MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting)
DATE OF MEETING: December 17, 2013
TIME OF MEETING: 4:00 p.m.
PLACE OF MEETING: City Hall Conference Room 3,1200 Carlsbad Village Drive, Carlsbad,
California
CALL TO ORDER: Mayor Hall called the meeting to order at 4:01 p.m.
ROLL CALL was taken by the Deputy City Clerk, as follows:
Present: Council Members Hall, Packard, Wood, Blackburn and Douglas.
Absent: None.
PUBLIC COMMENT ON AGENDA ITEM: None.
CLOSED SESSION: Council adjourned into Closed Session at 4:02 p.m. pursuant to the following:
1. GOVERNMENT CODE SECTION 54957.6. To hold a closed session to discuss employer-
employee relations, salaries, salary schedules and compensation in the form of fringe
benefits of its employees represented by CFA and CPMA with designated staff as labor
negotiators (Julie Clark, Human Resources Director, Debbie Porter, Senior Management
Analyst, Cheryl Gerhardt, Human Resources Professional and Steve Berliner, Liebert
Cassidy & Whitmore). If circumstances necessitate the absence of a specified
designated representative, an agent or designee may participate in the place ofthe
absent representative so long as the name of agent or designee is announced at an
open session held prior to the closed session.
2. GOVERNMENT CODE SECTION 54956.9(c). To hold a closed session to consider
initiation of litigation against State of California regarding the implementation of Senate
Bill 7.
3. GOVERNMENT CODE SECTIONS 54956.9(b)(3)(C) and 54957.5. To hold a closed session
to discuss significant exposure to litigation as follows:
Based on existing facts and circumstances regarding receipt of a claim against
the City of Carlsbad pursuant to the Tort Claims Act and available for public
inspection.

4. GOVERNMENT CODE SECTION 54957. To hold a closed session to consider and discuss
the appointment of a City Manager.
RECONVENE:
The Council reconvened at 5:15 p.m. with five members present. Mayor Hall announced that Council
met in closed session at 4:00 p.m. to discuss four items.
Items #1, #3 and #4 - the Council deliberated on what is in the best interests ofthe City and its citizens
but took no final action. Final action, when taken, will be reported out at a subsequent meeting.
Item #2 - the City Council gave unanimous direction to join a legal challenge with other charter cities
against the State of California regarding the constitutionality ofthe recently enacted Senate Bill 7. This
law, if allowed to stand, erodes charter city authority.
ADJOURNMENT:
By proper motion, the Special Meeting of December 17, 2013 was adjourned at 5:18 p.m.
