APPROVAL OF MINUTES: Minutes of the Special Meeting held April 13, 2017 Minutes of the Special Meeting held April 25, 2017 Minutes of the Regular Meeting held April 25, 2017 Motion by Mayor Pro Tern K. Blackburn, seconded by Council Member M. Schumacher, to approve the minutes, with the following correction requested by Council Member C. Schumacher to page 3, paragraph 3 of the April 25, 2017 Minutes: "In response to Council Member Cori Schumacher, Deputy City Attorney Heather Stroud stated that staff only used the Rocky Mountain High Intensity Drug Trafficking Area, The Legalization of Marijuana in Colorado: The Impact (vol. 4, Sept. 2016} study in preparation of this staff report." Motion carried unanimously, 5/0. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced there was no reportable action. PRESENTATION: Proclamation in recognition of Public Works Week. Council Member Packard presented a proclamation to Public Works Director Elaine Lukey in recognition of Public Works Week, May 21-27, 2017. Presentation by Carlsbad Sister City Ambassadors. Tom Hersant, President of Sister City Ambassadors, reported out on the Sister City Travels to Karlovy Vary and Futtsu. Presentation from Carlsbad Library and Arts Foundation. Library & Cultural Arts Director Heather Pizzuto and John Lucas, Secretary of the Carlsbad Library & Arts Foundation, gave an overview of the donation being presented to Council for approval via the Consent Calendar. May 23, 2017 Carlsbad City Council Regular Meeting Page 2 CONSENT CALENDAR: Item No. 2 was returned to staff. ACTION: Motion by Mayor Pro Tern K. Blackburn, seconded by Council Member M. Schumacher, to approve Consent Calendar Item Nos. 1, 3-7. Motion carried unanimously, 5/0. 1. REPORT ON CITY INVESTMENTS -Acceptance of report on City Investments as of April 30, 2017. {Staff contact: Nancy Sullivan, Administrative Services) Item No. 2 was returned to staff 2. AMENDMENT TO AGREEMENT WITH TEKSYSTEMS, GOVERNMENT SERVICES, LLC, DBA TEKSYSTEMS, INC. -Adoption of a resolution amending the agreement for information technology staffing services with TEKsystems Government Services, LLC, DBA TEKsystems, Inc. in an amount not to exceed $145,000. (Staff contact: Nicholas Lourian, Administrative Services) This item was continued to a later date. 3. OUT-OF-STATE TRAVEL TO PHOENIX, AZ -Adoption of Resolution No. 2017-086 authorizing out-of-state travel for four Fire Department personnel to attend the 8th Annual Hazard Zone Management Conference held in Phoenix, AZ on June 8-9, 2017. (Staff contact: Brianne Daley, Fire Department) 4. ACCEPTANCE OF DONATION -Adoption of Resolution No. 2017-087 accepting a donation from the Carlsbad Library and Arts Foundation in the amount of $151,000. (Staff contact: Heather Pizzuto, Library & Cultural Arts) 5. AUTHORIZATION TO PURCHASE A DUMP TRUCK -Adoption of Resolution No. 2017-088 authorizing the purchase of a dump truck from National Auto Fleet Group for $160,042. (Staff contact: Shawn Gaskari, Public Works) 6. ADVERTISE FOR BIDS FOR CARLSBAD BOULEVARD BRIDGE IMPROVEMENTS (PROJECT NOS. 6014 AND 6053) -Adoption of Resolution No. 2017-089 approving the plans and specifications and authorizing the City Clerk to advertise for bids for the Carlsbad Boulevard Bridge improvements over the Encina Power Station discharge channel. (Staff contact: Brandon Miles, Public Works) 7. ADVERTISE FOR BIDS FOR CORRUGATED METAL PIPE REPLACEMENT PROGRAM PROJECT (PROJECT NO. 6607) -Adoption of Resolution No. 2017-090 approving the plans and specifications and authorizing the City Clerk to advertise for bids for the Corrugated Metal Pipe Replacement Program Project -Carlsbad Boulevard north of Island Way. (Staff contact: Daniel Zimny, Public Works) ORDINANCES FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: None. May 23, 2017 Carlsbad City Council Regular Meeting Page 3 PUBLIC COMMENT: John Garcia spoke in favor of Community Choice Energy as an energy option for the City of Carlsbad. Alex DeTaboada also spoke in favor of the Council pursuing Community Choice Energy as an energy option for the City of Carlsbad. Mr. DeTaboada presented the Council with a petition listing residents in favor of Community Choice Energy (on file in the Office of the City Clerk). Patricia Amador stated she would like to see art from local artists in the new garden on Madison. She also spoke in favor of the City holding meetings in the Community such as at the Harding Center after work to acquire input on the district election process. Kris Wright spoke in favor of citizen outreach