APPROVAL OF MINUTES: Minutes of the Regular Meeting held April 11, 2017. Minutes of the Special Closed Session Meeting held April 18, 2017. Minutes of the Regular Meeting held April 18, 2017. Minutes of the Special Closed Session Meeting held May 16, 2017. Minutes ofthe Special Closed Session Meeting held May 23, 2017. Minutes of the Special Citizens Academy Meeting held May 25, 2017. Minutes of the Special Meeting held May 30, 2017. Minutes of the Special Closed Session Meeting held May 30, 2017. Motion by Mayor Pro Tern K. Blackburn, seconded by Council Member M. Schumacher, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATION: Presentation of proclamation in recognition of 3rd Grade Art Winners. Mayor Pro Tern Blackburn read the proclamation for Historic Preservation Month and presented it to Historic Preservation Commissioner Laurie Boone. Assistant Deputy Library Director Suzanne Smithson and Commissioners Laurie Boone, Kevin Bender and Jack Nelson presented the awards to the 3rd grade art winners. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced there was no reportable action. CONSENT CALENDAR: Item No. 9 was pulled for discussion. ACTION: Motion by Mayor Pro Tern K. Blackburn, seconded by Council Member M. Schumacher, to approve Consent Calendar Item Nos. 1-8, and 10. Motion carried unanimously, 5/0. 1. ANNUAL REPORT OF INVESTMENT PORTFOLIO-Acceptance of Annual Report of Investment Portfolio as of June 30, 2016. (Staff contact: Nancy Sullivan, Administrative Services) 2. SET PUBLIC HEARING FOR STREET LIGHTING AND LANDSCAPING DISTRICT 1 -Adoption of Resolution No. 2017-098 initiating the proceedings, approving the preliminary engineer's June 13, 2017 Carlsbad City Council Regular Meeting Page 2 report for Fiscal Year 2017-18 and setting a public hearing for July 11, 2017 for the Annual Levy of Assessments within Lighting and Landscaping District No. 1, a special assessment district. (Staff contact: Roxanne Muhlmeister, Administrative Services) 3. SET PUBLIC HEARING FOR STREET LIGHTING AND LANDSCAPING DISTRICT 2 -Adoption of Resolution No 2017-099 initiating the proceedings, approving the preliminary engineer's report for Fiscal Year 2017-18 and setting a public hearing for July 11, 2017 for the Annual Levy of Assessments within Lighting and Landscaping District No. 2, a special assessment district. DECLARATION OF RESTRICTIVE COVENANTS FOR LAKE CALAVERA MITIGATION SITES - Adoption of Resolution No. 2017-100 authorizing the City Manager to execute the Declaration of Restrictive Covenants for the Lake Calavera Mitigation Sites within Lake Calavera Preserve. RENEWAL OF EXCESS LIABILITY COVERAGE FOR FY2017-18-Adoption of Resolution No. 2017- 101 authorizing the purchase of $25 million of excess liability coverage through County Supervisors Association of California DBA California State Association of Counties Excess Insurance Authority (CSAC EIA) for fiscal year 2017-2018 in an amount not to exceed $403,000.00. (Staff contact: Ed Garbo, Administrative Services) 6. RENEWAL OF INSURANCE COVERAGE THROUGH ALLIANT INSURANCE FOR FY2017-18 - Adoption of Resolution No. 2017-102 authorizing the purchase of $1 billion of property insurance coverage through Alliant Insurance Services lnc.'s Alliant Property Insurance Program (APIP) for fiscal year 2017-2018 in an amount not to exceed $164,051.04. PROFESSIONAL SERVICES AGREEMENT WITH EsGIL CORPORATION -Adoption of Resolution No. 2017-103 approving a Professional Services Agreement with EsGil Corporation to provide building plan check services for up to five years. (Staff contact: Mike Peterson, Community & Economic Development) 8. AGREEMENT FOR PARK MAINTENANCE SERVICES -Adoption of Resolution No. 2017-104 accepting bids and awarding an agreement for parks maintenance services, work categories D, E & F, to Park West Landscape Maintenance, Inc., for an amount not to exceed $1,637,177 annually, during the initial two year term of the agreement; and authorizing the administrative services director to appropriate a total of $279,333 from the General Fund to the Parks and Trails Maintenance Operating Budgets for FY 2017-18. CARLSBAD FIREFIGHTERS' ASSOCIATION MEMORANDUM OF UNDERSTANDING-Adoption