ROLL CALL: M. Hall, K. Blackburn, M. Schumacher, C. Schumacher, M. Packard. INVOCATION: None. PLEDGE OF ALLEGIANCE: Mayor Pro Tern Blackburn led the Pledge of Allegiance. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: No reportable action. APPROVAL OF MINUTES: Minutes of the Regular Meeting held September 11, 2018 Minutes of the Regular Meeting held September 25, 2018 Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATION: Proclamation in recognition of Public Safety Month Mayor Pro Tern K. Blackburn presented the proclamation for Public Safety Month to Paramedic Firefighter Scott Sandland. Mr. Sandland thanked the Council and spoke about the youth involved in the police and fire explorers. PUBLIC COMMENT: Mary Lucid thanked Parks & Recreation staff for the way they handled an incident at the Senior Center. Jean Camp spoke about the Ponto open space and the choices made by staff and council regarding this issue. Michael Sebahar spoke regarding the Ponto Beachfront development and the feedback that they were going to send to Council regarding the issue. October 16, 2018 Carlsbad City Council Regular Meeting Page 2 Jerry Anderson spoke about a lawsuit filed on his behalf from the Department of Housing and Fair Employment against Lakeshore Gardens. Chris Megison thanked the Mayor for his effort on homelessness. Laurie Boone requested Council provide clarification about the value and purpose of the Historic Preservation Commission. Patrick Foley (handout provided and filed in the Office of the City Clerk) spoke about the letters received by residents from the La Costa Valley Master Association regarding accusations of violating their Declaration of Covenant?, Conditions, and Restrictions. CONSENT CALENDAR: Motion by Mayor Pro Tern Blackbum, seconded by Council Member M. Schumacher, to approve Consent Calendar Item Nos. 2, 4 through 6 except for Item Nos. 1 and 3 which were pulled for discussion. Motion carried unanimously, 5/0. This item was pulled for discussion by Council Member C. Schumacher. 1. 2019 CITY COUNCIL MEETING CALENDAR -Adoption of a Resolution approving the 2019 Regular City Council Meeting Calendar. (Staff contact:· Sheila Cobian, City Clerk Department) 2. APPOINTMENTS TO THE CTBID & CGLBID -Adoption of Resolution No. 2018-180 appointing Geoff Gray to the Carlsbad Tourism Business Improvement District Advisory Board; and, Adoption of Resolution No. 2018-181 appointing Geoff Gray and Tim Stripe to the Carlsbad Golf Lodging Business Improvement District Advisory Board. INITIATION OF A ZONING ORDINANCE AMENDMENT TO LIMIT AIRPORT AND AIRPORT SUPPORTING USES TO THE EXISTING MCCLELLAN-PALOMAR AIRPORT PROPERTY -Adoption of a Resolution declaring the intention to initiate a zoning ordinance amendment to allow airport and airport supporting uses with approval of a Conditional Use Permit only within the current McClellan-Palomar Airport property boundaries, and to prohibit such uses in all other zones and on all other properties within the City. PURCHASE OF REPLACEMENT LOADER AND PATCH TRUCK-Adoption of Resolution No. 2018- 183 authorizing the purchase of a replacement wheel loader from Sonsray Machinery for $128,385 and the purchase of a replacement patch truck from Transwest Truck Center for $145,701 for a total equipment purchase price of $274,086. (Staff Contact: Tony Ulloa, Public Works) 5. AGREEMENT WITH VALLEY CM, INC. FOR CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES Adoption of Carlsbad Municipal Water Board District Resolution No. 1605 authorizing execution of an agreement with Valley CM, Inc. to provide construction October 16, 2018 Carlsbad City Council Regular Meeting Page 3 management and inspection services for the Recycled Water Phase Ill Pipeline Expansion Segment 5, Project No. 5208-B and the Miscellaneous Pipeline Replacements, Project No. 3904 for an amount not to exceed $899,620. AWARD A CONTRACT FOR RECYCLED WATER PHASE Ill PIPELINE EXPANSION SEGMENT 5 - Adoption of Carlsbad Municipal Water Board District Resolution No. 1606 accepting bids and awarding a contract to Ferreira Coastal Construction Co. for an amount not exceed $9,487,655 for the Recycled Water Phase Ill Pipeline Expansion Segment 5, Project No. 5208- B. (Staff Contact: Lindsay Leahy, Public Works) CONSENT CALENDAR ITEM PULLED FOR DISCUSSION: This item was pulled for discussion by Council Member C. Schumacher. 1. 