APPROVAL OF MINUTES: Motion by Mayor Pro Tem Packard, seconded by Council Member Blackburn to approve minutes, motion carried unanimously. Minutes ofthe Regular Meeting held April 15, 2014. Minutes ofthe Special Meeting held May 20, 2014. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None. PRESENTATIONS: Mayor Hall introduced Suzanne Smithson, Deputy Library Director who also introduced members ofthe Historic Preservation Commission Raul Diaz and Chris Garcia. Mayor Pro Tem Packard presented a proclamation in recognition of National Historic Preservation Month to Raul Diaz and Chris Garcia, Historic Preservation Commission. Certificates were awarded to 3'^'' grade students who participated in the Historic Preservation Commission Art Contest. All artwork will be on public display at the Cole Library throughout the summer. CONSENT CALENDAR: City Manager Sarkozy informed Council of a revised resolution for Item #8 incorporating changes making it apply only to uninsured costs, in addition. Item #18 was pulled out of order to be included in the motion and action with the Consent Calendar items. Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve items 1-12, and Item #18 approving Resolution 2014-118, motion carried unanimously, with amendments to Item #8 Resolution No. 2014-112. CITY OF CARLSBAD CITY COUNCIL MEETING MINUTES June 3, 2014 1. AB #21,608 - Adopted Resolution No. 2014-105, approving Amendment No. 1 to extend the existing ground lease agreement with Callaway Golf Company, for five years, in the amount of $26,795.52 per year with a 3.5% increase per year, for property owned by the City of Carlsbad consisting of 0.843 acres, identified as Assessor's Parcel Number 212-270-08-00, and authorizing the Mayor to execute ail documents. 2. AB #21,609 - Adopted Resolution No. 2014-106, approving the Carlsbad Tourism Business Improvement District (CTBID) Annual Report, and authorizing the CTBID programs and assessments for Fiscal Year 2014-15. 3. AB #21,610 - Adopted Resolution No. 2014-107, approving the Carlsbad Golf Lodging Business Improvement District (CGLBID) Annual Report, and authorizing the CGLBID programs and assessments for Fiscal Year 2014-15. 4. AB #21,611 - Adopted Resolution No. 2014-108, authorizing a special event grant to the California Beach Foundation for the 7*^ annual Beach Fest to be held on June 14, 2014, and authorizing the administrative services director to appropriate and disburse said funds in the amount of $9,986. 5. AB #21,612 - Adopted Resolution No. 2014-109, awarding the contract for the Northwest Quadrant Storm Drain Improvement Program, (Valley Street, Highland Drive and Linda Lane), Project No. 6608, to Southland Paving, Inc. in the amount of $633,178, and authorizing the Mayor to execute said contract. 6. AB #21,613 - Adopted Resolution No. 2014-110, accepting as complete the contract for construction of Alga Norte Community Park Phase 1, Project No. 3837A, and directingthe City Clerk to record a Notice of Completion and release bonds in accordance with state law and city ordinances. 7. AB #21,614 - Adopted Resolution No. 2014-111, approving an amendment and extension of the professional services agreement between the City of Carlsbad and RBF Consulting for plan checking services, and increasing the not to exceed amount from $90,000 to $200,000 per agreement year. ITEM PULLED FOR DISCUSSION 8. AB #21,615 - Adopted Resolution No. 2014-112, approving a waiver of building permit fees associated with rebuilding or repairing single-family residential structures that were destroyed or damaged by the Poinsettia Fire. 9. AB #21,616-Adopted Resolution No. 2014-113, revising the management compensation and benefits plan, amending the conflict of interest code and establishing new management job classifications for Utilities Director, Utilities Manager, Utilities Maintenance Planner and Meter Services Supervisor. 10. AB #21,617 - Adopted Resolution No. 2014-114, approving the terms of an encroachment agreement for 2,700 square feet of outdoor dining on the southeast portion ofthe parking CITY OF CARLSBAD CITY COUNCIL MEETING MINUTES June 3, 2014 lot at the Plaza Camino Real shopping center, and authorizing the Mayor to execute said agreement. 11. AB #21,618-Adopted Resolution No. 2014-115, proclaiming the continuing existence ofthe May 20, 2014 local emergency due to extreme peril to the safety conditions of persons and property caused by a wildfire in Carlsbad. 12. AB #21,619 - Accepted and filed the City Treasurer's Report on City Investments as of April 30, 2014. ITEM PULLED OUT OF ORDER AND INCLUDED IN THE VOTE WITH THE CONSENT CALENDAR ITEMS. 