Hall —Absent. INVOCATION:None. PLEDGE OF ALLEGIANCE:Council Member Schumacher led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the Special Meeting held July 12, 2016. Minutes of the Regular Meeting held July 12, 2016. Minutes of the Regular Meeting held July 19, 2016. Minutes of the Special Meeting held July 26, 2016. Minutes of the Regular Meeting held July 26, 2016. Minutes of the Special Meeting held August 29, 2016. Motion by Council Member Schumacher, seconded by Council Member Blackburn, to approve the minutes as presented. Motion carried unanimously, 4/0/1 (Hall —Absent). PRESENTATIONS: Council Member Packard presented a Proclamation to Alida Woodward and Wanda Prosser, representing Regents of the Santa Margarita Chapter Daughters of the American Revolution,in recognition of Constitution Week, September 17 —23, 2016. Council Member Blackburn presented a Proclamation to Emergency Preparedness Coordinator David Harrison in recognition of National Preparedness Month, September 2016. Susan Day, Executive Director of the Burn Institute, recognized the Carlsbad Fire Department as the top fundraiser for the 2016 Firefighter Demolition Derby. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced that the City Council met in Closed Session at 5:30 p.m. and voted unanimously to approve a settlement in the amount of $25,000 to settle an eminent domain action in the case of City of Carlsbad v.Graham J.Espie.She explained that the entire amount would be paid by the project developer, the Toll Brothers. September 13, 2016 Carlsbad City Council Regular Meeting Page 2 CONSENT CALENDAR: ACTION: Motion by Council Member Schumacher, seconded by Council Member Blackburn, to approve Consent Calendar Item Nos.1 through 8.Motion carried 4/0/1 (Hall —Absent). 1.ACCEPTANCE OF DONATION FROM THE FRIENDS OF THE CARLSBAD LIBRARY —Approval of Resolution No. 2016-181 accepting a Fiscal Year 2016-17 cash donation of $10,460 from the Friends of the Carlsbad Library. (Staff contact:Heather Pizzuto, Library & Cultural Arts) 2.PINE AVENUE COMMUNITY PARK SYNTHETIC TURF REPLACEMENT (CAPITAL IMPROVEMENT PROJECT NO.47311)-Approval of Resolution No.2016-182 approving the contract documents,plans and specifications for the Pine Avenue Community Park synthetic turf replacement,and authorizing the City Clerk to advertise the project for public bids.(Staff contact: Kyle Lancaster, Parks & Recreation) 3.CARLSBAD CITY LIBRARY RENOVATION PROJECTS (PROJECT NOS. 4020 & 4030)—Approval of Resolution No.2016-183 authorizing an increase in the construction contingency in the amount of $250,000 for the Carlsbad City Library Renovation Projects. (Staff contact:Steve Didier, Public Works) 4.AGUA HEDIONDA STREAMBANK RESTORATION PROJECT (PROJECT NO.6618)—Approval of Resolution No. 2016-184 awarding a contract for $230,367 to JEFCO Equipment Company for the Agua Hedionda Streambank Restoration Project.(Staff contact:Sherri Howard, Public Works) 5.ROMERIA DRAINAGE IMPROVEMENTS AND LA COSTA AVENUE SLOPE REPAIR (PROJECT NOS. 6604 AND 6024)—Approval of Resolution No.2016-185 accepting the contract for construction of the Romeria Drainage Improvements and La Costa Avenue Slope Repair as complete and directing the City Clerk to record a Notice of Completion and release bonds in accordance with state law and City ordinances. (Staff contact:Patrick Vaughan, Public Works) 6.2015 SLURRY SEAL PROJECT (PROJECT NO. 6001-15SS)—Approval of Resolution No. 2016-186 accepting the contract for construction of the 2015 Slurry Seal Project as complete and directing the City Clerk to record a Notice of Completion and release bonds in accordance with state law and City ordinances. (Staff contact:Patrick Vaughan, Public Works) 7.AUTHORIZATION TO PURCHASE EIGHT POLICE VEHICLES —Approval of Resolution No. 2016- 187 authorizing the purchase of eight police vehicles from Downtown Ford for $250,275. (Staff contact:Steve Hodges, Public Works) 8.AUTHORIZATION TO PURCHASE A WASTEWATER PUMPING TRUCK —Approval of Resolution No. 2016-188 authorizing the purchase of a wastewater pumping truck from Plumbers Depot, Inc.for $454,896. (Staff contact:Steve Hodges, Public Works) ORDINANCES FOR INTRODUCTION:None. September 13, 2016 Carlsbad City Council Regular Meeting Page 3 ORDINANCES FOR ADOPTION:None. PUBLIC COMMENT: Craig Sheets expressed concerns relating to the trafficking of narcotics via military vehicles. Gita Nassiri, representing the Carlsbad Library and Arts Foundation, invited the Council to attend the Annual Night at the Library on September 17, 2016 in celebration of Ben D. Schulman's 99th birthday. Donna Bower apologized to Council Member Keith Blackburn for accusations she had previously made alleging that he had harassed guests at her home on March 5, 2016.She further explained that she had read a statement prepared by someone else and that those were not her words. Susan Miller expressed concerns relating to the chemicals that would be used to remove the trees in the Calavera Preserve area. Karen Ong requested that parking be prohibited on Hosp Way. Marti Wells encouraged the Council to consider supporting Community Choice Energy. Pacific Rim students that participated in the Odyssey of the Mind world competition came forward to announce they won second place. Brian Connor expressed concerns relating to the lack of code enforcement regarding vehicles being parked in garages. Lee Lambert requested that the Council oppose Proposition 64 on the November ballot. PUBLIC HEARING: The applicant has requested this item be continued to the Regular Meeting of September 27, 2016. 