PLEDGE OF ALLEGIANCE: Council Member Schumacher led the Pledge of Allegiance. APPROVAL OF MINUTES: Motion by Mayor Pro Tem Blackburn and seconded by Council Member Wood to approve minutes, motion carried unanimously. Minutes ofthe Regular Meeting held June 23, 2015. Minutes of the Joint Special Meeting held June 23, 2015. PRESENTATIONS: Presentation of proclamation in recognition of Miss Carlsbad 2015 and her court, and Miss Teen Carlsbad 2015 and her court. Miss Carlsbad presented a donation of $1,000 to Mayor Hall from the Carlsbad Lions Club for the Library. Mayor Hall invited Heather Pizzuto, Library & Cultural Arts Director and Patricia Roberts, Friends of the Library President to the podium. Heather presented a proclamation in recognition of Friends of the Library donation of $110,000 to support the library services. CONSENT CALENDAR: Motion by Mayor Pro Tem Blackburn and seconded by Council Member Wood to approve items 1-11, motion carried unanimously. WAIVER OF ORDINANCE TEXT READING: This is a motion to waive the reading ofthe text of all ordinances and resolutions at this meeting. 1. AB #22,024 - Adoption of Resolution No. 2015-180, accepting a fiscal year 2015-16 cash donation of $78,685 and a pledge of $31,315 in additional support from the Friends ofthe Carlsbad City Library to the Carlsbad Library & Cultural Arts Department. 2. AB #22,025 - Adoption of Resolution No. 2015-181, approving the consideration of Request for Bid (RFB) #15-05 - Parks Maintenance Services, awarding a contract to the best value determined bidder. West Coast Arborists for work category B; Terracare Associates for work category C; and PWLCl for work category D, E, & F, respectively. July 14, 2015 Carlsbad City Council Regular Meeting Page 2 3. AB #22,026 - Adoption of Resolution No. 2015-182, adopting annual benefit assessments for Buena Vista Channel Maintenance District Benefit Area No. 1. 4. AB #22,027 - Adoption of Resolution No. 2015-183, authorizing the City Manager to execute an agreement with the Regional Solid Waste Association (RSWA) for household hazardous waste collection program services for a five year term. 5. AB #22,028 - Adoption of Resolution No. 2015-184, approving and authorizing an agreement for radio frequency identification and self-check library systems with Sirsi Corporation in an amount of $649,959. 6. AB #22,029 - Adoption of Resolution No. 2015-185, designating Council Member Lorraine Wood as voting delegate and Council Member Michael Schumacher as voting delegate alternate, for the League of California Cities Annual Conference in San Jose, California, September 30-October 2, 2015. 7. AB #22,030 - Adoption of Resolution No. 2015-186, approving the agreement with Disability Access Consultants, LLC (DAC) for completion of an ADA Transition Plan in the amount of $139,900. 8. AB #22,039 - Adoption of Resolution No. 2015-195, ratifying an extension and amendment to the agreement for management services for Interfaith Community Services to operate the Carlsbad Hiring Center on behalf of the City of Carlsbad, with some revisions to the scope of work and contract amount. 9. AB #22,031 - Adoption of Resolution No. 2015-187, authorizing a special events grant for in- kind city services in the amount of $6,039 forthe 2015 Carlsbad Grand Prix, and authorizing the Administrative Services Director to appropriate and disburse said funds from Council Contingency. 10. AB #22,032 - Adoption of Resolution No. 2015-188, authorizing an agreement with Roesling Nakamura Terada Architects, Inc. for professional services for the Pine Avenue Community Park Master Plan Implementation - Project No. 4603, in a not to exceed amount of $999,497; and. Adoption of Resolution No. 2015-189, authorizing an agreement with Schmidt Design Group, Inc. for professional services for the Aviara and Poinsettia Community Parks Master Plan Implementation - Project Nos. 4604 and 4605, in a not to exceed amount of $212,360 and $212,749, respectively. 