PLEDGE OF ALLEGIANCES: Council Member Schumacher led the Pledge of Allegiance. APPROVAL OF MINUTES: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Wood to approve minutes, motion carried unanimously. Minutes of the Regular Meeting held April 7, 2015. Minutes of the Regular Meeting held April 14, 2015. Minutes of the Regular Meeting held April 21, 2015. Minutes of the Special Meeting held April 21, 2015. Minutes of the Special Meeting held April 24, 2015. PRESENTATIONS: Mayor Hall introduced Council Member Wood who invited Doug Bilse, Traffic Engineer, and Phoenix Smith, SANDAG representative to the podium as she read the proclamation in recognition of SANDAG Bike Month and Bike to Work Day. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None. CONSENT CALENDAR: Motion by Mayor Pro Tem Blackburn and seconded by Council Member Wood to approve items 1-7, motion carried unanimously. WAIVER OF ORDINANCE TEXT READING: This is a motion to waive the reading of the text of all ordinances and resolutions at this meeting. 1. AB #21,947 - Adopted Resolution No. 2015-106, authorizing out of state travel for Fire Department personnel to attend The Summit in Denver Colorado, on May 11-15, 2015. AB #21,948 - Adopted Resolution No. 2015-107, accepting the construction of the 2014 Concrete Replacement Project No. 6013-14, as complete, and directing the city clerk to record a Notice of Completion, and release bonds in accordance with state law and city ordinances. 3. AB #21,949 - Adopted Resolution No. 2015-108, authorizing the city manager to sign a reimbursement agreement with the San Diego County Water Authority (SDCWA) in the amount of $975,000 for additional asphalt paving associated with installation of the Carlsbad desalination conveyance pipeline. 4. AB #21,950 - Adopted Resolution No. 2015-109, accepting bids and awarding the contract in the amount of $183,300 to Lekos Electric, Inc. for Faraday Avenue fiber optic installation. 5. AB #21,951-Adopted Resolution No. 2015-110, ratifying a Joint Operating and Financial Plan between the City of Carlsbad, California and the County of San Diego for animal control services. 6. AB #21,952 - Accepted of report on city investments as of March 31, 2015. 7. AB #21,953-Adopted Resolution No. 2015-111, appointing Kathryn B. Dodson as Interim City Manager. ORDINANCE FOR INTRODUCTION: None. ORDINANCE FOR ADOPTION: 8. AB #21,954 - Adopted Ordinance No. CS-272, amending the Carlsbad Municipal Code by adding Chapter 5.60 Short Term Vacation Rentals, establishing regulations governing short- term vacation rentals. ACTION: Motion by Mayor Pro Tem Blackburn and seconded by Council Member Wood, motion carried unanimously to adopt Ordinance No. CS-272. PUBLIC COMMENT: Patrick Foley spoke regarding a 7 ft. high chain link fence topped with barbed wire located in the La Costa Valley. AB #21,955 - Approval of Resolution No 2015-112, approving and authorizing the submittal of the FY 2015-2020 Analysis of Impediments to Fair Housing Choice, The FY 2015-2020 Consolidated Plan and the FY 2015-2016 Annual Action Plan for Community Development Block Grant (CDBG) to the U.S. Department of Housing and Urban Development. Interim City Manager Kathy Dodson introduced the item and Management Analyst Courtney Enriquez and Jessica Suimanjaya, consultant with Veronica Tam and Associates who provided an overview and PowerPoint Presentation. Speakers in Support: Socorro R. Anderson, Tom Maddox, Sister Raymonda Duvall ACTION: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Wood, motion carried unanimously to approve Resolution No. 2015-112. 10. AB #21,956 - Introduce Ordinance No. CS-274, approving a Specific Plan Amendment to increase the allowed number of levels from three to four for the habitable portions of buildings within the Carlsbad Ranch Specific Plan Planning Area 5, located north of Legoland California, south of Cannon Road, east of Legoland Drive, and west of The Crossings Golf Course in Local Facilities Management Zone 13, and adopt Resolution No. 2015-113, approving a Local Coastal Program Amendment LCPA 14-02 for the Carlsbad Ranch Specific Plan SP 207(J) to increase the allowed number of levels from three to four for the habitable portions of buildings within the Carlsbad Ranch Specific Plan Planning Area 5, located north of Legoland California, south of Cannon Road, east of Legoland Drive, and west of The Crossings Golf Course within the Mello II segment of the Local Coastal Program and Local Facilities Management Zone 13. Interim City Manager Kathy Dodson introduced the item and Senior Planner Christer Westman who provided a PowerPoint presentation outlining the project. Speakers in Support: Ted Owen, Bill Hoffman, developer Grand Pacific Carlsbad L.P. City Attorney Celia Brewer read the ordinance by title only. ACTION: Motion by Mayor Pro Tem Blackburn and seconded by Council Member Wood, motion carried unanimously to adopt Resolution No. 2015-113 and to hold first reading of Ordinance No. CS-274, by title only, and scheduled the second reading and adoption on May 19, 2015. Mayor Hall adjourned the meeting for a brief recess at 7:10 p.m. and reconvened the meeting at 7:18 p.m. with all Council Members present. May 5, 2015 Carlsbad City Council Regular Meeting Page 4 11. AB #21,957 - Approval of Resolution No 2015-114, denying Gunther Guns' shooting range appeal and upholding the decision of the Planning Commission to deny the appeal and uphold the City Planner's determination that an indoor shooting range is not a permitted or conditionally-permitted use in the Planned Industrial (P-M) zone, nor is it substantially similar to a permitted or conditionally-permitted use in the P-M zone, MCUP 14-17. Interim City Manager Kathy Dodson introduced the item and City Planner Don Neu who provided a PowerPoint presentation providing an overview of the project being appealed. Leslie Devaney, Attorney for the appellant Gunther Guns' provided a statement and PowerPoint presentation. Lisa Gunther spoke on behalf of Gunther Guns' and the determinations made by the Planning Commission and City Planner Don Neu denying Gunther Guns' shooting range appeal. Speakers in Support of City Manager's Recommendation: Barbara Mead, Bill Fowler, Chad Majer, Elizabeth Cooke Speakers in Opposition of City Manager's Recommendation: Ed Peters, Robert Mead, David Englehorn, Michael Schwartz, Kevin Gillotti, John Buell, Kim Moons, Dr. Gary Gonsalves, Ed Migdal, Matthew Snyder, Marciya Winchester, Charles Sheridan, Scott Hasson, Jeff Burleson Mayor Hall adjourned the meeting for a brief recess at 8:44 p.m. and reconvened the meeting at 8:49 p.m. with all Council Members present. Speakers in Support of City Manager's Recommendation: Jeff Gosselin Speakers in Opposition of City Manager's Recommendation: Curtis Arndt, Douglas Baker, Robert Reichert, Leslie Delvaney ACTION: Motion by Council Member Wood and seconded by Council Member Packard, motion carried 4-1 with Mayor Pro Tem Blackburn voting No, to adopt Resolution No. 2015- 114, with direction to staff. Mayor Hall adjourned the meeting for a brief recess at 9:30 p.m. and reconvened the meeting at 9:33 p.m. with all Council Members present. Mayor Hall adjourned to the Special Meeting of the Carlsbad Municipal Water District Board of Directors, at 9:33 p.m. Meeting reconvened at 9:34 p.m. with all Council Members present.
