HomeMy WebLinkAbout2019-02-26; City Council; MinutesCITY COUNCIL February 26, 2019, 6 p.m. CALL TO ORDER: 6:00 p.m. Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Hall announced the City Council would be serving as the City Council and Carlsbad Municipal Water District on Consent Calendar Item No. 2 and the Carlsbad Public Financing Authority for Departmental and City Manager Report Item No. 5. ROLL CALL: Hall, Blackburn, Bhat-Patel, Schumacher, Hamilton. INVOCATION: None. PLEDGE OF ALLEGIANCE: Mayor Pro Tern Bhat-Patel led the Pledge of Allegiance. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: No reportable action. APPROVAL OF MINUTES: None. PRESENTATION: None. PUBLIC COMMENT: Mary Lucid spoke regarding the flood at the Senior Center in December. Janice Jones advocated for change regarding single use plastics. Minute Motion by Council Member Schumacher, seconded by Mayor Pro Tern Bhat-Patel, to add single use plastics and Styrofoam to the legislation platform conversation at an upcoming meeting. Motion carried unanimously, 5/0. James Wang spoke in support of a single-use plastics ordinance. Julie Peebles Peterson spoke regarding the Police Explorer Program and thanked Officer Casey Burns for hand delivering an orientation packet to her daughter at school after she missed the registration deadline. Bob Nichols, President of Surfing Madonna Oceans Project, spoke about why single use plastics are detrimental to the planet. Brian Conner spoke regarding single use plastics. Motion carried unanimously, 5/0. 1. SETTLEMENT OF WORKERS' COMPENSATION CLAIMS OF MARC RENO -Adoption of Resolution No. 2019-021 authorizing settlement of the Workers' Compensation claims of Marc Reno. (Staff contact: Donna Hernandez, Human Resources). 2. AGREEMENTS WITH NORTHSTAR UTILITIES SOLUTIONS AND INVOICE CLOUD FOR UTILITY BILLING SYSTEM UPGRADE AND PAYMENT SERVICES-Adoption of Resolution No. 2019-022 approving an agreement to provide software license services and upgrading from existing N. Harris Utilities Solutions PUBS Application with Northstar Utilities Solutions 6.4 Application in an amount not to exceed $683,384; and, Adoption of Resolution No. 2019-023 approving an agreement with Invoice Cloud for implementation services and annual bill payment services in an amount not to exceed $400,000; and, Adoption of CMWD Resolution No. 1613 approving an agreement to provide software license services and upgrading from existing N. Harris Utilities Solutions PUBS Application with Northstar Utilities Solutions 6.4 Application in an amount not to exceed $683,384; and, Adoption of CMWD Resolution No. 1614 approving an agreement with Invoice Cloud for implementation services and annual bill payment services in an amount not to exceed $400,000. ENERGY CONSERVATION AND ELECTRIC VEHICLE CHARGING INFRASTRUCTURE ORDINANCES -Introduce Ordinance No. CS-347 amending Carlsbad Municipal Code Chapters 18.21 and 18.30 regarding requirements for energy efficiency measures and photovoltaic systems in new or existing residential and non-residential buildings, and water heating systems in new nonresidential buildings, Project No. MCA 17-0002 (PUB17Y-0013}; and, Introduce Ordinance No. CS-348 amending Carlsbad Municipal Code Chapter 18.30 regarding requirements for water heating systems in new residential buildings Project No. MCA 17-0002 (PUB17Y-0013); and, Introduce Ordinance No. CS-349 amending Carlsbad Municipal Code Chapter 18.21 regarding requirements for electric vehicle charging infrastructure for new and existing residential building sites and new nonresidential building sites, Project No. MCA 17-0002 (PUB17Y-0013). Senior Program Manager Mike Grim and Principal Planner David de Cordova reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Minute motion by Council Member Schumacher, seconded by Mayor Pro Tern Bhat-Patel, to update the Climate Action Plan once the inventory is received. Motion carried, 4/1 (Hall -No). City Attorney Celia Brewer titled the Ordinance. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to Introduce Ordinance No. CS-347. Motion carried unanimously, 5/0. CITYWIDE TRANSPORTATION DEMAND MANAGEMENT PLAN -Adopt Resolution No. 2019- 024 approving a Citywide Transportation Demand Management Plan and authoring issuance of a Request for Proposals for consultant services to implement the Transportation Demand Management Program; and, Introduce Ordinance No. CS-350 adding Chapter 18.51 (Transportation Demand Management) to Title 18 of the Carlsbad Municipal Code. (Staff contact: Jason Geldert and Christie Marcella, Community & Economic Development). City Manager's Recommendation: Adopt the Resolution and Introduce the Ordinance. Engineering Manager Jason Geldert and Economic Development Manager Christie Marcella reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Paige OeCino, representing the Carlsbad Sierra Club Team, stated that higher goals need to be set for the TOM Plan. Harold Standerfer, representing North County Advocates, spoke regarding the letter he sent to Council outlining shortcomings of the TOM Plan. Minute motion by Council Member Hamilton, seconded by Council Member Schumacher, to direct staff to task the