ROLL CALL: Hall, Packard, Wood, Schumacher, Blackburn. INVOCATION: None. PLEDGE OF ALLEGIANCE: Council Member Schumacher led the Pledge of Allegiance. APPROVAL OF MINUTES: Approved 4-1, with Council Member Schumacher abstaining on the February 25, 2014 minutes. Minutes ofthe Regular Meeting held February 25, 2014. Minutes ofthe Special Meeting held March 18, 2014. PRESENTATION: Council Member Wood presented a proclamation to Aaron Byzak, President ofthe North Coastal Prevention and Coalition and John Byrom, Prevention Specialist with NCPC and Vista Community Clinic, recognizing Prescription Drug Abuse Awareness Month. Mayor Hall introduced Chris Hazeltine, Parks and Recreation Director and Ryan Gold from Carlsbad Lightning Soccer Club who presented the City Council with a donation. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None. CONSENT CALENDAR: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve items 1-4, and 6-8, motion carried unanimously. 1. AB #21,535 - Adopted Resolution No. 2014-045, entitled, "A Resolution ofthe City Council of the City of Carlsbad, California, accepting donation totaling $8,000 from Carlsbad Lightning Soccer Club in support ofthe opportunity grants scholarship program and appropriation of received funds." March 25, 2014 Page 1 2. AB #21,536 - Adopted Resolution No. 2014-046, entitled, "A Resolution of the City Council of the City of Carlsbad, California, accepting the finding recommendation of the community activity gran citizen review committee and approving the disbursement of funds to the identified organizations on a reimbursement basis only." 3. AB #21,537 - Adopted Resolution No. 2014-047, entitled, A Resolution of the City Council of the City of Carlsbad, California, approving the final map for CT 11-02, La Costa Vista generally located at 7500 Jerez Court." 4. AB #21,538-Adopted Resolution No. 2014-048, entitled, "A Resolution ofthe City Council of the City of Carlsbad, California, authorizing out-of-state travel to attend Gartner Enterprise architecture Summit." 5. AB #21,539 - Adopted Resolution No. 2014-049, entitied, "A Resolution ofthe City Council for the City of Carlsbad, California, approving a professional service agreement with Dover, Kohl & Partners to prepare a Master Plan for the Barrio and Village." ACTION: Motion by Council Member Blackburn, seconded by Council Member Wood, motion carried 3-2 with Mayor Hall and Mayor Pro Tem Packard absent on Item 5. Mayor Hall and Mayor Pro Tem Packard left the Council Chamber at 6:26 p.m. and returned to the dais at 7:07p.m. 6. AB #21,540 - Adopted Resolution No. 2014-050, entitled, "A Resolution of the City Council of the City of Carlsbad, California, declaring as public nuisances, weeds, rubbish, and refuse upon private property in the City of Carlsbad Weed Abatement Program," and set a public hearing for April 22, 2014. 7. AB #21,541 - Adopted Resolution No. 2014-051, entitled, "A Resolution ofthe City Council of the City of Carlsbad, California, authorization ofthe Settlement of Worker's Compensation Claim of Nicholas Lutes." 8. AB #21,542 - Acceptance of the report on City Investments as of February 28, 2014. DEPARTMENTAL AND CITY MANAGER REPORT: 15. AB #21,549 - Carlsbad Desalination Project Update. Peter MacLaggan with Poseidon Resources presented the monthly update on the Desalination Pipeline Construction Project. Frank Belock with the San Diego County Water Authority detailed work being done on Cannon Road and the tunneling that has begun on Faraday Avenue. More tunnels are being added to help alleviate the impact to traffic. ACTION: Receive and file. ORDINANCES FOR INTRODUaiON: 9. AB #21,543 - First Reading and Introduction of Ordinance No. CS-245, entitled, "An Ordinance ofthe City Council ofthe City of Carlsbad, California, amending Carlsbad Municipal Code, Title 18, Chapter 18.04 (Building Code); Chapter 18.08 (Mechanical Code); Chapter 18.12 (Electrical Code); Chapter 18.16 (Plumbing Code); Chapter 18.18 (Solar Energy Code); Chapter 18.20 (Residential Code); Chapter 18.21 (Green Building Standards Code); and Chapter 18.30 (Energy Conservation Regulations) and repealing Chapter 18.28 (Swimming Pool Enclosure and Use)." Will Foss, Building and Code Enforcement Manager and Mike Lopez, Fire Division Chief presented the item. City Attorney Brewer read the ordinance by title only. ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve, motion carried unanimously. 10. AB #21,544 - First Reading and Introduction of Ordinance No. CS-246, entitled, "An Ordinance of the City Council of the City of Carlsbad, California, repealing existing Chapter 17.04 and adopting a new Chapter 17.04, Fire Prevention Code based on the 2013 California Fire Code." Will Foss, Building and Code Enforcement Manager and Mike Lopez, Fire Division Chief presented the item. City Attorney Brewer read the ordinance by title only. ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve, motion carried unanimously. 11. AB #21,545 - First Reading and Introduction of Ordinance CS-247, entitled, "An Ordinance of the City Council of the City of Carlsbad, California, amending Title 10, Chapter 10.44 of the Carlsbad Municipal Code by revision of Section 10.44.210(c) to reduce the 40 mile per hour speed limit upon Alicante Road from Poinsettia Lane to Gateway Road to 30 miles per hour. Will Foss, Building and Code Enforcement Manager and Mike Lopez, Fire Division Chief presented the item. City Attorney Brewer read the ordinance by title only. ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve, motion carried unanimously. ORDINANCE FOR ADOPTION: 12. AB #21,546 - Second Reading and adoption of Ordinance No. CS-244, entitled, "An Ordinance ofthe City Council ofthe City of Carlsbad, California adopting Master Plan Amendment MP 20-03(E) to modify the location of Planning Area 4, within the previously approved Robertson Ranch Master Plan for the West Village on 201.37 acres of land located north of El Camino Real, south of Tamarack Avenue and west of Cannon Road in Local Facilities Management Zone 14." City Attorney Brewer read the ordinance by title only. ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve, motion carried unanimously. PUBLIC COMMENT: None. PUBLIC HEARINGS: 13. AB #21,547 - First Reading and Introduction of Ordinance No. CS-248, entitled, "An Ordinance of the City Council of the City of Carlsbad, California, approving an amendment to the Car Country Specific Plan, SP 19(j) to 1) update the Car Country Comprehensive Sign Program by modifying the existing sign standards, and 2) to streamline the permit and review process for minor improvements," and adopt Resolution No. 2014-052, entitled, "A Resolution ofthe City Council of the City of Carlsbad, California, approving a Local Costal Program Amendment for the Car Country Specific Plan SP 19(j) to 1) update the Car Country Comprehensive Sign Program by modifying the existing sign standards, and 2) to streamline the permit and review process for minor improvements on property generally located on the south side of Cannon Road, north and west of Car Country Drive, and east of Interstate 5 within the Mello II Segment ofthe Local Coastal Program and Local Facilities Management Zone 3. Mayor Hall opened the duly noticed public hearing at 6:58 p.m. Associate Planner Barbara Kennedy and Assistant City Manager Gary Barberio gave the PowerPoint Presentation. Speakers in Support: J.P. ACTION: Motion by Mayor Pro Tem Packard to close the public hearing and schedule second reading of the ordinance, seconded by Council Member Blackburn to approve, motion carried unanimously. 14. AB #21,548 - First Reading and Introduction of Ordinance No. CS-249, entitled, "An Ordinance ofthe City Council ofthe City of Carlsbad, California, Approving a Zone Code Amendment to Ordinance CS-191 to remove text that specifies the number of persons allowed per transitional and supportive housing unit; amend the transitional and supportive housing definitions to state they are residential uses subject to only those restrictions that apply to other residential uses of the same type in the same zone; make other related, minor changes," and adopt Resolution No. 2014-053, entitled, "A Resolution ofthe City Council of the City of Carlsbad, California, approving Local Costal Program Amendment to Transitional and Supportive Housing." Mayor Hall opened the duly noticed public hearing at 8:53 p.m. Associate Planner Pam Drew gave the PowerPoint Presentation. City Attorney Brewer read the ordinance by title only. ACTION: Motion by Mayor Pro Tem Packard to close the public hearing and schedule second reading ofthe ordinance, seconded by Council Member Blackburn to approve, motion carried unanimously. DEPARTMENTAL AND CITY MANAGER REPORTS: 16. AB #21,550 - Adoption of Resolution No. 2014-054, entitled, "A Resolution ofthe City Council ofthe City of Carlsbad, California, approving Public Artwork Concept Design for the Coastal Rail Trail Roundabout." Vincent Kitch, Cultural Arts Manager presented a PowerPoint Presentation and simulation of art project. ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve, motion carried unanimously. 17. AB #21,551-Adoption of Resolution 2014-055, entitled, "A Resolution ofthe City Council of the City of Carlsbad, California, approving the design/build contract with Independent Energy Solutions (ies) for a Solar Photovoltaic System at Alga Norte Community Park Project No. 3925 and 3837." Patrick McGarry Public Works Superintendent presented report via PowerPoint Presentation. Speakers in Support: David Voss, Christine Bevilacqua, Kerry Siekmann ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve, motion carried unanimously. 18. AB #21,552 - Reorganization ofthe City Council and City Council Committee Appointments. ACTION: Council Member Schumacher has been appointed to represent the City on the following regional boards and committees: Buena Vista Lagoon JPC, SANDAG Board of Directors (1'^ Alternate), SANDAG Borders Committee (1'* Alternate), SANDAG Shoreline Preservation Committee, Chamber of Commerce Liaison, and City/School Committee. Motion by Mayor Hall and seconded by Mayor Pro Tem Packard to approve, motion carried unanimously. PUBLIC COMMENT: Cindy Piro spoke on the consideration to delay the sale of the City reservoir and consider a small neighborhood park for the northwest Carlsbad area. COUNCIL REPORTS AND COMMENTS: Mayor Hall and Council Members reported on activities and meetings of some committees and sub-committees of which they are members. CITY MANAGER COMMENTS: Alga Norte Community Park has been selected for 2014 Project ofthe Year Award, by the San Diego Chapter of American Public Works Association. CITY ATTORNEY COMMENTS: None.
