ANNOUNCEMENT OF CONCURRENT MEETINGS: City Council is serving as the Carlsbad Municipal
Water District Board of Directors for Item No. 4.
PLEDGE OF ALLEGIANCE: Mayor Pro Tern Bhat-Patel led the Pledge of Allegiance.
INVOCATION: None.
APPROVAL OF MINUTES:
Minutes of the Special Meeting held July 16, 2019.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to approve the
minutes as presented. Motion carried unanimously, 5/0.
PRESENTATIONS: None.
PUBLIC COMMENT:
Mark Packard stated that he hopes that the Council thinks about proper solutions and makes
good choices to the issues presented.
Glenn Bernard spoke regarding the Mexican American community and various social issues.
Jonathan Simek spoke regarding skate park crowding issues. He proposed having live stream
cameras that showed current traffic at the skateparks.
Stacy King stated that she would like the City Council to put a limit to the amount of time a
planning application can be outstanding without forward movement from a developer. She also
asked that the Council reconcile the Coastal Commission Local Coastal Program Plan guidelines
for Zone 9 with the City's General Plan No. 2.

1. APPROVAL OF GIS ASSOCIATE SYSTEMS ADMINISTRATOR JOB CLASSIFICATION -Adoption of
Resolution No. 2019-126 approving the GIS Associate Systems Administrator job classification
under the Carlsbad City Employees' Association (CCEA) and revising the CCEA Salary Schedule
to include the new job classification. (Staff contact: Silvano Rodriguez, Administrative
Services)
2. ACCEPTANCE OF DONATION FROM THE CARLSBAD LIBRARY & ARTS FOUNDATION -Adoption
of Resolution No. 2019-127 accepting a donation of $14,120 from the Carlsbad Library & Arts
Foundation to the City of Carlsbad Library & Cultural Arts Department. (Staff contact:
Heather Pizzuto, Library & Cultural Arts)
3. AWARD OF CONTRACT TO JUST CONSTRUCTION, INC. -Adoption of Resolution No. 2019-128
accepting bids and awarding a contract to Just Construction, Inc. for construction of the
Palomar Airport Road Widening Project at the intersection with Paseo Del Norte, Capital
Improvement Program (CIP) Project Nos. 6043 and 6044 in an amount not to exceed
$741,463.10. (Staff contact: Daniel Zimney, Public Works)
4. APPROVAL OF REIMBURSEMENT AGREEMENT WITH LENNAR HOMES OF CALIFORNIA, INC. -
Adoption of Carlsbad Municipal Water District Resolution No. 1618 approving authorizing
execution of a reimbursement agreement with Lennar Homes of California, Inc. for a pressure
reducing station adjacent to Poinsettia Lane between Cassia Road and Skimmer Court,
Carlsbad Tract No. CT 14-10 (Poinsettia 61), Capital Improvement Program (CIP) Project No.

5. CITY COUNCIL BOARD, COMMISSION AND COMMITTEE MEMBER APPLICATION, INTERVIEW
AND APPOINTMENT PROCESS-Adoption of Resolution No. 2019-129 approving City Council
Policy No. 88 -City Council Board, Commission and Committee Member Application,
Interview and Appointment Process. (Staff contact: Sheila Cobian, City Clerk Services)

DEPARTMENTAL AND CITY MANAGER REPORTS:
Mayor Hall announced that Item Nos. 8 and 9 would be moved ahead of Item No. 6.
8. SANDAG PRESENTATION -SAN DIEGO FORWARD: THE 2021 REGIONAL PLAN -Receive a
presentation from SANDAG Executive Director, Hasan lkhrata, on San Diego Forward: The
2021 Regional Plan. (Staff contact: Jason Haber, City Manager Department)

