INVOCATION: None. PLEDGE OF ALLEGIANCE: Council Member Schumacher led the Pledge of Allegiance. APPROVAL OF MINUTES: Motion by Mayor Pro Tem Packard, seconded by Council Member Blackburn to approve the minutes, motion carried 5-0. Minutes ofthe Special Meeting held July 22, 2014. Minutes ofthe Regular Meeting held July 22, 2014. PRESENTATIONS: None. PUBUC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: There was no reportable action from closed session. CONSENT CALENDAR: Motion by Mayor Pro Tem Packard and seconded by Council Member Blackburn to approve items 1-10, motion carried 5-0. 1. AB #21,708-Accepted the report on City Investments as of June 30, 2014. 2. AB #21,709-Adopted Resolution No. 2014-202, approving Amendment No. Ito the FY 2013 Operation Stonegarden Grant accepting $28,000 awarded to the Carlsbad Police Department to extend participation in joint anti-smuggling operations. 3. AB #21,710 - Adopted Resolution No. 2014-203, accepting the contract for construction of Palomar Airport Road and College Boulevard intersection improvements. Project Nos. 6028 and 6029 as complete and directing the City Clerk to record the Notice of Completion and release bonds in accordance with state law and city ordinances. 4. AB #21,711 - Adopted Resolution No. 2014-204, accepting a donation of equipment in the amount of $13,539.60 purchased by the Carlsbad Fire Department Foundation for the Carlsbad Fire Department. Equipment donated are mono-coupling kits and super swivels for the existing Amkus rescue tools. CITY OF CARLSBAD CITY COUNCIL MEETING MINUTES August 26, 2014 5. AB #21,712 - Adopted Resolution No. 2014-205, accepting bids and awarding a contract for construction of El Camino Real widening, median improvements, undergrounding utilities, and upgrading traffic signals, Project Nos. 3957, 3643, 6302 and 6303. 6. AB #21,713 - Adopted Resolution No. 2014-206, accepting the contract with American Asphalt South, Inc. for construction of the 2013 Slurry Seal, Project No. 6001-13SS, as complete and directing the City Clerk to record a Notice of Completion and release bonds in accordance with state law and city ordinances. 7. AB #21,714 - Adopted Resolution No. 2014-207, approving the Joint Use and Community Recreation Agreement between the Carlsbad Unified School District and City of Carlsbad to maintain and utilize multipurpose field areas, tennis courts and school grounds. 8. AB #21,715 - Adopted Resolution No. 2014-208, accepting the contract with All American Asphalt for construction ofthe 2012 Pavement Overlay, Project No. 6001-12OL as complete and directing the City Clerk to record the Notice of Completion and release bonds in accordance with state law and city ordinances. 9. AB #21,716 - Adopted Resolution No. 2014-209, approving plans and specifications and authorizing the City Clerk to advertise for bids for the North Batiquitos Lift Station Pump Replacement, Project No. 5517. 10. AB #21,717 - Adopted Resolution No. 2014-2010, approving Amendment No. 5 to amend and fund the agreement for median, parkway and landscape maintenance services with Nissho of California, Inc. in the amount of $455,211 for the removal and replacement of landscaping and irrigation damaged during the 2014 Poinsettia fire; and, adopted Resolution No. 2014-2011, approving Amendment No. 4 to amend and fund the agreement for parks and facilities landscape maintenance services with Westturf Landscape Management, Inc. in the amount of $66,102 for the removal and replacement of landscaping and irrigation damaged during the 2014 Poinsettia fire. ORDINANCES FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: 11. AB #21,718 - Adopted Ordinance No. CS-260, amending Section 21.05.030 of the Carlsbad Municipal Code by an amendment to the Zoning Map to grant a zone change from Limited Control (L-C) to One-Family Residential (R-l) and Open Space (OS) on a 4.53 acre property located on the southeast corner of Fisherman Drive and Poinsettia Lane. yVo public speakers. ACTION: On a motion made by Mayor Pro Tem Packard and seconded by Council Member Blackburn, motion carried unanimously to adopt Ordinance No. CS-260. CITY OF CARLSBAD CITY COUNCIL MEETING MINUTES August 26, 2014 12. AB #21,719 - Adopted Ordinance No. CS-259, amending Carlsbad Municipal Code Section 2.06.070 Appointments to Mayor and City Council appointed boards, commissions and committees. No public speakers. City Attorney Brewer read the ordinance by title only. ACTION: On a motion made by Mayor Pro Tem Packard and seconded by Council Member Blackburn, motion carried unanimously to adopt Ordinance No. CS-259. PUBUC COMMENT: Paige Decino gave a Power Point presentation on the Preserve Calavera Endangered Species Day and Art Contest in which 160 Carlsbad students grades pre-k through 5*"^ grade participated. Christine Bevilacqua thanked the City Council for its support of the Carlsbad Calaveras Schoolhouse Community Garden. PUBUC HEARING: None. Mayor Hall adjourned to the Special Meeting of the Carlsbad Municipal Water District Board at 6:09 p.m., meeting reconvened at 6:10 p.m. with all Council Members present. Mayor Hall reconvened the City Council Meeting at 6:11 p.m. with all Council Members present. DEPARTMENTAL AND CITY MANAGER REPORTS: 18. AB #21,721 - Receive a presentation from representatives of Poseidon Resources and the San Diego County Water Authority regarding the construction progress on the Carlsbad Desalination Project. Jessica Jones, Poseidon Water, and Frank Belock, General Manager with the San Diego County Water Authority, gave an update presentation ofthe work done to date. ACTION: Received presentation. 19. AB #21,722 - Approval of Resolution No. 2014-214, approving agreements with Tyler Technologies, Inc. for professional services and product and service maintenance associated with an integrated community development system for the purpose of modernizing and enhancing land management and licensing processes. City Manager Sarkozy introduced Development Services Manager Mike Peterson and Management Analyst Christie Marcella who gave a presentation via PowerPoint. No public speakers. ACTION: Mayor Hall made a motion to continue the item to a date undetermined, seconded by Mayor Pro Tem Packard, motion carried unanimously. PUBUC COMMENT: None. CITY OF CARLSBAD CITY COUNCIL MEETING MINUTES August 26, 2014 COUNCIL REPORTS AND COMMENTS: Mayor Hall and Council Members reported on activities and meetings of some committees and sub-committees of which they are members.