18. AB #21,625 - Approval of Resolution No. 2014-118, appointing David Kirken to the Carlsbad Tourism Business Improvement District Board (CTBID). ORDINANCES FOR ADOPTION: Mayor Hall left the Council Chamber at 6:22 p.m. and returned to the dais at 6:24 p.m. 13. AB #21,620 - Held second reading and adopted Ordinance Nos. CS-253, CS 254 and CS 255, Ordinance No. CS-253 repealing Ordinance CS-158, and revoking an amendment to Zoning Ordinance Chapter 21.36, Public Utility Zone, and specifically to Table "A" of Section 21.36.020, Permitted Uses, regarding generation and transmission of electrical energy. Case No: ZCA 14-01; and. Ordinance No. CS-254, approving an amendment to the Encina Power Station Precise Development Plan PDP 00-02(F) located at 4600 Carlsbad Boulevard, along the south shore ofthe Agua Hedionda Lagoon and west of Interstate 5 and within Local Facilities Management Zones 1 and 3. Case No. PDP 00-02(F); and. Ordinance No. CS-255, repealing the Encina Specific Plan SP 144, located between the Pacific Ocean and Cannon Road, and encompassing the Agua Hedionda Lagoon, Encina Power Station, Carlsbad Seawater Desalination Plant, agricultural lands and properties within Local Facilities Management Zones 1, 3 and 13. Case No. SP 144(0). City Attorney Brewer read the Ordinances by title only. No Public Speakers. ACTION: Motion by Mayor Pro Tem Packard, seconded by Council Member Blackburn to adopt Ordinance Nos. CS-253, CS-254, and CS-255, motion carried 4-0, with Mayor Hall absent. PUBLIC COMMENT: Janann Taylor, protection of land located in "Old Carlsbad" Mary Ann Viney, spoke on parcels located near Cole Library in "Old Carlsbad" PUBLIC HEARING: 14. DEPARTMENTAL AND CITY MANAGER REPORTS: 15. AB #21,622 - Received a presentation from Kenneth Conrad regarding complaints of noise at Alga Norte Community Park. Mayor Hall announced a break at 7:32 p.m. Mayor Hall called the meeting back into regular session at 7:40 p.m. with all Council Members present. 16. AB #21,623 - Received the report on the Fiscal Year 2014-15 Preliminary Operating Budget Workshop. City Manager Sarkozy introduced the item and asked that the public hearing be set for the June 17, 2014 Regular City Council meeting. He also announced that on June 5, 2014 staff would be holding a Citizen Operating Budget Workshop at the Faraday Administration Building to review the budget. CITY OF CARLSBAD CITY COUNCIL MEETING MINUTES June 3, 2014 Presentation of report by Administrative Services Director, Chuck McBride and Finance Manager, Helga Stover, via a PowerPoint Presentation. Gary Morrison, Police Chief gave an overview of the Police Department budget; Fire Chief Mike Davis presented a request for new equipment in the budget for the Fire Department; Heather Pizzuto, Library and Cultural Arts Director presented the operating budget for her division; Glen Van Peski, Community and Economic Development presented branding efforts and technology upgrades as a portion of the budget; Interim Public Works Director, Jim Howell's presentation focused on budget highlights for Public Works including the installation of "smart" manhole covers; Chris Hazeltine, Director ofthe Parks and Recreation Department announced the Parks Master Plan updates and coastal bluff maintenance. No Public Speakers. ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to receive the report and set the public hearing for June 17,2014, motion carried unanimously. Mayor Hall left the Council Chamber at 8:32 p.m. and returned to the dais at 9:17 p.m. 17. AB #21,624 - Adoption of Resolution No. 2014-117, denying sign permit application no. PS 13-110 and declining the offer to fabricate, install and donate to the City of Carlsbad a community archway sign that would cross Carlsbad Boulevard north of Carlsbad Village Drive. Case No. PS 13-110. City Manager Sarkozy introduced the item. Presentation of report by Associate Planner Pam Drew, via a PowerPoint Presentation. Speakers in Support: Tina Schmidt, Judy Marx, Gary Nessom Speakers in Opposition: Ted Owen, Chamber of Commerce, Mike Howes, Jessica Jones, Sandy Lund Council Options: #1 - Approve the sign application as submitted and as shown on Exhibit 4 ofthe Agenda Bill. #2 - Approve the sign application with Council directed modifications (i.e. color, material, design, etc.) #3 - Defer action on the sign application, with the consensus of the applicant, pending completion ofthe Village Master Plan process. ACTION: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to choose option #1 - approving sign application as submitted and as shown on Exhibit 4 ofthe Agenda Bill with conditions to address (a) compliance with Policy 79 - regarding corporate sponsorships as it relates to the plaque requested be placed on the sign acknowledging donation and (b) staff to work to assure appropriate lighting of the sign. Motion carried 4-0, with Mayor Hall absent. CITY OF CARLSBAD CITY COUNCIL MEETING MINUTES June 3, 2014 Resolution of approval will be prepared to allow Council to confirm its decision on a future consent calendar agenda. PUBLIC COMMENT: None.
