20.973 - ADVERTISE FOR BIDS.
Council adopted RESOLUTION NO. 2012-187. approving contract specifications for
the Manual on Uniform Traffic Control Devices (MUTCD) Street Name Sign
Replacement Project; and, authorizing the City Clerk to advertise for bids. Project
No. 6035.
PUBLIC COMMENT:
Walt Meier came fonA/ard and addressed Council speaking in support of outsourcing parks
maintenance. He also requested that Council follow the City of Oceanside's example and
adopt regulations regarding recreafional vehicle parking in the city.

Katie Taylor and a representative from the Scandia Hotel in Carisbad came forward to
provide Council with an update regarding ongoing discussions with representatives ofthe
Army/Navy Academy regarding their concerns with the Army/Navy Academy's field
renovation project.
ADJOURNMENT TO THE SPECIAL MEETING OF THE CARLSBAD MUNICIPAL
WATER DISTRICT BOARD.
Mayor Hall adjourned to the Special Meeting of the Carisbad Municipal Water District
Board at 6:12 p.m. with five council members present.
RECONVENE:
Mayor Hall reconvened the Carlsbad City Council Meeting at 6:14 p.m. with five council
members present.
DEPARTMENTAL AND CITY MANAGER REPORTS:
6. AB #20.975 - ACCUMULATION PROGRAM FOR PART-TIME AND LIMITED-
SERVICE EMPLOYEES.
ACTION: On a motion by Council Member Blackburn, Council adopted
RESOLUTION NO. 2012-189. adopting the City of Carisbad
Accumulation Program for Part-Time and Limited-Service Employees
(APPLE) plan to provide retirement benefits in lieu of coverage under
Social Security or the existing Lincoln Financial Advisors Plan, and
authorizing and directing the Human Resources Director to execute all
necessary documents.
AYES: Hall, Kulchin, Blackburn and Douglas.
NOES: Packard.
7. AB #20.974 - PARKS AND RECREATION DEPARTMENT OPERATIONAL
ASSESSMENT REPORT.
Christine Smith, Principal and Shelley Fulla, Senior Manager from Baker Tilly provided the
PowerPoint presentation regarding the Parks and Recreation Operational Assessment
Report Baker and Tilly conducted on behalf of the City (on file in the Office of the City
Clerk).
Deputy City Manager Cynthia Haas and Paries and Recreation Director Chris Hazeltine
addressed staff recommendations to the Assessment Report with a PowerPoint
presentation (on file in the Office ofthe City Clerk).

Council Member Blackburn asked Mr. Hazeltine if it was possible for Council to compare a
true cost savings once the efficiencies outlined for immediate implementation had occurred
and outside vendor estimates had been obtained.
Mr. Hazeltine replied that Recreation Span of Control, Recreation Contractor Split,
utilization of the Online Registration Software and addressing the Senior Transportation
Services item could return quickly with savings, but other elements needed additional
analysis.
Ms. Haas, while reviewing the options fbr Council to consider, suggested that those
efficiencies that require fee and revenue changes be evaluated during the nonnal budget
process for the next fiscal year. She added that those items pertaining wages, benefits,
hours and other items that fall under the meet and confer process, be continued until
official negotiations begin with the Carisbad City Employees Association this fall.
In response to an inquiry from Council Member Packard regarding paid-time off for city
employees, Mr. Fulla explained that according to other government agencies, Carisbad
employees average 43 plus paid-time off days per year while the other agencies provide 38
paid-time off days per year to their employees. Ms. Fulla further explained that according
to the Bureau of Labor Statistics the nation has an average of 92.6% availability of days to
work while Carisbad has an 85.5% availability of days to work.
Council Member Douglas asked why preserve maintenance management was not
recommended for outsourcing in the report.
Ms. Fulla responded that the city currently outsources the majority of its preserve
maintenance at a low cost of service to the city.
In response to an inquiry from Council Member Douglas , Mr. Hazeltine explained that 54%
of the city's overall park acreage is maintained by vendors and are primarily the smaller
parks (Maxton Brown, Cadencia, etc.). The city's major paries that attract families with
children (Poinsettia, Calavera Hills, Stagecoach) are currently maintained by city staff.
Council Member Blackburn clarified and Deputy City Manager Haas concurred that Council
is not making a decision to contract for outside services but is giving direction to staff to
take the next step in the process.
Pam Drew, President of the City of Carisbad Employees' Association asked Council to
consider taking additional time before making a decision to review savings and allow the
operational efficiencies to be implemented.

citing the value and benefits city employees provide to the city of Carisbad and its
residents:

Option No. 1.
RECESS:
Mayor Hall adjourned the meeting at 8:41 p.m. with five council members present.
RECONVENE:
Mayor Hall reconvened the meeting at 8:46 p.m. with five council members present.
Mayor Hall invited Ms. Drew to return to the podium for further discussion with Council.
Ms. Drew stated that if Council did choose the RFP process that she would like the
Association and pari<s management to woric together gathering the data; however, she
added she was not ready to make a commitment on behalf of the Association at this time.
Ms. Drew again asked Council to take additional time before making decisions on the
recommendations.
Council Member Blackburn explained that Council's responsibility is to ensure that it makes
its decision on the recommendations in this report with all the accurate infomiation it can
obtain. He said that in order for him to make a decision on this matter he would like to have
the data that can only be obtained through the formal RFP process.
Discussion ensued among Council Members and staff regarding the options presented and
the meet and confer process with the Employees' Association.
It was detennined that if Council chose Option Nos. 1 or No. 2, the meet and confer
process would be initiated with the City of Carisbad Employees' Association.
Ms. Smith added that during the assessment ten (10) vendors were contacted to obtain
bids on parks maintenance services. Only one vendor provided a quote. She said that six
vendors expressed interest until they learned the request was not a formal request for
proposals (RFP). Ms. Smith further added that the city may not be able to obtain the data
Council is seeking without a fonnal RFP process.
Mayor Hall stated a similar study was presented to Council in June 2004 and it contained
many similar findings that are in the Baker Tilly report.
Mayor Hall indicated that he favored Option No. 1 in order to obtain real numbers that will
allow Council Members to make a decision that is in the best interest of the city. Council
Members Kulchin, Blackburn and Douglas and Packard concurred.

ACTION: On a motion by Mayor Pro Tem Kulchin, Council accepted the
Baker Tilley Operational Assessment Report on the Parks and
Recreation Department; and, directed staff to proceed with
Option No. 1 of staff's recommendations to the report to pursue
contracting for all parks maintenance services and initiate the
meet and confer process with the City of Carisbad Employees'
Association.
