PLEDGE OF ALLEGIANCE: Mayor Pro Tem Wood led the Pledge of Allegiance. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: No reportable action. PRESENTATION: None. APPROVAL OF MINUTES: Minutes of the Joint Special Meeting held January 12, 2016. Minutes of the Regular Meeting held January 19, 2016. Minutes of the Regular Meeting held February 9, 2016. Minutes of the Special Meeting held February 11, 2016. Motion by Mayor Pro Tem Wood, seconded by Council Member Schumacher, to approve the minutes as presented. Motion carried unanimously, 5/0. CONSENT CALENDAR: Item #4 was pulled for discussion. ACTION: Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to approve Consent Calendar Item Nos. 1, 2 3, 5 and 6. Motion carried unanimously, 5/0. 1. AB #22,221 — Approval of Resolution No. 2016-035, ratifying the advertisement for bids for Dove Library roof repair; and, accepting bids and awarding the contract to Commercial Waterproofing Systems, Inc. dba ERC Roofing and Waterproofing, in the amount of $326,600 for the Dove Library roof repair, Project No. 4030. 2. AB #22,222 — Approval of Resolution Nos. 2016-036 and 2016-037, appointing Emma Jadhav and Cathy Breslaw to the Arts Commission. February 23, 2016 Carlsbad City Council Regular Meeting Page 2 3. AB #22,223 — Approval of Resolution No. 2016-038, accepting the construction of the pavement overlay, Project No. 6001-140L, as complete; and, directing the city clerk to record Notice of Completion and release bonds in accordance with state law and city ordinances. 5. AB #22,227 — Approval of Resolution No. 2016-041, approving property use agreement for Cole Library for coffee services. 6. AB #22,224 — Report on city investments as of January 31, 2016. Consent item pulled for discussion: 4. AB #22,228 — Approval of Resolution No. 2016-042, adopting council policy governing tribal cultural resources. Speaker in favor: Mel Vernon, San Luis Rey Band of Mission Indians. ACTION: Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to approve Resolution No. 2016-042, with a correction to replace the term "Native American Tribes in San Diego including San Luis Rey" with the term "California Native American Tribes that are traditionally and culturally affiliated with the city including the San Luis Rey Band of Mission Indians", as read into the record by City Attorney Celia Brewer. Motion carried unanimously, 5/0. ORDINANCE FOR INTRODUCTION: None. ORDINANCE FOR ADOPTION: 7. Item continued from February 9, 2016. AB #22,213 — Adopt Ordinance No. CS-291, amending Carlsbad Municipal Code Chapter 5.60 Short-Term Vacation Rentals, Section 5.60.030, to allow short-term vacation rentals in the La Costa Resort and Spa Master Plan Area, to include the Balboa and Cortez buildings located at 2003 and 2005 Costa Del Mar Road. Speaker in opposition: Jes Hinrichs City Attorney Celia Brewer titled the ordinance. ACTION: Motion by Council Member Schumacher, seconded by Council Member Packard, to adopt Ordinance No. CS-291. Item continued from January 26, 2016. AB #22,204 — Introduction of Ordinance Nos. CS-292 and CS-293, approving Zone Change 14-02 and Specific Plan Amendment SP 207(k); and adopt Resolution Nos. 2016-021 and 2016-022, certifying the Environmental Impact Report EIR 15-02, adopting the Candidate Findings of Fact and a Mitigation Monitoring and Reporting Program and approving a General Plan Amendment, Local Coastal Program Amendment, Tentative Tract Map, Planned Development Permit, Site Development Plan, Conditional Use Permit, Coastal Development Permit, and Hillside Development Permit as recommended for approval by the Planning Commission. Case Name: Westin Hotel and Timeshare, Case No. ZC 14-02. Senior Planner Christer Westman reviewed a PowerPoint presentation (on file in the office of the City Clerk). Mr. Westman responded to questions from Council Member Blackburn regarding traffic impacts, consistency with the general plan, impact determination and fees. Mr. Westman clarified for Council Member Packard that the transportation intersections were east of the freeway. The applicant's representative Bill Hoffman provided a PowerPoint presentation regarding the proposed property (on file in the office of the City Clerk). Tim Stripe, Grand Pacific Resorts, addressed council and thanked city staff for the work completed on this project. In response to Council Member Wood, Mr. Stripe stated that there is currently a trolley system in place, and this could be extended to Pacific Pallisades and SeaPointe. CS-292 and CS-293, and adopt Resolution Nos. 2016-021 and 2016- 022, including additional information contained in the Errata Sheet dated February 23, 2016. Motion carried unanimously, 5/0. 9. Item continued from February 9, 2016. AB #22,215 — Introduce Ordinance No. CS-294, approving an amendment to Carlsbad Municipal Code Chapter 18.50 — Water Efficient Landscape, for the purpose of consistency with the State of California Model Water Efficient Landscape Ordinance; and, Approving Resolution No. 2016-031, approving an amendment to the City of Carlsbad Landscape Manual policies and requirements for the purpose of consistency with the State of California Model Water Efficient Landscape Ordinance. Associate Planner Carl Stiehl provided a staff report and PowerPoint presentation (on file in the office of the City Clerk). Mayor Hall opened the public hearing at 6:50 p.m. Seeing no one wishing to speak, Mayor Hall closed the public hearing at 6:50 p.m. City Attorney Celia Brewer titled the ordinance. ACTION: Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to introduce Ordinance No. CS-294 and adopt Resolution No. 2016-031, including the Errata Sheet dated February 23, 2016. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 10. AB #22,225 — Approval of Resolution No. 2016-039, appointing one member to the Planning Commission. ACTION: Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to adopt Resolution No. 2016-039, appointing Patrick Goyarts to the Planning Commission. Motion carried unanimously, 5/0. 11. AB #22,226 — Approval of Resolution No. 2016-040, receiving the Climate Action Plan Implementation Cost Analysis Report. Environmental Program Manager Elaine Lukey and Consultant Scott Anders provided the report and PowerPoint presentation (on file in the office of the City Clerk). Council Member Packard requested that staff provide a list of cities that are members of the San Diego Climate Collaborative at a future meeting. February 23, 2016 Carlsbad City Council Regular Meeting Page 5 Council Member Schumacher encouraged staff to pursue grant opportunities in an effort to recover costs associated with implementing the Plan. In response to an inquiry from Mayor Pro Tern Wood, Ms. Lukey explained that greenhouse gases and emissions reports will be updated every three years, and that the goal is to reach the State target by 2035. Mayor Hall suggested that staff investigate receiving credit for measures that the city has taken in the past, for example, growth management, city design, reclaimed water and street lights. ACTION: Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to adopt Resolution No. 2016-040, receiving the Climate Action Plan Implementation Cost Analysis Report. Motion carried unanimously, 5/0. COUNCIL REPORTS AND COMMENTS: Mayor Pro Tem Wood and Council Members reported on activities and meetings of some committees and sub-committees of which they are members. CITY MANAGER COMMENTS: None.
