APPROVAL OF MINUTES: Minutes of the Special Meeting held May 7, 2019. Minutes of the Regular Meeting held May 7, 2019. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to approve the minutes as presented. Motion carried 4/0/1 (Hamilton -Absent). PRESENTATIONS: Proclamation in recognition of Public Works Week. Council Member Schumacher presented a proclamation to Public Works Deputy City Manager Paz Gomez in recognition of Public Works Week. Proclamation in recognition of National Gun Violence Awareness Day. Mayor Pro Tern Bhat-Patel presented a proclamation to Nikki Faddik of Moms Demand Action for Gun Sense in America. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: Assistant City Attorney Walter Chung announced that there was no reportable action from Closed Session. PUBLIC COMMENT: Eddie Myers stated he was disappointed in the outcome of the discussion relating to the Expressive Activities Ordinance at the previous City Council meeting. City Clerk Barbara Engleson read written comments from City Council Member Barbara Hamilton relating to Agenda Item No. 9 (Comments on file in the Office of the City Clerk attached to Agenda Item No. 9). May 21, 2019 Carlsbad City Council Regular Meeting Page 2 CONSENT CALENDAR: Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to approve Consent Calendar Item Nos. 1 through 5. Motion carried, 4/0/1 (Hamilton -Absent). 1. REPORT ON CITY INVESTMENTS AS OF MARCH 31, 2019 -Acceptance of report on City Investments as of March 31, 2019. (Staff contact: Craig Lindholm, City Treasurer and Laura Rocha, Administrative Services) 2. AUTHORIZE EXTENSION TO AGREEMENT WITH ADMINSURE, INC. -Adoption of Resolution No. 2019-067 authorizing the City Manager to execute the first extension term and granting the City Manager the authority to execute future extensions of the agreement with AdminSure, Inc. for third party administration of workers' compensation claims. APPROVAL OF MEMORANDUM OF UNDERSTANDING AND CONTRACT FOR INNOVATE 78 ECONOMIC DEVELOPMENT INITIATIVE -Adoption of Resolution No. 2019-068 approving a Memorandum of Understanding among the cities of Carlsbad, Escondido, Oceanside, San Marcos and Vista for the purposes of continuing to implement the Innovate 78 Economic Development Initiative and approving an agreement with the San Diego Regional Economic Development Corporation in an amount not to exceed $190,000 per agreement year. APPROVAL OF FIRST AMENDMENT TO GROUND LEASE -VILLA LOMA APARTMENTS - Adoption of Resolution No. 2019-069 approving the first amendment to Ground Lease between the City of Carlsbad and Tobria Terrace LLC for City property located at 6421 Tobria Terrace and commonly known as Villa Loma Apartments, and authorizing the City Manager to execute the first amendment to the Ground Lease and the Ground Lessor's Estoppel Certificate and other related documents to extend the lease term for said property. ADVERTISE FOR BIDS FOR CITY HALL EXTERIOR SAFETY AND ACCESSIBILITY IMPROVEMENTS Adoption of Resolution No. 2019-070 approving the plans and specifications and authorizing the City Clerk to advertise for bids for the City Hall Exterior Refurbishment and Northwest Quadrant Storm Drain Improvement Program, Capital Improvement Program (CIP) Project Nos. 4725 and 6608. SHARED MOBILITY DEVICES ORDINANCE NO. CS-354 -Adoption of Ordinance No. CS-354 amending Carlsbad Municipal Code Title 10, Vehicles and Traffic, by adding Chapter 10.60 Shared Mobility Devices to establish regulations that prohibit shared mobility devices from being abandoned in the public right-of-way or other public areas, from being placed for rent in those areas, and from presenting a public nuisance. (Staff contact: Sheila Cobian, City Clerk Services) City Manager's Recommendation: Adopt Ordinance No. CS-354. Assistant City Attorney Walter Chung titled the Ordinance. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt Ordinance No. CS-354. Motion carried, 4/0/1 (Hamilton -Absent). PUBLIC HEARING: 7. ROOSEVELT TOWNHOMES -Adoption of Resolution No. 2019-071 approving a Tentative Tract Map and Site Development Plan to construct a five-unit, residential air-space condominium project on a 0.22 acre site located at 2569 Roosevelt Street in the Village General (VG) District of the Village and Barrio Master Plan and within Local Facilities Management Zone 1. Case Name: Roosevelt Townhomes. Case No.: CT 2017-0006/SDP 2018-0013 (DEV2017-0213) (Staff contact: Chris Garcia, Community & Economic Development) City Manager's Recommendation: Take public input, close the public hearing, and adopt the Resolution. Associate Planner Chris Garcia presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 4:29 p.m. Seeing no one wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 4:29 p.m. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt Resolution No. 2019-071. Motion carried, 4/0/1 (Hamilton -Absent). DEPARTMENTAL AND CITY MANAGER REPORTS: 8. SB 1205 COMPLIANCE REPORT FOR STATE-MANDATED ANNUAL FIRE INSPECTIONS - Adoption of Resolution No. 2019-072 accepting a report on the status of all state-mandated annual fire inspections in the City of Carlsbad in conjunction with SB1205 and the California Health and Safety Code Section 13146.4. (Staff contact: Randy Metz, Fire Department) City Manager's Recommendation: Adopt the Resolution. Fire Marshal Randy Metz provided a brief overview of the staff report. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt Resolution No. 2019-072. Motion carried, 4/0/1 (Hamilton -Absent). PRESENTATION OF THE FISCAL YEAR 2019-20 PRELIMINARY OPERATING BUDGET AND CAPITAL IMPROVEMENT PROGRAM -Accept the report and set the Public Hearing date of June 18, 2019 for adoption of the Fiscal Year 2019-20 Operating Budget and Capital Improvement Program Budget and adoption of the changes to the Master Fee Schedule. (Staff contact: Roxanne Muhlmeister, Administrative Services) City Manager's Recommendation: Accept the report and set the Public Hearing for June 18, 2019. City Manager Scott Chadwick explained how the budget would be presented and that any questions asked of staff at this meeting or following the meeting would be responded to via a memorandum that would be provided to the City Council and made part of the budget adoption staff report scheduled for consideration on June 18, 2019. He then introduced Administrative Services Deputy City Manager Laura Rocha and Budget Manager Roxanne Muhlmeister to provide the PowerPoint Presentation (on file in the Office of the City Clerk). Communications Manager Kristina Ray explained the public engagement efforts that took place relating to preparation of the Fiscal Year 2019-2020 Budget. Police Chief Neill Gallucci, Fire Chief Michael Calderwood, Public Works Deputy City Manager Paz Gomez, Community Services Deputy City Manager Gary Barberio and Chief Operations Officer Elaine Lukey gave an overview of each of their respective departments' budget requests. John Gamma requested that the City Council re-evaluate the budget and that the City purchase land in the Ponto area to construct a park. Sean Kirkland also spoke in support of the construction of a park near the Ponto area. Chas Wick, speaking on behalf of People for Ponto, requested that the City Council consider purchasing property in the Ponto area for construction of a park. Brian Connor spoke in favor of additional resources being allocated to code enforcement efforts. Don Christiansen also encouraged the City Council to purchase property in the Ponto area for a park. Betty Prentice spoke in support of a park in the Ponto area. The City Council received the report and set the Public Hearing for June 18, 2019. APPROVAL OF FINANCIAL MANAGEMENT POLICIES FOR PENSION FUNDING AND GENERAL FUND SURPLUS-Adoption of a Resolution approving a City Council Policy No. 86 to establish a Pension Funding Policy, approving City Council Policy No. 87 to establish a General Fund Surplus Policy, and revising City Council Policy No. 74, General Fund Reserve Policy. (Staff contact: Laura Rocha, Administrative Services) City Manager's Recommendation: Adopt the Resolution. City Manager Scott Chadwick requested that Item No. 9 be continued to the meeting of June 18, 2019 to allow all Council Members the opportunity to participate in discussion of the item. Motion by Council Member Schumacher, seconded by Mayor Hall, to continue the item to the June 18, 2019 City Council meeting. Motion carried, 4/0/1 (Hamilton -Absent). COUNCIL REPORTS AND COMMENTS: Mayor Hall and Council Members reported on activities and meetings of some committees and sub-committees of which they are members. CITY MANAGER COMMENTS: None.