of a resolution adopting a Memorandum of Understanding between the City of Carlsbad and the Carlsbad Firefighters' Association, Inc. (CFA) and approving the associated CFA salary schedule and classification specifications. (Staff contact: Julie Clark, Human Resources) 10. REVISIONS TO JOB CLASSIFICATIONS AND SALARY SCHEDULES -Adoption of Resolution No. 2017-106 adopting new job classifications, revising current job classifications, deleting an existing job classification and amending the Carlsbad Police Officers' Association Salary June 13, 2017 Carlsbad City Council Regular Meeting Page 3 Schedule, the Carlsbad City Employees' Association Salary Schedule, the Part-Time Salary Schedule and the Management Salary Schedule. (Staff contact: Julie Clark, Human Resources) CONSENT CALENDAR ITEM PULLED FOR DISCUSSION Council Members Packard and M. Schumacher requested Item No. 9 be pulled for discussion. 9. CARLSBAD FIREFIGHTERS' ASSOCIATION MEMORANDUM OF UNDERSTANDING-Adoption of Resolution No. 2017-105 adopting a Memorandum of Understanding between the City of Carlsbad and the Carlsbad Firefighters' Association, Inc. (CFA) and approving the associated CFA salary schedule and classification specifications. (Staff contact: Julie Clark, Human Resources) Council Member Packard recognized and congratulated the CFA for being a significant contributing part of our community. Council Member M. Schumacher highlighted the professionalism that the CFA demonstrate every day. Council Member C. Schumacher commented that she is proud to be a part of the shift in compensation philosophy. Mayor Pro Tern Blackburn explained how distracting pay negotiations can be. ACTION: Motion by Council Member Packard, seconded by Council Member M. Schumacher, to approve Consent Calendar Item No. 9. Motion carried unanimously, 5/0. ORDINANCES FOR INTRODUCTION: 11. SET PUBLIC HEARING FOR BUILDING AND FIRE CODE UPDATE -Introduce Ordinance No. CS- 318 repealing existing Chapter 17.04 of the Carlsbad Municipal Code, and adopting a new Chapter 17.04, Fire Prevention Code based on the California Fire Code; and Introduce Ordinance No. CS-319 amending Carlsbad Municipal Code, Title 18, Chapter 18.04 (Building Code); Chapter 18.08 (Mechanical Code); Chapter 18.12 (Electrical Code); Chapter 18.16 (Plumbing Code); Chapter 18.18 (Solar Energy Code); Chapter 18.20 (Residential Code); Chapter 18.21 (Green Building Standards Code); and Chapter 18.30 (Energy Conservation Regulations). (Staff contact: Randy Metz, Fire Department and Mike Peterson, Community & Economic Development) City Manager's Recommendation: Introduce the Ordinances by title only and schedule the public hearing for June 27, 2017. City Attorney Celia Brewer titled the Ordinances. Building & Code Enforcement Manager Mike Peterson reviewed a brief PowerPoint presentation (on file in the Office of the City Clerk). ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to introduce Ordinance Nos. CS-318 and CS-319. Motion carried unanimously, 5/0. PUBLIC COMMENT: Laura Medway, Jessica Price, Student Kelsey Price, and Student Jacob Dougherty spoke in support of keeping the grassy bowl at Poinsettia Park and relocating the dog park away from the playground. Andrew Johnson spoke about the upcoming American Cancer Society Carlsbad & Encinitas Relay for Life. Kyle Menzies spoke about the influx of transients in the Village and Pine Park. PUBLIC HEARING: 12. PROPOSED RECYCLING & TRASH SERVICE RATES -Adoption of Resolution No. 2017-107 approving increases to recycling and trash service rates effective July 1, 2017. (Staff contact: Avecita Jones, Public Works) City Manager's Recommendation: Take public input, close the public hearing and adopt the resolution. Environmental Manager James Wood, Jr. and Public Works Director Elaine Lukey gave a report and presented a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 6:36 p.m. Seeing no one wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 6:36 p.m. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-107. Motion carried unanimously, 5/0. 