PUBUC COMMENT ON AGENDA ITEM: None. CLOSED SESSION: Council adjourned into Closed Session at 4:52 p.m. pursuant to the following: 1. CONFERENCE WITH REAL PROPERTY NEGOTIATORS: (Government Code Section 54956.8) Property: The Crossings at Carlsbad West View Lot 9, regarding purchase, sale, exchange or lease. City Negotiators: Gary Barberio, Assistant City Manager, and Chuck McBride, Administrative Services Director. Negotiating Parties: Grand Pacific Resorts. If circumstances necessitate the absence of a specified designated representative, an agent or designee may participate in place ofthe absent representative so long as the name of the agent or designee is announced at an open session held prior to the closed session. 2. CONSIDER PENDING LITIGATION: (Government Code Section 54956.9(a)) City of El Centro, City of Carlsbad, et al. v. State of California, et al. (SB 7). Case No. 37-2014-00003824-CU-WM-CTL September 9, 2014 Carlsbad City Council Special Meeting Page 2 RECONVENE: The Council reconvened at 5:25 p.m. with five members present. Item No. 1 - Mayor Hall announced that there was no reportable action taken. Item No. 2 - Mayor Hall announced that after discussion in closed session, the City Council voted unanimously to appeal the Superior Court decision in City of El Centro, et al. v. David Lanier, et al., denying the writ of mandate challenging SB 7. SB 7 is state legislation that impairs the right of charter cities to exercise "Home Rule" authority as authorized under the California Constitution. This law, if allowed to stand, erodes charter city authority.