11. AB #22,033 - Adoption of Resolution No. 2015-190, authorizing the City Manager to sign an amendment to the reimbursement agreement with San Diego County Water Authority (SDCWA) in the revised amount of $1,228,049 for additional asphalt paving associated with installation ofthe Carlsbad Desalination Conveyance Pipeline. PUBUC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced there was no reportable action from the closed session held earlier in the day. PUBLIC COMMENT: Speakers commented on the Agua Hedionda 85/15 Specific Plan Initiative, encouraging the City Council to place the initiative on the ballot: Fred Sandquist, Mary Thompson with the League of Women's Voters, Jason Oziel, Ralph Williams, Liz Kruidenier, and Dustin Johnston. PUBLIC HEARING: 12. AB #22,034 - Adoption of Ordinance No. CS-279, amending Title 7, Chapter 7.08, Section 7.08.010 of the Carlsbad Municipal Code to adopt by reference San Diego County Code of Regulations regarding Animal Control. CityAttorney Brewer explained the item and read the ordinance by title only. ACTION: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Wood, motion carried unanimously to adopt Ordinance No. CS-279. 13. AB #22,035 - Approval of Resolution No. 2015-191, confirming the diagram and assessment and providing for the levy of the annual assessment for Street Lighting and Landscaping District No. 1, a Special Assessment District. Interim City Manager Kathy Dodson introduced the item and Senior Accountant Roxanne Muhlmeister who gave the report and PowerPoint presentation on both Lighting and Landscaping District 1 and 2, Special Assessment Districts (Items #13-14) 14. AB #22,036 - Approval of Resolution No. 2015-192, confirming the diagram and assessment and providing for Lighting and Landscaping District No. 2, a Special Assessment District. ACTION: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Wood, motion carried unanimously to adopt Resolution Nos. 2015-191 and 2015-192. Minutes Order: Council Member Wood requested that the City Clerk remove the PowerPoint Presentation presented at the meeting from the record. The presentation had an error in the data. Additionally, the information provided in Agenda Bill 22,036 was correct which included the Resolutions adopted without amendment. 15. AB #22,037 - Introduction of Ordinance No. CS-280, amending Title 21 of the Carlsbad Municipal Code to make the city's regulation of density bonuses consistent with State Law; and approval of Resolution No 2015-193, approving a Local Coastal Program Amendment (LCPA 14-04) to make the City's regulation of density bonuses consistent with State Law. Interim City Manager Kathy Dodson introduced the item and Associate Planner Carl Stiehl who gave the report and PowerPoint presentation. ACTION: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Wood, motion carried unanimously to hear the first reading of Ordinance No. CS-280, and adopt Resolution No. 2015-193. Mayor Hall left the dais at 6:46 p.m. recusing himself from Item #16 as he is a property owner within the project area. 16. AB #22,038 - Approval of Resolution No. 2015-194, denying the appeal and upholding the decision of the Planning Commission to uphold the City Planner's decision to approve an Administrative Review Permit to allow for a delicatessen on property generally located at 3040 Carlsbad Boulevard in Land Use District 1 of the Village Review Zone and within the Village Segment of the Local Coastal Program and in Local Facilities Management Zone 1. Case Name: El Corral, Case Number: RP 14-22. Interim City Manager Kathy Dodson introduced the item and Associate Planner Austin Silva who gave the report and PowerPoint presentation. Appellant presentation: Mike Hewitt representing Ron and Allison Presta, owners of the property gave a PowerPoint presentation. (Presentation on file in the City Clerk's Office) Bill Hoffman representing Sterling Development who are the owners of El Corral. (Presentation on file in the City Clerk's Office) Speaker in Support: Ashley Westman with Urban Place Consulting Group ACTION: Motion by Council Member Wood, seconded by Council Member Schumacher, motion carried 4-0, to adopt Resolution No. 2015-194, with Mayor Hall recusing himself as he is a property owner in the project area. Mayor Hall returned to the dais at 7:35 p.m. Mayor Hall adjourned to the Special Meeting of the Carlsbad Municipal Water District Board at 7:35 p.m. Meeting reconvened at 7:37 p.m. with all Council Members present.