consultants with expanding their RFP scope of work to include a broader scope to review schools, HOAs, community districts, as well as employees within Carlsbad. Motion carried unanimously, 5/0. Motion carried unanimously, 5/0. ORDINANCES FOR ADOPTION: None. PUBLIC HEARING: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 5. THE CROSSINGS AT CARLSBAD REPORT OF 2018 CALENDAR YEAR FINANCIAL PERFORMANCE -Receive a report on the 2018 calendar year financial performance of The Crossings at Carlsbad Municipal Golf Course. (Staff contact: Laura Rocha, Administrative Services and Chris Hazeltine, Parks & Recreation) City Manager's Recommendation: Receive the report. Parks & Recreation Director Chris Hazeltine, Administrative Services Director Laura Rocha, and Finance Manager Aaron Beanan reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Roxana Asian with Unite Here Local 11 spoke regarding the underperformance of The Crossings restaurant and merchandise revenue. John McNair, Vice President of JC Resorts, responded to the speaker and answered Council questions. Minute Motion by Council Member Schumacher, seconded by Council Member Hamilton, directing staff to return with a staff report at a future meeting authorizing an independent audit of The Crossings Golf Course. Motion carried unanimously, 5/0. ACTION: Council received the report. RECESS: Mayor Hall called for a recess at 8:50 p.m. Mayor Hall called the meeting to order at 8:55 p.m. 6. COMMUNITY CHOICE ENERGY TECHNICAL FEASIBILITY STUDY-Receive the draft North San Diego County Cities Community Choice Energy Technical Feasibility Study and provide feedback to staff and consultants; and, February 26, 2019 Carlsbad City Council Regular Meeting Page 5 Adopt Resolution No. 2019-025 authorizing the City Manager to negotiate, execute and fund a cost share agreement allowing for the City of Carlsbad's participation in an evaluation of potential Community Choice Energy program governance options in an amount not to exceed $35,000. (Staff contact: Jason Haber, City Manager Department) City Manager's Recommendation: Receive the report, provide direction to staff and adopt the Resolution. Assistant to the City Manager Jason Haber gave a brief background on the report and introduced Gary Saleba, of EES Consulting, Inc., who provided a PowerPoint presentation (on file in the Office of the City Clerk). Michael Hetz spoke regarding the dangerous levels of climate change. Lane Sharman, co-founder of the San Diego Energy District Foundation, spoke regarding years of climate inaction. Matthew Vasi/akis, from Climate Action Campaign, thanked the City of Carlsbad for facing today's climate issues by supporting the item. Gerrie Ingram spoke about "Stay Cool for Grandkids" which educates grandparents about global warming. Linda Daniels, President of American Association of University of Women, spoke about school districts being hurt by SDG&E. Kathy Parker, representing the Sierra Club, spoke about 100% Clean Renewable Energy in the City of Carlsbad. John Bottorff, with CleanforKids.org, spoke in support of 'No Idling' legislation. Maye/a Manasjan spoke in favor of Community Choice Energy. Amanda Macia, Secretary of Sierra Club San Diego, advocated for strong values in the JPA, including paying prevailing wage to construction workers. Suzanne Hume, Educational Director for CleanEarth4Kids.org, expressed her support of the extension of the EES contract, 100% clean energy, CCE, and the motion on single-use plastics. Council Member Schumacher made the following minute motion: To adopt a Resolution of Intent to pursue Community Choice Aggregation to provide electric commodity service to the citizens of Carlsbad-to the citizens and businesses of Carlsbad with the intent to pay prevailing wage. As we're thinking about governance and moving forward and sculpting potentially an agreement we need to make sure that we're including prevailing wage for our construction workers. Local hire which means PLA's, Community Benefit Agreements and ensure neutrality in the event workers wish to unionize. City Attorney Brewer stated that although a Resolution of Intent is not before the Council, that staff could bring one back at a future Council meeting. Mayor Hall suggested that the City be diligent in how it moves forward with this and stated that there is no reason to rush at this moment in time. Mayor Hall called for the question. The motion passed 4/1 (Hall -No) Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, directing staff to participate in the public workshop on the draft study in coordination with partner cities to solicit community feedback. Motion carried unanimously, 5/0. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt Resolution No. 2019-025. Motion carried unanimously, 5/0. PUBLIC COMMENT CONTINUED: Andrew Schorr requested a study for a yellow flashing crosswalk where the Coastal Rail Trail crosses Tamarack. COUNCIL REPORTS AND COMMENTS: None. CITY MANAGER COMMENTS: City Manager Scott Chadwick reminded everyone about the Budget Public Workshop scheduled for Monday, March 4, 2019 from 6 to 8 p.m. at the Faraday Center, including using a digital tool displaying results in real time.