13. DISTRICT ELECTIONS -Public Hearing regarding the Composition of the City's Voting Districts pursuant to Elections Code 10010{a)(1) (Second of Five Public Hearings). {Staff contact: Celia Brewer, City Attorney's Office) City Manager's Recommendation: Take public input and close the public hearing. Consultants Doug Johnson and Alan Fenstermacher reported out on the district election workshops held on Saturday, June 10, 2017. In response to Council Member C. Schumacher, Mr. Johnson stated that the maps the public submits will be placed on line as part of the interactive review map. He explained that NDC will draw from the submitted maps to draw their maps, the public will comment and Council will vote. Mayor Hall opened the duly noticed Public Hearing at 6:44 p.m. June 13, 2017 Carlsbad City Council Regular Meeting Page 5 David Ku/chin spoke in favor of four districts and an at-large Mayor for four year terms. Seena Trigas and Larry Posner spoke in favor of the Mayor position being elected at-large. Julie Baker spoke in support of four districts and would like to see them drawn as closely as possible to the current quadrants. She also spoke in support of the Mayor position remaining at-large. Arnie Cohen spoke in support of four districts and Mayor at-large. Kerry Siekmann stated that she is in favor of the Mayor being elected at-large. She stated that the districting should be what is best for citizens and not so Council Members can get re- elected. Laurie Boone stated her frustration that districting is being forced on the city and spoke in support of the Mayor position remaining at-large. Laura Dreleshak urged Council to be rational and proactive and choose four districts and the Mayor position elected at-large. Noell Breen agreed that an at-large Mayor is needed but stated there is confusion as to what the City Charter says and would like a more conservative approach. Catherine Miller submitted a speaker slip in support of four districts and the Mayor position elected at-large. Seeing no one else wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 7:03 p.m. Council Member C. Schumacher asked about Government Code 34886. Mr. Fenstermacher stated that it allows the City Council to adopt a five district or four district with at-large Mayor. Mayor Pro Tern Blackburn stated that he does not want to go to districts. He asked about the resident vote of 1964 to go to an at-large Mayor. Mr. Fenstermacher stated that the prudent course would be to continue with the Mayor elected at-large. Council Member C. Schumacher stated that Govt. Code 34886 leaves the Mayor at-large and asked if that takes the power away from the people. Mr. Fenstermacher responded that the purpose of the new code does not take away from a previous vote ofthe people. Mayor Pro Tern Blackburn spoke in favor of four districts and an at-large Mayor for the stability of the City. Council Member M. Schumacher spoke in support of establishing four districts and leaving the Mayor to be elected at-large. June 13, 2017 Carlsbad City Council Regular Meeting Page 6 Council Member Packard expressed support to establish four districts and to leave the Mayor to be elected at-large. ACTION: On a Minute Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, directing the demographer to focus on establishing maps with four districts. Motion carried unanimously, 5/0. Mayor Hall adjourned to the Joint Special Meeting of the City Council, Carlsbad Municipal Water District, Public Financing Authority, Community Development Commission and City Council as Successor Agency to the Redevelopment Agency at 7:25 p.m. Mayor Hall reconvened the Regular City Council Meeting at 8:12 p.m. DEPARTMENTAL AND CITY MANAGER REPORT: 18. TRAFFIC SAFETY COMMISSION APPOINTMENT -Adoption of Resolution No. 2017-116 appointing one member to the Traffic Safety Commission. (Staff contact: Tammy McMinn, City Clerk Department) City Manager's Recommendation: Adopt the resolution. ACTION: Motion by Mayor Hall, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-116 appointing Jonnie Johnson to the Traffic Safety Commission. Motion carried, 4/1 {C. Schumacher -No). COUNCIL REPORTS AND COMMENTS: Mayor Hall and Council Members reported on activities and meetings of some committees and sub-committees of which they are members. CITY MANAGER COMMENTS: None.