9.GUNTHER GUNS SHOOTING RANGE CONDITIONAL USE PERMIT 15-09 —Adoption of a resolution approving a Conditional Use Permit to allow for a 16 lane indoor shooting range and a 1,680 square foot retail gun store within a 13,932 square foot stand-alone building on property located at 2717 Loker Avenue West within the Carlsbad Airport Business Center Specific Plan and Local Facilities Management Zone 5.(Staff contact:Jason Goff, Community & Economic Development) City Manager Kevin Crawford announced that the applicant requested that the item be continued to September 27, 2016. Mayor Pro Tern Wood invited anyone wishing to speak regarding the item that could not attend the September 27, 2016 meeting to come forward at this time. September 13, 2016 Carlsbad City Council Regular Meeting Page 4 Seeing no one wishing to speak, Mayor Pro Tern Wood requested a motion to continue the item. ACTION: Motion by Council Member Schumacher, seconded by Council Member Blackburn, to continue the Public Hearing to the Regular Meeting of September 27, 2016. Motion carried 4/0/1 (Hall —Absent). 10. NEW FEE STRUCTURE FOR FIRE PREVENTION SERVICES —Adoption of Resolution No.2016- 189 approving a new Fire Prevention Fee Schedule,setting the collection of Development Services and Special Events and Activities Fees at true costs,and establishing Fire Code Permits and Maintenance Inspections as a service to the public and not a fee for service. (Staff contact:Randy Metz, Fire) Fire Chief Mike Davis and Fire Marshal Randy Metz presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Schumacher, Chief Davis explained that the Fire Department provides many services to residents free of charge such as home visits and guidance regarding proper weed abatement. Mayor Pro Tern Wood opened the duly noticed Public Hearing at 7:05 p.m. Seeing no one wishing to speak, Mayor Pro Tern Wood closed the duly noticed Public Hearing at 7:05 p.m. ACTION: Motion by Council Member Schumacher, seconded by Council Member Blackburn, to adopt Resolution No. 2016-189.Motion carried 4/0/1 (Hall —Absent). Mayor Pro Tern Wood adjourned to the Special Meeting of the Carlsbad Municipal Water District at 7:06 p.m. Mayor Pro Tern Wood reconvened the Regular City Council Meeting at 7:07 p.m. DEPARTMENTAL AND CITY MANAGER REPORTS: 11. LIVE WELL SAN DIEGO PRESENTATION —Approval of Resolution No. 2016-190 supporting the Live Well San Diego Initiative.(Staff contact:Courtney Pene,Housing &Neighborhood Services) San Diego Health & Human Services Chief Medical Officer Dr.Nick Yphantides reviewed a PowerPoint presentation (on file in the Office of the City Clerk)regarding the benefits of supporting the Live Well San Diego Initiative. Council discussion ensued regarding their support for the program. ACTION: Motion by Council Member Schumacher, seconded by Council Member Blackburn, to adopt Resolution No. 2016-190.Motion carried 4/0/1 (Hall —Absent). SUNROAD ENTERPRISES APPEAL —Approval of Resolution No. 2016-191 denying the appeal of Sunroad Enterprises and upholding the Planning Commission's determination that non- medical counseling is a prohibited use in the Carlsbad Airport Centre Specific Plan (SP 181(G)). Case Name: Sunroad Enterprises Appeal/Case No.PCD 16-01.(Staff contact: Teri Delcamp, Community & Economic Development) Senior Planner Teri Delcamp presented the report and reviewed a PowerPoint presentation (on file in the office of the City Clerk). The appellant Tom Story gave a brief oral presentation requesting that the Council consider granting the appeal.He explained that Sunroad would stipulate that no services requiring a medical license would be permitted at the location. Council discussion ensued regarding the fact that adequate office space exists throughout the City that could readily accommodate the appellant's needs. Council Member Blackburn stated that he was in support of staff's recommendation to deny the appeal. ACTION: Motion by Council Member Schumacher, seconded by Council Member Blackburn, to adopt Resolution No. 2016-191.Motion carried 4/0/1 (Hall —Absent). 13. CARLSBAD RESIDENT PRESENTATION —Receive a presentation from Carlsbad resident Richard Schneck regarding Carlsbad Municipal Code Chapter 5.60 —Short-Term Vacation Rentals. (Staff contact:Debbie Fountain, Housing & Neighborhood Services) Carlsbad resident Richard Schneck provided a verbal presentation requesting that the Council consider repealing the Ordinance passed last year regarding Short-Term Vacation Rentals. Speakers in opposition to Mr. Schneck's recommendation to allow short-term vacation rentals throughout the City: Jill Agosti;Jes Hinrichs; Brian Connor. Speakers in support of Mr. Schneck's recommendation to allow short-term vacation rentals throughout the City:Craig Miller; Nicole Connors; Casey Connors; Kathy; Tom Billich. In response to an inquiry from Mayor Pro Tern Wood, Assistant City Manager Gary Barberio explained that staff will be returning to Council with a status report regarding the Ordinance that was passed in June 2014 by the end of the calendar year. ACTION: Council received the report. COUNCIL REPORTS AND COMMENTS: Mayor Pro Tern Wood and Council Members reported on activities and meetings of some committees and sub-committees of which they are members. CITY MANAGER COMMENTS:None.
