HomeMy WebLinkAbout2012-09-25; City Council; Minutes (3)MINUTES MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting) DATE OF MEETING: September 25, 2012 TIME OF MEETING: 3:30 p.m. PLACE OF MEETING: City Hall Conference Room 3, 1200 Carlsbad Village Drive, Carlsbad, California CALL TO ORDER: Mayor Hall called the Meeting to order at 3:31p.m. ROLL CALL was taken by the Deputy City Clerk, as follows: Present: Hall, Kulchin, Blackburn, Douglas, Packard. Absent: None. PUBLIC COMMENT ON AGENDA ITEM: None. CLOSED SESSION: Council adjourned into Closed Session at 3:33 p.m. pursuant to the following: 1. GOVERNMENT CODE SECTION 54957.6. To hold a closed session to discuss employer- employee relations, salaries, salary schedules and compensation in the form of fringe benefits of its employees represented by CPMA with designated staff as labor negotiators (Cynthia Haas, Deputy City Manager, Julie Clark, Human Resources Director, Debbie Porter, Senior Management Analyst, Cheryl Gerhardt, Human Resources Professional) and Steve Berliner, Liebert, Cassidy & Whitmore. If circumstances necessitate the absence of a specified designated representative, an agent or designee may participate in place of the absent representative so long as the name of the agent or designee is announced at an open session held prior to the closed session. 2. GOVERNMENT CODE SECTION 54957.6. To hold a closed session to discuss employer- employee relations, salaries, salary schedules and compensation in the form of fringe benefits of its unrepresented employees with designated staff (Cynthia Haas, Deputy City Manager, Julie Clark, Human Resources Director, Debbie Porter, Senior Management Analyst, Cheryl Gerhardt, Human Resources Professional) and Steve Beliner, Liebert, Cassidy & Whitmore. If circumstances necessitate the absence of a specified designated representative, an agent or designee may participate in place of the absent representative so long as the name of the agent or designee is announced at an open session held prior to the closed session. 3. GOVERNMENT CODE SECTION 54957. To hold a closed session to discuss and consider the appointment of a City Attorney as a result of the announced retirement of the incumbent City Attorney. 4. GOVERNMENT CODE SECTION 54956.9(c). To hold a closed session to consider initiation of litigation against Bao Ngoc Tran, Lui Lydia Li and JP Morgan Chase Bank NA regarding a loan for property located at: 7003 Forsters Tern Drive, Carlsbad CA 92011 5. GOVERNMENT CODE SECTION 54956.9(a). To hold a closed session to discuss pending litigation as follows: Holbrook v. City of Carlsbad, et al. Case No. 37-2011-0008906-CU-PA-CTL. RECONVENE: The Council reconvened at 5:47 p.m. with five members present. Mayor Hall announced that the City Council met in closed session at 3:30 p.m. to discuss five items: The City Council directed the City Attorney to begin foreclosure proceedings against Bao Ngoc Tran, Lui Lydia Li and JP Morgan Chase Bank. The City Council also approved a proposal from William Avery and Associates for executive search services for recruitment of a new city attorney and directed the City Attorney to send a letter of acceptance. That proposal is on file with the Human Resources Department. For the remaining items, the City Council directed the City Attorney in what it felt was in the best interest of the citizens of Carlsbad. There was no final action taken on these items, and they will be reported at a future meeting when final action occurs.
