Hall,K.Blackburn, M. Schumacher,C.Schumacher, M. Packard. CLOSED SESSION: PUBLIC COMMENT ON AGENDA ITEMS: Council concurred to move Item No. 3 up for discussion at the beginning of the meeting. City Attorney Celia Brewer read the Council into Closed Session. Council adjourned into Closed Session at 3:32 p.m. pursuant to the following: 3.CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION To discuss existing litigation pursuant to Government Code section 54956.9(a)(d)(1). Gabrielle Ginter v. City of Carlsbad,Case No. 37-2015-00042052 -CU-PO-NC Council Action:No reportable action. Council reconvened to Open Session at 3:39 p.m. OPEN SESSION: 1.POLICE OFFICER TERMINATION CASE To review the full Administrative Record concerning the termination of Police Officer Steven Seapker;allow reasonable oral arguments by both parties; take whatever action the City Council deems appropriate regarding final disciplinary action;give direction to the City Attorney to prepare final form of resolution containing finding supporting City Council's decision based on substantial evidence from the entire record. Michael Williamson, counsel for the appellant Mr. Seapker, addressed the Council regarding the termination of Officer Seapker.Mr. Williamson requested that the City Council accept the Hearing Officer's recommendations and reinstate Mr. Seapker's employment. Laura Kalty, counsel for the Carlsbad Police Department, reviewed a PowerPoint presentation (on file in the Office of the City Clerk)detailing the history of events that led to Officer Seapker's termination.Ms.Kalty requested that the Council reject the Hearing Officer's recommendations regarding the final disciplinary action of Officer Seapker. April 25, 2017 Carlsbad City Council Special Meeting Page 2 Mayor Pro Tern Keith Blackburn disclosed that he worked at the Police Department at the same time that Steven Seapker worked there and believed that he could be fair in this process. James C.Mitchell spoke in support of Steven Seapker returning to his position of police officer. CLOSED SESSION: City Attorney Celia Brewer read the Council into Closed Session. Council adjourned into Closed Session at 4:28 p.m. pursuant to the following: 2.CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION To discuss existing litigation pursuant to Government Code section 54956.9(a)(d)(1). Steven Seapker v. City of Carlsbad,Case No. CSMCS ARB-13-0476 The Council reconvened to Open Session at 5:20 p.m. and the Mayor made the following announcement: The City Council rejects the findings and recommendations of the Hearing Officer.The City Council upheld the termination of Steven Seapker.The City Attorney is directed to prepare a resolution of findings.(4/0/1 —C.Schumacher Abstain) Item No. 3 was pulled and discussed at the beginning of the meeting. 3.CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION To discuss existing litigation pursuant to Government Code section 54956.9(a)(d)(1).
