PLEDGE OF ALLEGIANCE: Mayor Pro Tem Blackburn, led the pledge of allegiance. APPROVAL OF MINUTES: Minutes ofthe Joint Special Meeting held July 18, 2015. Minutes ofthe Joint Special Meeting held July 21, 2015. Minutes ofthe Special Meeting held July 21, 2015. Minutes ofthe Special Meeting held July 28, 2015. Minutes ofthe Regular Meeting held July 28, 2015. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Wood to approve minutes, the motion carried unanimously. PRESENTATIONS: None. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None. CONSENT CALENDAR: None. ORDINANCE FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: None. PUBLIC COMMENT: Michael Restive spoke concerning the County's water rate increase in 2016. Klaus Kirchhoff, Patricia Amador, Michael Schertzer, DeAnn Weimer, Carlton Lund, Shirley Forsch, Jim Boone, Saundra Cima, Dave Kendall, Maureen Simons, Ralph Wenstone, Jerry Miller, Fred Sandquist, Angela Behrens, Peggy Roberts, Jimmy Ukegawa, Dr. Richard Eckfield, Valerie Lindholm, and Bill Dominguez spoke concerning the Agua Hedionda 85/15 Specific Plan. RECESS: Mayor Hall adjourned the meeting for a brief recess at 9:48 a.m. and reconvened the meeting at 9:56 a.m. with all Council Members present. DEPARTMENTAL AND CITY MANAGER REPORTS: 1. AB #22,057 - Approval of Resolution No. 2015-208, certifying the results of the County of San Diego Registrar of Voters Sufficiency Examination ofthe Petition Filed for the Agua Hedionda South Shore Specific Plan. Interim City Manager Kathryn Dodson introduced the item and City Clerk Barbara Engleson gave the report and power point presentation (copy on file in the Office ofthe City Clerk). ACTION: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Wood to approve Resolution No. 2015-208, motion carried unanimously. 2. AB #22,058 - Approval of Resolution No. 2015-209 granting/denying respondent's motion to stay administrative hearing pending emergency writ to the Superior Court to correct procedural error in the matter of Steven Seapker, Appellant v. City of Carlsbad, Respondent [Case No. C.S.M.CS. ARB-13-0476]. Assistant City Attorney Paul Edmonson provided a synopsis and introduced Laura Kalty ofthe firm Lubart Cassidy Whitmore, counsel for the City of Carlsbad and Michael Williamson ofthe firm Stone Busailah, counsel for Steven Seapker. Each attorney provided a five minute brief. Mayor Hall adjourned the meeting into closed session for further discussion of Item 2 at 10:11 a.m. and reconvened the City Council Meeting at 10:31 a.m. with all members ofthe Council present. Mayor Pro Tem Blackburn announced in the interest of full disclosure that he had worked with Mr. Steven Seapker while both were employed by the City of Carlsbad's Police Department, but he (Council Member Blackburn), has no knowledge relative to this case beyond what the entire Council has been briefed on. ACTION: Motion by Mayor Pro Tem Keith Blackburn, seconded by Council Member Lorraine Wood to approve Resolution No. 2015-209 granting the Respondent's motion Resolution passed unanimously.
