INVOCATION:None. PLEDGE OF ALLEGIANCE:Council Member Packard led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the Special Meeting held June 7, 2016. Minutes of the Regular Meeting held June 7, 2016. Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATION: Presentation in recognition of donation from Friends of the Carlsbad City Library. Friends of the Carlsbad City Library President Patricia Roberts expressed her appreciation for the Council's support of the book sales program which allowed the Friends the opportunity to make the donation. CONSENT CALENDAR: Item No. 11 was pulled for discussion. ACTION:Motion by Mayor Pro Tern Wood,seconded by Council Member Schumacher,to approve Consent Calendar Item Nos.1 through 10,12 and 13. Motion carried unanimously, 5/0. 1.AB #22,353 —Approval of Resolution No. 2016-154 accepting a cash donation of $71,000 and a pledge of $42,950 in additional support from the Friends of the Carlsbad City Library for the Library and Cultural Arts Department. 2.AB #22,354 —Approval of Resolution No.2016-155 authorizing the execution of a Professional Services Agreement with Michael Baker International not-to-exceed $194,000 for the design of drainage Master Plan Facility BCA— Park Drive and Tamarack Avenue. Project No. 6617. July 26, 2016 Carlsbad City Council Regular Meeting Page 2 3.AB #22,355 —Approval of Resolution No.2016-156 approving two grant requests from CB Ranch Enterprises,a subsidiary of Caritas Company, for research projects intended to ensure the long-term productivity of the Flower Fields at Carlsbad Ranch. 4.AB #22,356 —Approval of Resolution No. 2016-157 authorizing the Public Works Director or designee to submit necessary forms and manage all California Department of Resources, Recycling and Recovery (CalRecycle) grants for which the City of Carlsbad is eligible. 5.AB #22,357 —Approval of Resolution No.2016-158 authorizing the purchase of 11 hybrid vehicles from Freeway Toyota of Hanford for $320,845. 6.AB #22,358 —Approval of Resolution No.2016-159 opening a portion of Lot 9 of Carlsbad Tract No. 76-18,located on the south side of the westerly cul-de-sac of Haymar Drive and lying within the Plaza Camino Real Project, for public street and utility purposes. Project No. PR 16-05. 7.AB #22,359 —Approval of Resolution No.2016-160 authorizing Amendment No.2 to an agreement with Natures Image, Inc. for Buena Vista Creek Maintenance Services. 8.AB #22,360 —Approval of Resolution No. 2016-161 authorizing the execution of a contract with EVGO Services LLC for a sum of $0 to install electrical infrastructure from existing transformers on two city owned sites to a number of locations where electrical charging stations can be installed. 9.AB #22,361 —Adoption of Resolution No. 2016-162 approving the designation of the Tavarua Senior Affordable Apartments as a combined project under the City of Carlsbad's Inclusionary Housing Ordinance and setting the housing credit price for the sale of housing credits within the project to other housing developers within the northwest quadrant of the City. 10. AB #22,362 —Approval of Resolution No.2016-163 authorizing out-of-state travel for one police sergeant, two police officers, one fire battalion chief and one paramedic/firefighter to attend the Incident Response to Terrorist Bombings course in Socorro, New Mexico August 22 -26, 2016. 11. AB #22,375 —Approval of Resolution No. 2016-165 of intent to vacate a portion of Madison Street Alley,from Chestnut Avenue Northwest to the Northeasterly prolongation of the Southeast line of Lot 14 of Map 775.Case Name:Pine Avenue Community Park CIP 4603/Case No. STV 16-01. July 26, 2016 Carlsbad City Council Regular Meeting Page 3 CONSENT CALENDAR ITEM PULLED FOR DISCUSSION: 11. AB #22,363 —Approval of Resolution No.2016-164 designating Mayor Pro Tern Wood as voting delegate for the League of California Cities Annual Conference in Long Beach, California, October 5-7, 2016. Mayor Pro Tern Wood suggested that the Resolution be amended to include the City Manager and City Attorney as alternate delegates. Council discussion ensued in support of Mayor Pro Tern Wood's suggested amendment to the Resolution. ACTION:Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to adopt Resolution No. 2016-164 as amended to include the City Manager and City Attorney as alternate voting delegates. Motion carried unanimously, 5/0. ORDINANCES FOR INTRODUCTION: 14. AB #22,364 —Introduction of Ordinance No.CS-303 amending Title 10, Chapter 10.44, of the Carlsbad Municipal Code by the revision of Section 10.44.770 to modify the limits of the 45 mile per hour speed zone on Camino Junipero. Assistant City Attorney Ron Kemp titled the Ordinance. ACTION:Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to introduce Ordinance No.CS-303. Motion carried unanimously, 5/0. 15. AB #22,365 —Introduction of Ordinance No.CS-304 amending Title 10, Chapter 10.44, of the Carlsbad Municipal Code by the revision of Section 10.44.030 to modify the limits of the existing 30 mile per hour and 35 mile per hour speed zones on Carlsbad Boulevard between the North City Limit and Walnut Avenue. Assistant City Attorney Ron Kemp titled the Ordinance. ACTION:Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to introduce Ordinance No.CS-304. Motion carried unanimously, 5/0. 