throughout the entire community regarding the district election proceedings. She encouraged the Council to hold meetings at other locations. Linda Breen expressed concerns about fairness and inclusiveness throughout the districting process. She provided a memo to Council (on file in the Office of the City Clerk) suggesting that the Council include the following provision in the upcoming resolution, "the demographer will disregard the location of incumbents and candidates as well as the interests of political parties." PUBLIC HEARING: 8. TENTATIVE TRACT MAP AND MAJOR REVIEW PERMIT FOR PROPERTY LOCATED AT 2501 STATE STREET (PROJECT NAME: OCEAN / PROJECT NO. CT 16-02/RP 16-08/DEV 15-087) - Adoption of a resolution approving a Tentative Tract Map and Major Review Permit to demolish an existing office building, and construct a four-story, 45-foot tall residential building consisting of 17 multi-family residential air space condominium units on a 0.487-acre project site located at 2501 State Street. (Staff contact: Greg Fisher, Community and Economic Development) City Manager's Recommendation: Take public input, close the public hearing, and adopt the resolution. Associate Planner Greg Fisher and City Planner Don Neu presented the staff report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Council Member C. Schumacher asked how many other affordable housing options were considered as part of this project. City Planner Don Neu explained that the only other option was to include the units on site and that idea was rejected. Mayor Hall confirmed that this project is not in the Coastal Zone. May 23, 2017 Carlsbad City Council Regular Meeting Page 4 Mayor Hall asked if CC&R's will address noise on the roof decks. Planner Fisher stated that at this time the CC&R's are not proposed to include restrictions on the roof decks. Applicant Jan Jahsson requested that Council approve the proposed project. Jim Simmons, representing the applicant, spoke in support of Council approval of the project. Council Member C. Schumacher asked what kind of community outreach has taken place regarding the proposed project. Mr. Simmons explained that the sign providing information on the project has been a little controversial because the sign kept being taken down so it was moved indoors. He explained that other public noticing occurred before the Planning Commission meeting and before the City Council meeting. Mayor Hall suggested that the applicant include language in the CC&R's addressing noise amplification on the roof decks and the prohibition of vacation rentals outside the coastal zone. Mayor Hall opened the duly noticed Public Hearing at 6:54 p.m. Speakers in opposition: Scott Lyle; Neil Bradley. Cindy (last name unknown) asked if the renderings of the project displayed on the wall were accurate. In response to Cindy's inquiry, Mr. Simmons explained the picture on the wall was the backside of the building and that there will not be a wall in the front of the project. Mayor Pro Tern Blackburn asked how the air conditioning units are going to be shielded from view. Planner Fischer explained that the air conditioning units will be below the parapet and not very high. He further explained that there will also be a shield around the units. Council Member C. Schumacher expressed concerns relating to difficulty of adding solar to the building. The architect for the project explained that the project will meet Cal Green requirements. In response to an inquiry from Council Member C. Schumacher, Mr. Simmons explained the roof will be built in a way to support solar panels desired by any of the residents. May 23, 2017 Carlsbad City Council Regular Meeting Page 5 In response to Mayor Hall, Mr. Simmons explained that the applicant worked with the City to purchase credits in an existing development to satisfy the low-income housing unit requirement. Mayor Hall closed the duly noticed Public Hearing at 7:11 p.m. Mayor Hall confirmed this project is not the first time an applicant has purchased low-income housing unit credits off-site. Housing and Neighborhood Services Director Debbie Fountain stated that this project only has a three unit requirement and it is easier to purchase credits off site. Council Member Packard spoke in support of the project due to the consistency with the neighborhood. Council Member C. Schumacher expressed concerns relating to the difficulty in placing solar on the project for the residents use and the lack of affordable housing on site. Therefore, she would not be supporting the project for those two reasons. Council Member M. Schumacher stated he could make the findings to support the project as proposed. Mayor Pro Tern Blackburn spoke in support of the project. Mayor Hall also spoke in support of the project. He requested that conditions be added to the resolution to require that the applicant include language in the CC&R's addressing roof top noise and the prohibition on short term vacation rentals. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-091 as amended to include the following language: 3. The approved CC&Rs shall include the following provisions: a) A reminder that short-term vacation rentals are prohibited within the project; and b) The HOA shall establish guidelines for use of the common roof deck space in order to minimize noise impacts to the adjacent properties. Motion carried, 4/1 (C. Schumacher -No). Mayor Hall adjourned to the Joint Special Meeting of the City Council and Carlsbad Municipal Water District Board at 7:26 p.m. Mayor Hall reconvened the Regular City Council Meeting at 7:48 p.m. May 23, 2017 Carlsbad City Council Regular Meeting Page 6 DEPARTMENTAL AND CITY MANAGER REPORTS: 17. FISCAL YEAR 2017-18 OPERATING BUDGET WORKSHOP -Acceptance of report on the Fiscal Year 2017-18 Preliminary Operating Budget and set the Public Hearing for June 13, 2017. (Staff contact: Helga Stover, Finance) City Manager's Recommendation: Receive the report and set the Public Hearing for June 13, 2017. Chief Operations Officer Marisa Lundstedt gave an overview of the upcoming presentation and introduced Administrative Services Director Chuck McBride and Finance Manager Helga Stover to present the report and review a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member M. Schumacher, Director McBride explained that the golf course is projecting to do about 55,000 rounds of golf and a quarter million in operating revenues. In response to Council Member C. Schumacher, Director McBride explained that the City's reserve policy requires reserves of 30% of the operating budget. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to receive the report and set the Public Hearing for June 13, 2017. Motion carried, 5/0. 18. CARLSBAD MUNICIPAL CODE REVIEW AND UPDATE -Adopt Resolution No. 2017-095 approving the proposed scope and schedule for the comprehensive Carlsbad Municipal Code update and appropriating funds. Provide direction to staff relating to desired method of Council input for revisions to Title 1 (General Provisions) and Title 2 (Administration and Personnel). (Staff contact: Celia Brewer, City Attorney) City Manager's Recommendation: Adopt the resolution and provide direction to staff. City Attorney Celia Brewer presented the report. Council discussion ensued regarding their support for the effort to update the Municipal Code and concurred to form a Council ad hoc committee to work with staff on Chapters 1 and 2. Council Member C. Schumacher stated she was excited about this project and would support the subcommittee idea. She also stated that she would like to serve on the committee. Council Member Packard stated he would like someone with the Council history view to serve on the sub-committee. May 23, 2017 Carlsbad City Council Regular Meeting Page 7 Mayor Hall stated that he would like Council Members M. Schumacher and Packard to serve on the committee since Mayor Pro Tern Blackburn and Council Member C. Schumacher recently served on another ad hoc committee. ACTION: On a Minute Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn to appoint Council Member M. Schumacher and Council Member Packard to the sub- committee. Motion carried, 4/1 (C. Schumacher-No). ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-095. Motion carried, 5/0. 19. HISTORIC PRESERVATION COMMISSION APPOINTMENT-Adoption of a resolution appointing one member to the Historic Preservation Commission. (Staff contact: Sheila Cobian, City Clerk Department) City Manager's Recommendation: Consider Council nominations and appoint one member to the Historic Preservation Commission. The following nominations were made for one appointment to the Historic Preservation Commission: Council Member Packard nominated Laurie Boone for reappointment Council Member C. Schumacher nominated Holly Hart for appointment Council Member M. Schumacher nominated Laurie Boone for reappointment Mayor Pro Tern Blackburn nominated Laurie Boone for reappointment ACTION: Motion by Council Member Packard, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-096 reappointing Laurie Boone to the Historic Preservation Commission. Motion carried, 5/0.
