ANNOUNCEMENT OF CONCURRENT MEETINGS: None. Council Chamber 1200 carlsbad Village Drive carlsbad, CA 92008 PLEDGE OF ALLEGIANCE: Mayor Pro Tern Bhat-Patel led the Pledge of Allegiance. INVOCATION: None. APPROVAL OF MINUTES: Minutes of the Regular Meeting held January 15, 2019 Minutes of the Special Meeting held January 22, 2019 Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATIONS: None. PUBLIC COMMENT: Rosanne Bentley spoke in support of construction of Hub Park and trail connections. David Macgurn spoke in support of allowing dogs off-leash at Village H. Brian Connor spoke in support of good governance, democracy and a healthy society. Howard Krausz, representing North County Advocates, spoke about the Forest Management Plan in accordance with the settlement agreement and provided Council with a handout (on file in the Office of the City Clerk). He encouraged the Council to monitor compliance with the settlement agreement. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: None. CONSENT CALENDAR: This item was pulled for discussion by Council Member Schumacher. 1. REQUEST FOR PROPOSALS TO SELL THE PROPERTY LOCATED AT 3701 CATALINA DRIVE - Adoption of Resolution No. 2019-017 authorizing the release of a Request for Proposals for the sale of the property located at 3701 Catalina Drive, APN 167-154-20, commonly known as Old Fire Station No. 3. (Staff contact: Curtis Jackson, City Manager Department). February 12, 2019 Carlsbad City Council Regular Meeting Page 2 Real Estate Manager Curtis Jackson and Assistant City Manager Gary Barberio gave a brief overview of the staff report. Council Member Schumacher requested that the City Council consider adding a fourth Selection Criteria to the Request for Proposals (RFP) to read as follows: 4) Highest and best use of the Subject Property, as determined by City Council. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt Resolution No. 2019-017 as amended to include Council Member Schumacher's suggested language to the RFP. Motion carried unanimously, 5/0. ORDINANCES FOR INTRODUCTION: 2. AMEND TITLE 8 OF THE CMC BY REPEALING AND REPLACING CHAPTER 8.32 TO CREATE A SIDEWALK AND FOOD TRUCK VENDING EQUIPMENT PERMIT PROGRAM -Discuss and introduce, if desired, a draft ordinance in compliance with California Senate Bill 946, which would amend Title 8 of the Carlsbad Municipal Code by repealing and replacing Chapter 8.32 (Peddlers, Solicitors, Vendors and Canvassers) to create a sidewalk and food truck vending equipment permit program. (Staff contact: Marissa Kawecki, City Attorney Department). City Manager's Recommendation: Consider options and provide direction to staff. Deputy City Attorney Marissa Kawecki presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Christine Davis, representing the Carlsbad Village Association, requested that the City Council direct staff to work with the Association to gather input on the Ordinance. City Attorney Celia Brewer titled the Ordinance. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to introduce Ordinance No. CS-346 amending Title 8 of the Carlsbad Municipal Code by repealing and replacing Chapter 8.32 to create a Sidewalk and Food Truck Vending Equipment Permit Program. Motion carried unanimously, 5/0. ORDINANCE FOR ADOPTION: None. PUBLIC HEARINGS: None. DEPARTMENTAL AND CITY MANAGER REPORTS: Mayor Hall recused himself from participating in discussion of this item due to a potential conflict of interest -owning property in the subject area. He stepped down from the dais at 7:21 p.m. February 12, 2019 Carlsbad City Council Regular Meeting Page 3 Per the appellant's request, this item was continued from the Regular Meeting held Jan. 29, 2019. 3. APPEAL OF BUILDING PERMIT CB00-3222 EXPIRATION, 3275 ROOSEVELT STREET-Adoption of Resolution No. 2019-018 denying the appeal of the Building Official's decision to expire building permit CB00-3222 for the Join Hands Youth Facility located at 3275 Roosevelt Street. (Staff contact: Mike Peterson, Community & Economic Development) City Manager's Recommendation: Adopt the Resolution. Mayor Pro Tern Bhat-Patel announced that the appellant had requested another continuance for the item. She asked if any Council Member would like to make a motion to grant the continuance. Receiving no motion to grant the continuance, Mayor Pro Tern Bhat-Patel announced that the Council would consider the appeal at this time. Building and Code Enforcement Manager Mike Peterson and Community and Economic Development Director Debbie Fountain presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Appellant Frank Sorino presented materials to the City Council regarding his project (on file in the Office of the City Clerk) and requested that the City Council grant his appeal so that he can complete his project in a timely manner. The following speakers spoke in opposition to staff's recommendation: Jose DeAnda; Saul Carlos; Chris Schneider; Steve Chapin; Juan Velazquez; Kevin Edwards; David Fleming; Manuel Zepeda; Eriberto Grasida; Dominic Vidales; Thomas MacManus. The following speaker spoke in support of staff's recommendation: T.J. Childs. Motion by Council Member Blackburn, seconded by Council Member Schumacher, to adopt Resolution No. 2019-018. Motion carried, 4/0/1 (Hall -Absent). Mayor Hall returned to the dais at 8:29 p.m. COUNCIL REPORTS AND COMMENTS: Council Member Schumacher commented that she participated in discussion and formulating comments to provide to the League of California Cities staff office regarding Senate Bill 35. Mayor Pro Tern Bhat-Patel announced that she and Council Member Hamilton attended the Governmental Affairs meeting for the Chamber of Commerce. CITY MANAGER COMMENTS: None.
