PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: None. APPROVAL OF MINUTES: Minutes of the Joint Special Meeting held September 12, 2017. Minutes of the Special Meeting held September 26, 2017. Minutes of the Regular Meeting held September 26, 2017. Motion by Council Member Packard, seconded by Council Member M. Schumacher, to approve the minutes as presented. Mayor Hall announced he would not be voting on the Sept. 26 minutes. For the Sept. 12 2017 minutes, motion carried unanimously, 5/0. For the Sept. 26, 2017 minutes, motion carried, 4/1 (Hall -Abstained). PRESENTATION: Presentation of proclamation in recognition ofthe Carlsbad Charitable Foundation Anniversary. Mayor Hall presented the proclamation to Knox Williams, Founding Chair, and the Carlsbad Charitable Foundation in recognition of the Carlsbad Charitable Foundation 10th Anniversary. Presentation of proclamation in recognition of America Recycles Day. Council Member Cori Schumacher presented the proclamation to Environmental Manager James Wood in recognition of America Recycles Day. CONSENT CALENDAR: Council Member C. Schumacher requested Item No. 2 be pulled for discussion. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to approve Consent Calendar Item Nos. 1 and 3 through 7. Motion carried unanimously, 5/0. 1. REPORT ON CITY INVESTMENTS-Acceptance of report on City Investments as of September 30, 2017. ADOPTION OF THE 2018 REGULAR CITY COUNCIL MEETING CALENDAR -Adoption of Resolution No. 2017-208 approving the 2018 Regular City Council Meeting Calendar. (Staff contact: Sheila Cobian, City Clerk) Council Member C. Schumacher made a motion to change the time of the proposed 9 a.m. meetings to 6 p.m. for calendar year 2018. Motion failed due to lack of a second. ACTION: Motion made by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-208. Motion carried, 4/1 (C. Schumacher-No). 3. APPROVAL TO ISSUE RFP FOR LEASE OF DOVE LIBRARY CAFE PROPERTY AT 1775 DOVE LANE Adoption of Resolution No. 2017-209 authorizing the release of a request for proposals for leasing the property located at 1775 Dove Lane, commonly known as the Dove Library Cafe. (Staff contact: Curtis Jackson, City Manager Department) 4. SUMMARILY VACATE A PUBLIC UTILITY EASEMENT AT 5440 GRAND PACIFIC DRIVE-Adoption of Resolution No. 2017-210 approving a summary vacation of a public utility easement for an existing water system designated for fire service at 5440 Grand Pacific Drive. Case Name: Carlsbad Ranch PA 5 Utility Easement Vacation. Case No.: STV 15-01. (Staff contact: David Rick, Community and Economic Development) 5. APPROVAL TO REMOVE A GAS LINE ADJACENT TO THE VISTA/CARLSBAD INTERCEPTOR SEWER -Adoption of Resolution No. 2017-211 approving a collectible work authorization with Southern California Gas Company to remove a 12-inch gas line adjacent to the Vista/Carlsbad Interceptor Sewer, Reach VCllB, Project No. 3886. (Staff contact: Terry Smith, Public Works) 6. AGREEMENT FOR CONSTRUCTION MANAGEMENT SERVICES FOR FIRE STATION 2-Adoption of Resolution No. 2017-212 authorizing execution of an agreement with SchneiderCM, Inc. to provide construction management services during the design and reconstruction of Fire Station 2, Project No. 4060, for an amount not to exceed $391,500. (Staff contact: Steven Stewart, Public Works) 7. ADVERTISE FOR BIDS FOR DRAINAGE MASTER PLAN PROJECT -Adoption of Resolution No. 2017-213 approving the plans and specifications and authorizing the City Clerk to advertise for bids for the Drainage Master Plan Project: BCA -Tamarack Avenue, Park Drive and Monroe Street, Project Nos. 6001, 6608 and 6617, and approving an additional appropriation of Planned Local Drainage Area B Funds in the amount of $391,105. CS-326 AMENDING ZONING ORDINANCE CHAPTERS 21.30.010, 21.32.010, 21.34.020 AND 21.42.140 RELATING TO AUTO REPAIR AND AUTO STORAGE USES -Adoption of Ordinance No. CS-326 approving an amendment to the Zoning Ordinance and Local Coastal Program to: 1) Allow for Auto Repair within the P-M Planned Industrial Zone subject to approval of a Minor Conditional Use Permit; 2) Change the permit required for auto storage in the C-M Heavy Commercial-Limited Industrial Zone, M Industrial Zone and P-M Planned Industrial Zone from a Conditional Use Permit to a Minor Conditional Use Permit; and 3) Establish screening requirements for auto repair and auto storage uses. City Attorney Celia Brewer titled the Ordinance ACTION: Motion by Mayor Pro Tern, seconded by Council Member M. Schumacher, to adopt Ordinance No. CS-326. Motion carried unanimously, 5/0. PUBLIC COMMENT: Alex Brown spoke regarding the Lancer on line paper article "Overdevelopment Ruins Local Beauty." AJ Griffin, Staff Writer for the LancerLink, read the article he wrote. Walt Meier spoke in support of leash laws for dogs. Laurie Boone spoke about how thankful she is to live in Carlsbad. PUBLIC HEARING: 9. 