APPROVAL OF MINUTES: Minutes of the Regular Meeting held October 17, 2017. Minutes of the Special Meeting held October 24, 2017. Minutes of the Regular Meeting held October 24, 2017. Minutes of the Special Meeting held November 7, 2017. Minutes of the Regular Meeting held November 7, 2017. Minutes of the Joint Special Meeting held November 7, 2017. Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to approve the minutes as presented. Motion carried unanimously, 5/0. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: None. PRESENTATION: Presentation of proclamation in recognition of the Beach Preservation Committee Members. Council Member M. Schumacher presented a proclamation to Darryl Hatheway and Bret Barger for their eight years of service on the Beach Preservation Committee. Mr. Hatheway and Mr. Barger said a few words and thanked the Council. Presentation of proclamation in recognition of the Online High School Graduate. Council Member Packard presented a proclamation to Wendy Hoch-Estelle for being the first graduate of the Carlsbad City Library's Career Online High School Program. Ms. Hoch-Estelle thanked the City of Carlsbad for the opportunity to be able to obtain her high school diploma. CONSENT CALENDAR: ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to approve Consent Calendar Item Nos. 1 through 5 and Item No. 7. Motion carried unanimously, 5/0. 1. ACCEPTANCE OF ANNUAL FINANCIAL INFORMATION REPORT ON CAPITAL PROJECT FUNDS & SPECIAL TAXES -Adoption of Resolution No. 2017-221 accepting the Annual Financial Information Report on Capital Project Funds and Special Taxes pursuant to California December 5, 2017 Carlsbad City Council Regular Meeting Page 2 Government Code Sections 50075, 66001 and 66006. (Staff contact: Roxanne Muhlmeister, Administrative Services) 2. APPROVAL OF PART-TIME MINIMUM WAGE SALARY INCREASE -Adoption of Resolution No. 2017-222 adopting revisions to the City of Carlsbad Part-Time Salary Schedule and approving pay increases for part-time employees who are below minimum wage. (Staff contact: Drew Cook, Human Resources) 3. APPROVAL OF 2018 BOARDS, COMMISSIONS & COMMITTEES LOCAL APPOINTMENT LISTS - Received and filed Boards, Commission and Committees Local Appointments List for 2018. (Staff contact: Tammy McMinn, City Clerk Department) 4. APPROVAL OF AMENDMENT TO AGREEMENT FOR AGUA HEDIONDA LIFT STATION & VISTA/CARLSBAD INTERCEPTOR -Adoption of Resolution No. 2017-223 approving Amendment No. 1 to the agreement between the City of Vista and the City of Carlsbad for construction of the Agua Hedionda Sewer Lift Station and Vista/Carlsbad Interceptor Sewer, reaches VC11-VC15, Project Nos. 3492, 3886, and 3949. (Staff contact: Terry Smith, Public Works) 5. APPROVAL OF CONTRACT WITH COUNTY FOR ANIMAL CONTROL SERVICES -Adoption of Resolution No. 2017-224 approving a Joint Operating and Financial Plan between the City of Carlsbad and the County of San Diego for animal control services. (Staff contact: Cindy Anderson, Police Department) This item was pulled for discussion by Council Member C. Schumacher. 6. RATIFYING FIRST AMENDMENT TO LEASE AGREEMENT WITH MAAC PROJECT TO OPERATE A PRESCHOOL-Adoption of a resolution ratifying the First Amendment to the Lease Agreement with Metropolitan Area Advisory Committee on anti-poverty in San Diego County, Inc. DBA MAAC Project to operate a preschool at the city-owned property located at 3368 Eureka Place and authorizing the City Manager to execute the Lease Agreement and the subsequent extension option for the final year. UTILITY EASEMENT VACATION AND SLOPE EASEMENT VACATION -VAC 2017-0007-Adoption of Resolution No. 2017-226 approving a summary vacation of all that portion of a public utility easement across Parcel 3 of Parcel Map No. 18059, located at the southeast corner of El Camino Real & Cougar Drive. Case Name: West Coast Self Storage -Carlsbad. Case No.: VAC 2017-0007.; and Adoption of Resolution No. 2017-227 approving a summary vacation of all that portion of a slope easement on Parcel 3 of Parcel Map No. 18059 Fronting Cougar Drive. Case Name: West Coast Self Storage -Carlsbad. Case No.: VAC 2017-0007. (Staff contact: David Rick, Community & Economic Development) CONSENT CALENDAR ITEM PULLED FOR DISCUSSION: This item was pulled for discussion by Council Member C. Schumacher. 6. RATIFYING FIRST AMENDMENT TO LEASE AGREEMENT WITH MAAC PROJECT TO OPERATE A PRESCHOOL -Adoption of Resolution No. 2017-225 ratifying the First Amendment to the December 5, 2017 Carlsbad City Council Regular Meeting Page 3 Lease Agreement with Metropolitan Area Advisory Committee on anti-poverty in San Diego County, Inc. DBA MAAC Project to operate a preschool at the city-owned property located at 3368 Eureka Place and authorizing the City Manager to execute the Lease Agreement and the subsequent extension option for the final year. (Staff contact: Curtis Jackson, City Manager Department) Motion by Council Member C. Schumacher to authorize the execution of the agreement with the specific caveat that the rent will not be increased, seconded by Mayor Hall. Motion failed, 1/4 (C. Schumacher -Yes) ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2017-225. Motion carried, 4/1 (C. Schumacher -No). ORDINANCES FOR INTRODUCTION: 8. ORDINANCE AMENDING CMC 10.40.145 -TRAFFIC ENGINEER TO INDICATE LOCATIONS WHERE PARKING BEYOND MARKINGS OF SINGLE SPACE IS PROHIBITED-Introduce Ordinance CS-328 amending section 10.40.145 of the Carlsbad Municipal Code. (Staff contact: Cindy Anderson, Police Department) City Manager's Recommendation: Introduce the Ordinance by title only and schedule the second reading and adoption of the ordinance for a future meeting. City Attorney Celia Brewer titled the Ordinance. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to introduce Ordinance No. CS-328. Motion carried, 5/0. ORDINANCES FOR ADOPTION: None. PUBLIC COMMENT: Mary Lucid requested that funding be provided to ensure adequate service levels at the Senior Center. Paul Housh spoke about Trail H and areas where dogs are permitted to be off-leash. Al Wanamaker spoke about the Buena Vista Lagoon input the citizens gave and their concern for the effect it will have on the beaches. De'Ann Weimer spoke regarding the changes made to Carlsbad Municipal Code Chapter 1.20. She requested that the Council create an Ethics Commission to review changes. Clark Thomas spoke about his concerns of the drug epidemic taking place at Tamarack Beach. Tom Rausch spoke about two different projects located on realignment of Carlsbad Boulevard and the safety issues regarding the roundabout. PUBLIC HEARING: None. COUNCIL POLICY REQUIRING EARLY STAKEHOLDER OUTREACH FOR SIGNIFICANT NEW DEVELOPMENT PROPOSALS-Adoption of Resolution No. 2017-228 adopting a development project public involvement policy related to the General Plan Lawsuit Settlement Agreement. Case Name: Development Project Public Involvement Policy. Case No.: OAJ 17-0006 (PUB17Y- 0021) (Staff contact: Carl Stiehl, Community & Economic Development) City Manager's Recommendation: Adopt the resolution. City Planner Don Neu and Associate Planner Carl Stiehl presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Motion by Mayor Pro Tern K. Blackburn, seconded by Council Member C. Schumacher to have staff address the issues brought up by Council and return with an updated staff report as well as provide public notification. Motion failed, 2/3 (K. Blackburn, C. Schumacher -Yes) ACTION: Motion by Council Member M. Schumacher, seconded by Council Member Packard to adopt Resolution No. 2017-228 with the amended language to include staff's original recommendation of "50 residential units or 50,000 square feet of habitable space." Motion carried -5/0. 10. AFFORDABLE HOUSING LOAN STATUS REPORT -Acceptance of the Housing Loan Status Report as presented by city staff. (Staff contact: Debbie Fountain, Housing & Neighborhood Services) City Manager's Recommendation: By minute motion, accept the Housing Loan Status Report. Housing & Neighborhood Services Director Debbie Fountain presented the report. ACTION: Motion by Mayor Pro Tern K. Blackburn, seconded by Council Member M. Schumacher to accept the Housing Loan Status Report as presented by staff. Motion carried -5/0. RECESS: Mayor Hall declared a recess at 7:26 p.m. Mayor Hall reconvened the Regular City Council Meeting at 7:30 p.m. with all Council Members present. 11. INTEGRATED PEST MANAGEMENT PLAN -Acceptance of the Integrated Pest Management Plan as presented by city staff, consider available options on city owned or operated properties and rights of way, and provide direction to staff as appropriate. (Staff contact: Kyle Lancaster, Parks & Recreation) City Manager's Recommendation: Receive report, consider options and adopt the resolution. December 5, 2017 Carlsbad City Council Regular Meeting Page 5 Parks & Recreation Director Chris Hazeltine, Public Works Director Elaine Lukey and Parks Services Manager Kyle Lancaster presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mary Ann Viney spoke regarding the effects of exposure to benzene and other chemicals. Bob Johnson spoke regarding some of the accomplishments that Non-toxic Irvine has made in their area. Mary-Anne Monck spoke about her studies on integrated pest management plans. Kevin Fretz spoke about his work in helping convert cities into organic communities after his childhood poisoning experience. Bridget Wright spoke about carcinogens and the effect of exposure to developing children and her support for Option 3a. Quinn Bodon expressed his concerns with the chemicals at his school and his support for Option 3a. Melanie Burkholder expressed her concern for the schools choice of spraying the fields with chemicals the day before Field Day and her support for Option 3a. Samantha Sarsilmaz spoke about her support for Option 3a to remove the harmful pesticides from the public areas so that the children can play safely. Heather Benson expressed her concern of chemical runoff into the ocean and stated her support for Option 3a. Amanda Mascia spoke about the pesticides that are being applied to the Calavera Preserve boundaries that touch on constituents' backyards. Paige DeCino spoke about the lack of complete herbicide and pesticide testing. Kasey Cinciarelli spoke about her findings in a test she conducted on her organic property. Linda Breen spoke about her support for Option 3a. Robin Hansen spoke about her support for a natural environment. ACTION: Motion by Mayor Hall, seconded by Council Member C. Schumacher to adopt Resolution No. 2017-229 and accept the Integrated Pest Management Plan Option 3a as presented by staff. Motion carried -5/0. CTBID AND CGLBID COMMISSION APPOINTMENTS -Adoption of Resolution No. 2017-230 and Resolution No. 2017-231 appointing two members to the Carlsbad Tourism Business Improvement District Advisory Board; and Adoption of Resolution No. 2017-232 appointing one member to the Carlsbad Golf Lodging Business Improvement District Advisory Board. ACTION: Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn to adopt Resolution No. 2017-230 appointing Robert Rauch to the CTBID and 2017-231 reappointing Bill Canepa to the CTBID. Motion carried unanimously, 5/0. ACTION: Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn to adopt Resolution No. 2017-232 appointing Robert Rauch to the CGLBID. Motion carried unanimously, 5/0.