16. AB #22,366 —Introduction of Ordinance No.CS-305 amending Title 10, Chapter 10.44, of the Carlsbad Municipal Code by the revision of Section 10.44.070 establishing a 35 mile per hour prima facie speed limit on La Costa Avenue from Camino de los Coches to Circulo Sequoia. Assistant City Attorney Ron Kemp titled the Ordinance. ACTION:Motion by Mayor Pro Tem Wood, seconded by Council Member Schumacher, to introduce Ordinance No.CS-305. Motion carried unanimously, 5/0. AB #22,347 —Introduction of Ordinance No.CS-306 amending Title 10, Chapter 10.28 of the Carlsbad Municipal Code to add Section 10.28.995 to establish an all-way stop control at the intersection of Buena Vista Way and Arland Road. Assistant City Attorney Ron Kemp titled the Ordinance. ACTION:Motion by Mayor Pro Tem Wood, seconded by Council Member Schumacher, to introduce Ordinance No.CS-306. Motion carried 4/1 (Packard —No). 18. AB #22,373 —Introduction of Ordinance No.CS-307 amending Carlsbad Municipal Code Title 3,Chapter 3.28 (Purchasing) to add Section 3.28.087 (Job Order Contracts); Amend Sections 3.28.050 (Procurement of Goods) and 3.28.060 (Procurement of Professional Services and Services)to clarify the dollar threshold where formal bidding is required;Amend Section 3.28.080 (Construction Projects) to reduce the notice period inviting formal bids to 15 days; and, Amend Section 3.28.090 (Execution of Change Orders and Amendments) to clarify the City Manager may delegate authority to execute change orders. Deputy City Attorney Heather Stroud presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Assistant City Attorney Ron Kemp titled the Ordinance. ACTION:Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to introduce Ordinance No.CS-307. Motion carried unanimously, 5/0. ORDINANCES FOR ADOPTION: 19. AB #22,367 —Adoption of Ordinance No.CS-301,adopting an amendment to the Carlsbad Airport Centre Specific Plan (SP 181(H)) amending Land Use Plan Figure 7 to add an "Area 2" land use designation over Lot 12 for purposes of allowing, with the approval of a conditional use permit a 142-room business hotel on a 3.8 acre previously graded infill site generally located north of Palomar Airport Road, south of Wright Place and east of Palomar Oaks Way in Local Facilities Management Zone 5.Case Name:Home2 Carlsbad Suites.Case No.:SP 181(H). Assistant City Attorney Ron Kemp titled the Ordinance. ACTION:Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to adopt Ordinance No.CS-301. Motion carried unanimously, 5/0. 20. AB #22,368 —Adoption of Ordinance No.CS-302, approving amendments to the zoning map (LCPA 07-02/ZC 15-02)pursuant to the California Coastal Commission's suggested modifications to Local Coastal Program Amendment (LCPA 07-02). Case Name: General Plan Update.Case No.: LCPA 07-02/ZC 15-02. Assistant City Attorney Ron Kemp titled the Ordinance. ACTION:Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to adopt Ordinance No.CS-302. Motion carried unanimously, 5/0. July 26, 2016 Carlsbad City Council Regular Meeting Page 5 PUBLIC COMMENT: Walt Meier expressed concerns relating to the condition of the public restrooms near Tamarack beach.He also expressed concerns relating to consistent street sweeping throughout the City. Linda Daniels expressed concerns relating to the rising rates of electricity.She requested that the Council work on bringing Community Choice Energy to Carlsbad. PUBLIC HEARING: 21. AB #22,369 —Approval of Resolution No.2016-166, confirming the report of the Fire Chief showing cost of weed abatement against each parcel of land assessed, confirming the cost, providing for collection on the regular tax bill, and directing the City Clerk to file a certified copy of the resolution with the San Diego County Assessor on or before August 10, 2016. Fire Marshal Randy Metz gave a brief overview of the report. Mayor Hall opened the duly noticed Public Hearing at 6:26 p.m. Seeing no one wishing to speak Mayor Hall closed the duly noticed Public Hearing at 6:26 p.m. ACTION:Motion by Mayor Pro Tem Wood, seconded by Council Member Schumacher, to take public input,close the public hearing,and adopt Resolution No.2016-166.Motion carried unanimously, 5/0. Mayor Hall adjourned to the Special Meeting of the Carlsbad Public Financing Authority at 6:27 p.m. Mayor Hall reconvened the Regular City Council Meeting at 6:28 p.m. DEPARTMENTAL AND CITY MANAGER REPORT: 23. AB #22,370 —Approval of Resolution No. 2016-168 of the City Council of the City of Carlsbad, acting as the Legislative Body of the City of Carlsbad Community Facilities District No.3, authorizing the issuance of its 2016 Special Tax Refunding Bonds (Improvement Area 2) in a principal amount not to exceed fourteen million dollars ($14,000,000) and approving certain documents and taking certain other actions in connection therewith. Senior Accountant Aaron Beanan presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). ACTION:Motion by Mayor Pro Tem Wood, seconded by Council Member Schumacher, to adopt Resolution No. 2016-168.Motion carried unanimously, 5/0. ACTION:Motion by Mayor Pro Tern Wood, seconded by Council Member Schumacher, to adopt Resolution No. 2016-169 re-appointing Linda Petrucci and Norelynn Pion-Goureau and appointing Sage Naumann to the Beach Preservation Committee.Motion carried unanimously, 5/0. 25. AB #22,372 —Approval of Resolution No. 2016-170 appointing two members to the Library Board of Trustees. ACTION:Motion by Mayor Pro Tem Wood, seconded by Council Member Schumacher, to adopt Resolution No. 2016-170 appointing Sherman DeForest and Taffy Cannon to the Library Board of Trustees.Motion carried unanimously, 5/0. COUNCIL REPORTS AND COMMENTS: Mayor Hall and Council Members reported on activities and meetings of some committees and sub -committees of which they are members. CITY MANAGER COMMENTS:None.