2018-2019 CDBG FUNDING PLAN -Adoption of Resolution No. 2017-214 approving the 2018- 2019 Community Development Block Grant Program Funding Plan and Citizen Participation Plan, and authorizing the distribution of the Notice of Funding Availability. (Staff contact: Courtney Pene, Community & Economic Development) City Manager's Recommendation: Take public input, close the public hearing and adopt the resolution. Management Analyst Courtney Pene gave a brief PowerPoint presentation (on file in the Office of the City Clerk). In response to Mayor Hall, Interim Community & Economic Development Director Debbie Fountain explained that HUD drives the dollar amount by a variety of factors. November 7, 2017 Carlsbad City Council Regular Meeting Page 4 In response to Council Member C. Schumacher, Analyst Pene clarified the Community Engagement process for the overall program. Mayor Hall opened the duly noticed Public Hearing at 6:43 p.m. Simon Angel suggested the Council put more money towards the homeless and keep public restrooms open longer. Seeing no one else wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 6:45 p.m. Council Member C. Schumacher suggested they set a theme around the Notice of Funding Availability for homelessness. In response to Mayor Hall, Director Fountain stated that the small grant amount was set by a Council policy. Mayor Hall suggested they double the amount of small grants from $10,000 to $20,000. He suggested working with Solutions for Change to assist the homeless in obtaining housing. Council Member Packard reminded everyone that there is a committee who chooses the grant recipients. ACTION: Minute Motion by Council Member C. Schumacher to amend the resolution to include the theme of homelessness in the current year's Notice of Funding Availability, seconded by Mayor Hall. Motion carried, 3/2 (M. Schumacher, Packard -No). ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-214. Motion carried unanimously, 5/0. Mayor Hall adjourned to the Joint Special Meeting of the City Council and Carlsbad Municipal Water District Board at 6:54 p.m. Mayor Hall reconvened the Regular City Council Meeting at 6:56 p.m. DEPARTMENTAL AND CITY MANAGER REPORTS: 12. PRESENTATION BY SISTER CITY AMBASSADORS -Receive a presentation from Tom Hersant representing the Carlsbad Sister City Ambassadors. (Staff contact: Sheila Cobian, City Clerk Department) City Manager's Recommendation: Receive the presentation. Tom Hersant gave a brief presentation on Sister City Ambassadors. Schumacher, to receive the presentation and add the item to a future agenda with recommendations from staff. Motion carried unanimously, 5/0. 13. AUTHORIZATION TO ENTER INTO LEASE NEGOTIATIONS WITH SAN DIEGUITO UNION HIGH SCHOOL DISTRICT -Adoption of Resolution No. 2017-216 authorizing staff to initiate lease negotiations with the San Dieguito Union High School District for the maintenance and operations of the La Costa Valley Sports Complex. (Staff contact: Mick Calarco, Parks & Recreation) City Manager's Recommendation: Adopt the resolution. Special Projects Manager Mick Calarco presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Tina Douglas from the San Dieguito High School District spoke in support of the project. Vicky Sayage spoke in support of the project with the caveat that it does not count towards park space and public access in the Southeast Quadrant. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-216. Motion carried unanimously 5/0. 14. BUENA VISTA LAGOON ENHANCEMENT PROJECT -Receive a Presentation from SANDAG regarding the Buena Vista Lagoon Enhancement Plan Final EIR. (Staff contact: Jason Haber, City Manager Department) City Manager's Recommendation: Receive the presentation. Assistant to the City Manager Jason Haber and Keith Greer from SAN DAG gave a brief PowerPoint presentation (on file in the Office of the City Clerk). Joan Herskowitz from the Buena Vista Audubon Society spoke in support of the saltwater alternative. Natalie Shapiro representing the Board of the Buena Vista Audubon Society and Preserve Calaveras spoke in support of the saltwater alternative. Ray Allen, President of Buena Vista Lagoon Foundation, stated that the Board voted to support the saltwater alternative. ACTION: Minute Motion by Council Member C. Schumacher, seconded by Mayor Pro Tern Blackburn, to submit a letter to SAN DAG supporting the saltwater alternative. Motion carried unanimously, 5/0. HISTORIC PRESERVATION COMMISSION APPOINTMENT-Adoption of Resolution No. 2017- 217 appointing one member to the Historic Preservation Commission. (Staff contact: Tamara McMinn, City Clerk Department) City Manager's Recommendation: Adopt the resolution. Mayor Hall nominated Shelley Sander to serve on the Historic Preservation Commission. Council Member C. Schumacher nominated Catherine Wright to serve on the Historic Preservation Commission. Council voted on the nomination first made by Mayor Hall. ACTION: Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2017-217 appointing Shelly Sander to the Historic Preservation Commission. Motion carried, 5/0. 16. TRAFFIC SAFETY COMMISSION APPOINTMENT -Adoption of Resolution No. 2017-218 appointing one member to the Traffic Safety Commission. (Staff contact: Tamara McMinn, City Clerk Department) City Manager's Recommendation: Adopt the resolution. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-218 appointing Peter Penseyres to the Traffic Safety Commission. Motion carried, 4/1 (C. Schumacher -No). 17. BEACH PRESERVATION COMMITTEE APPOINTMENT-Adoption of Resolution No. 2017-219 appointing one member to the Beach Preservation Committee.
