APPROVAL OF MINUTES: Minutes of the Regular Meeting held November 14, 2017. Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to approve the minutes as presented. Motion carried unanimously, 5/0. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: No reportable action. PRESENTATION: None. CONSENT CALENDAR: ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to approve Consent Calendar Item Nos. 1, 3 through 6. Motion carried unanimously, 5/0. 1. REPORT ON CITY INVESTMENTS -Acceptance of report on City Investments as of November 30, 2017. (Staff contact: Nancy Sullivan, Administrative Services) This item was pulled for discussion by Council Member C. Schumacher. 2. FIRST AMENDMENT TO THE LEASE AGREEMENT WITH BIO, TECH, AND BEYOND, LLC - Adoption of a resolution approving the first amendment to the lease agreement with Bio, Tech, and Beyond, LLC at 2351 Faraday Avenue and authorizing the City Manager to execute the first amendment. (Staff contact: Curtis Jackson, City Manager Department) 3. APPROVAL OF AGREEMENT FOR BEACH ACCESS REPAIRS -Adoption of Resolution No. 2018- 002 approving a professional services agreement for the preparation of construction plans, specifications, cost estimates, and environmental permits with GHD, Inc., for an amount not to exceed $500,000 for the Carlsbad Boulevard Beach Access Repairs from Pine Avenue to Tamarack Avenue, Project No. 3896. AWARD OF CONTRACT FOR CONSTRUCTION OF BRIDGE PREVENTATIVE MAINTENANCE PROGRAM -Adoption of Resolution No. 2018-003 accepting bids and awarding a contract to Leonida Builders, Inc. for an amount not to exceed $434,420 for the construction of the Bridge January 9, 2018 Carlsbad City Council Regular Meeting Page 2 Preventative Maintenance Program (2017), Project No. 6066-17. CONTRACT FOR CONSTRUCTION OF THE ADA IMPROVEMENT PROGRAM -Adoption of Resolution No. 2018-004 accepting bids and awarding a contract to Ramona Paving & Construction Corp. for an amount not to exceed $620,266 for the construction of the ADA Improvement Program, Project No. 6049-17. CREATION OF THE ROAD MAINTENANCE AND REHABILITATION ACCOUNT FUND AND APPROPRIATION OF FUNDS TO THE PAVEMENT MANAGEMENT PROGRAM -Adoption of Resolution No. 2018-005 creating the Road Maintenance and Rehabilitation Account Fund and appropriating Road Maintenance Rehabilitation Account Funds to the Pavement Management Program, Project No. 6001, and the Concrete Repair Program, Project No. 6013. (Staff contact: Marshall Plantz, Public Works) CONSENT CALENDAR ITEM PULLED FOR DISCUSSION: This item was pulled for discussion by Council Member C. Schumacher. 2. FIRST AMENDMENT TO THE LEASE AGREEMENT WITH BIO, TECH. AND BEYOND. LLC - Adoption of Resolution No. 2018-001 approving the first amendment to the lease agreement with Bio, Tech, and Beyond, LLC at 2351 Faraday Avenue and authorizing the City Manager to execute the first amendment. (Staff contact: Curtis Jackson, City Manager Department) In response to Council Member C. Schumacher's inquiry as to whether or not the City Hall needs assessment would be completed within two years, Assistant City Manager Gary Barberio stated that it would be and that the two year lease seems to fit the timing of the process well. Council Member C. Schumacher expressed her preference for a one year lease rather than a two year lease. In response to Mayor Pro Tern Blackburn, Assistant City Manager Barberio confirmed that there is a without cause 90 day termination provision clause in the agreement. ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to approve Resolution No. 2018-001. Motion carried, 4/1 (C. Schumacher -No). ORDINANCES FOR INTRODUCTION: 7. AMENDING CARLSBAD MUNICIPAL CODE CHAPTER 1.20-Introduction of Ordinance No. CS- 329 repealing Chapter 1.20 -City Council Procedure and replacing it with Chapter 1.20 - Meetings. (Staff contact: Celia Brewer, City Attorney) City Manager's Recommendation: Introduce the Ordinance. City Attorney Celia Brewer titled the Ordinance. January 9, 2018 Carlsbad City Council Regular Meeting Page 3 ACTION: Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to introduce Ordinance No. CS-329. Motion carried unanimously, 5/0. ORDINANCES FOR ADOPTION: None. PUBLIC COMMENT: Craig spoke about different dangers. Mary Lucid thanked Chief Gallucci and Sergeant Hargett for making things safer at the Senior Center and expressed her concerns for a lack of a discussion group regarding aging. Robert Paul requested that the Trail H alternative use park become a leash free zone. Walt Meier thanked the Council for doing a great job and also spoke about his concerns regarding Trail H. Joaquin Vogler requested that the Council or City assist in helping raise money for leukemia and lymphoma research. The campaign began January 5th and closes February 4th. Glenn Bernard spoke about undergrounding some SDG&E utility lines. Sarah Hageman urged the Council to make traffic modifications on Alicante Road. PUBLIC HEARING: None. Mayor Hall adjourned to the Special Meeting of the Carlsbad Municipal Water District at 6:35 p.m. Mayor Hall reconvened the Regular City Council Meeting at 6:36 p.m. DEPARTMENTAL AND CITY MANAGER REPORTS: 11. TRAFFIC SAFETY COMMISSION APPOINTMENT -Adoption of Resolution No. 2018-006 appointing one member to the Traffic Safety Commission. (Staff contact: Tammy McMinn, City Clerk Department) City Manager's Recommendation: Adopt the resolution. ACTION: Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to approve Resolution No. 2018-006 appointing Bill Fowler to the Traffic Safety Commission. Motion carried, 4/1 (C. Schumacher-No). 12. COUNCIL REORGANIZATION, ELECTION OF MAYOR PRO TEMPORE AND REGIONAL COMMITTEE ASSIGNMENTS -Discuss Council reorganization by election of one member as January 9, 2018 Carlsbad City Council Regular Meeting Page 4 Mayor Pro Tempore and appoint members of the City Council as liaisons/alternatives to various regional committees.