2019 CITY COUNCIL MEETING CALENDAR -Adoption of Resolution No. 2018-179 approving the 2019 Regular City Council Meeting Calendar. (Staff contact: Sheila Cobian, City Clerk Department) Motion by Council Member C. Schumacher, seconded by Mayor Pro Tern Blackburn, to change the morning meetings to evening meetings and approve Resolution No. 2018-179. Motion carried, 3/2 (M. Schumacher; Packard -No). This item was pulled for discussion by Council Member C. Schumacher. 3. Jim Swain spoke in opposition of staff's recommendation. RJ Lowy spoke in opposition of staff's recommendation. Glenn Bernard expressed support for Mr. Hook's success on his company. Group Speaker Vickey Syage, on behalf of Rich Numrich, Pat Amador and Shirley Anderson, spoke regarding the Mayor's attendance at the San Diego County meeting on October 10, 2018. Suzie Thorley spoke in opposition to staff's recommendation and referenced a comment letter submitted for the record to staff. October 16, 2018 Carlsbad City Council Regular Meeting Page 4 Cliff Kaiser spoke in favor of the airport expansion and spoke regarding the Mayor's attendance at the San Diego County meeting on October 10, 2018. Michael Schertzer spoke in opposition of staff's recommendation. Hope Nelson asked the Council and staff to be careful with their words in drafting up this proposed ordinance. Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Resolution No. 2018-182. Motion carried, 5/0. RECESS: Mayor Hall declared a recess at 7:49 p.m. Mayor Hall reconvened the meeting at 7:54 p.m. ORDINANCES FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: None. 7. ORDINANCE NO. CS-341 -ESTABLISH A 30 MPH SPEED LIMIT ON ESTRELLA DE MAR - Adoption of Ordinance No. CS-341 amending Carlsbad Municipal Code Section 10.44.420 to a 30 miles per hour (MPH) speed limit on Estrella de Mar Road from Alga Road to 675 feet north of Beryl Way. (Staff contact: Sheila Cobian, City Clerk Department) City Manager's Recommendation: Adopt Ordinance No. CS-341. City Attorney Celia Brewer titled the ordinance. Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Ordinance No. CS-341. Motion carried unanimously, 5/0. 8. ORDINANCE NO. CS-342 -ADD TWO MEMBERS TO THE TRAFFIC SAFETY COMMISSION - Adoption of Ordinance No. CS-342 amending Chapter 2.15, Section 2.15.050 of the Carlsbad Municipal Code to add two members to the Traffic Safety Commission. (Staff contact: Sheila Cobian, City Clerk Department) City Manager's Recommendation: Adopt Ordinance No. CS-342. City Attorney Celia Brewer titled the ordinance. Motion by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher, to adopt Ordinance No. CS-342. Motion carried unanimously, 5/0. PUBLIC HEARING: DEPARTMENTAL AND CITY MANAGER REPORTS: October 16, 2018 Carlsbad City Council Regular Meeting Page 5 9. COMMUNITY SAFETY AND GUN VIOLENCE PREVENTION POLICY-Receive a committee report from staff and City/School Committee City Council representatives. Consider options regarding the development and adoption of a community safety and gun violence prevention policy and provide direction to staff. (Staff contact: Jason Haber, City Manager) City Manager's Recommendation: Receive the report, consider options and provide direction to staff. Assistant to the City Manager Jason Haber presented the report. Stephanie Wells spoke in support of staff's recommendation and asked that Council ask staff to create a resolution that addresses community safety and gun violence prevention. Dylan Bree spoke regarding common sense and address gun violence with that view. Jesse Bry stated that gun violence is much broader issue than just viol~nce in schools. Minute motion by Council Member Packard, seconded by Council Member M. Schumacher, to change the ending to the proposed resolution to read, "state laws and federal laws" and to also read that they will be "monitored and enforced." Motion carried, 4/1 (C. Schumacher -No). Minute motion by Mayor Pro Tern Blackburn, seconded by Mayor Hall, to direct staff to return with a resolution including the changes that Council Member Packard requested. Motion carried, 4/1 (C. Schumacher -No). Minute motion by C. Schumacher, seconded by Mayor Pro Tern Blackburn, to have a second resolution brought back specifically acknowledging gun violence. Motion carried, 3/2 (M. Schumacher; M. Packard -No). PUBLIC COMMENT: Continuation of the Public Comments Kaitlyn Elliott-Norgrove expressed concern about Mayor Hall's choice to endorse Corrine Busta. Pierre Cochet-Weinaudt provided statistics about gun safety and security. Robert Germann expressed his concerns with the vagueness of the county's proposed airport plans.
