CLOSED SESSION: City Attorney Celia Brewer read the Council into Closed Session. Council adjourned into Closed Session at 4:00 p.m. pursuant to the following: 1. CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION To authorize a closed session to discuss existing litigation in the following matter of: City of Carlsbad v. County of San Diego, Case No. 37-2018-00061565-CU-MC-CTL, pursuant to Government Code Section 54956.9(d)(l). Council Action: Outside counsel, Peter Kirsch of Kaplan Kirsch Rockwell, gave a report on the Closed Session. The City Council met from 4:00 p.m. to 7:30 p.m. to discuss a proposed mutual cooperation and settlement agreement with the County of San Diego with regard to Palomar Airport issues. Council voted 4/1 (Schumacher -No) to approve the settlement agreement. The settlement agreement is designed to change the relationship between the County and the City regarding Palomar Airport issues. It establishes a permanent mechanism for dialogue between the City Council and the Board of Supervisors, and between the staff of the City and the staff of the County, so that the current dispute that exists in regard to the Airport Master Plan is not something that is repeated in the future. The settlement agreement establishes a permanent process for quarterly meetings between City staff and County staff to make sure City staff is well informed and therefore keeps Council well informed of activities at the airport. The County is agreeing to a process whereas it will keep the City informed and seek City comment, reaction and feedback on any major development plans at the airport. The County is committing that it will give the City 30 days to comment on any significant plans, and will consider City feedback. To the extent the County is not willing or able to accept City feedback, that it will formally tell the City what the basis is for rejection of the City requests. The agreement commits the County to all mitigation set forth in the Mitigation Monitoring Program in the final EIR, and in addition to those required by law, the County commits to implement all of the mitigation measures that are set forth in responses to comments in the final EIR, which incorporates a number of the most important issues to the City. Minute Motion by Council Member Schumacher, seconded by Mayor Pro Tern Bhat-Patel, to bring to an open session of the Council a conversation specific to the Palomar Airport Master Plan for clarity, specific to a couple of different areas, so that our community members can have a conversation with Council.