Assistant to the City Manager Jason Haber introduced SAN DAG representatives Hasan lkhrata,
Coleen Clementson and Ray Major who presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
Bret Schanzenbach spoke about the time constraint challenges of using public transportation.
He also stated that the Chamber of Commerce is interested in finding solutions to public
transportation issues.
Mary Oren spoke in support of Council Member Schumacher and her efforts to find a solution
to transportation concerns. She also stated her support for the NCTD Coaster.
Ryan Vaughn, a representative of the Sur/rider Foundation, spoke in support of the SAN DAG
presentation.
Pierre Weinault stated that SANDAG has not invested enough in public transportation and does
not have an equal balance with freeway expansions. He also expressed his concerns with public
transportation and greenhouse gas emissions.
Philip Urbina stated that transportation funds should be spent in a balanced fashion. He stated
that money should not be diverted from other projects and put into mass transit.
ACTION: City Council received the Presentation.
9. PRESENTATION REGARDING INTERSTATE 5 NORTH COAST CORRIDOR PROGRAM PHASE 1-
Receive a presentation from Caltrans and SANDAG representatives regarding the Interstate
5 (1-5) North Coast Corridor Program Phase 1 (Build NCC). (Staff contact: Hossein Ajideh,
Public Works)
City Manager's Recommendation: Receive the presentation.
Transportation Director Sean Haeri and Caltrans representative Allen Kosup presented the
report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
ACTION: City Council received the Presentation.
PUBLIC HEARINGS:
6. WEED ABATEMENT PUBLIC HEARING -Adoption of Resolution No. 2019-130 approving the
cost assessments for weed abatement and directing the City Clerk to file a certified copy of
the resolution with the San Diego County Assessor. (Staff contact: Randy Metz, Fire)
City Manager's Recommendation: Take public input, close the Public Hearing and adopt the
Resolution.

Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt
Resolution No. 2019-130. Motion carried unanimously, 5/0.
CONTINUATION OF DEPARTMENTAL AND CITY MANAGER REPORTS:
7. ESTABLISH FISCAL YEAR 2019-20 SPECIAL TAX FOR COMMUNITY FACILITIES DISTRICT NO. 1-
Adoption of Resolution No. 2019-131 establishing the Fiscal Year 2019-20 Special Taxes for
Community Facilities District No. 1. (Staff contact: Kevin Branca, Administrative Services)
City Manager's Recommendation: Adopt the Resolution.
Finance Director Kevin Branca, Finance Manager Roxanne Muhlmeister and Barbara Carter
from Special District Financing and Administration presented the report and reviewed a
PowerPoint presentation (on file in the Office of the City Clerk).
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt
Resolution No. 2019-131. Motion carried unanimously, 5/0.
10. STAGECOACH COMMUNITY PARK SYNTHETIC TURF REPLACEMENT PROJECT -Adopt
Resolution No. 2019-132 approving the contract documents, plans and specifications for the
Stagecoach Community Park Synthetic Turf Replacement Project (CIP Project No. 47421), and
authorizing the City Clerk to advertise project for public bids. (Staff contact: Kyle Lancaster,
Parks & Recreation)
City Manager's Recommendation: Adopt the Resolution.
Interim Parks & Recreation Director Kyle Lancaster presented the report and reviewed a
PowerPoint presentation (on file in the Office of the City Clerk).
Diane Nygaard spoke about the potential health hazards that can come from synthetic turf and
recommended that the Council table the item until further studies can be conducted.
Council Member Hamilton stated her support for using natural grass for the community parks
because of the potential health hazards of synthetic turf.
Motion by Council Member Schumacher, seconded by Council Member Blackburn, to adopt
Resolution No. 2019-132. Motion carried, 4/1 (Hamilton -No)

11. FORMATION OF AN AD-HOC SUBCOMMITTEE FOR CARLSBAD MUNICIPAL CODE AND CITY
COUNCIL POLICY UPDATE -Adopt Resolution No. 2019-133 authorizing the formation of an
Ad-Hoc City Council Carlsbad Municipal Code and City Council Policy Update Subcommittee.

City Manager's Recommendation: Adopt the Resolution.

12. FORMATION OF AN AD-HOC SUBCOMMITTEE ON SOBER LIVING HOMES-Adopt Resolution
No. 2019-134 authorizing the formation of an Ad-Hoc City Council Subcommittee on Sober
Living Homes. (Staff contact: Jason Haber, City Manager Department)
City Manager's Recommendation: Adopt the Resolution.

John Kiehl spoke on the benefits and misconceptions of sober living homes.
Motion by Council Member Blackburn, seconded by Mayor Pro Tern Bhat-Patel, to adopt
Resolution No. 2019-134 appointing Council Member Blackburn and Council Member
Hamilton to the subcommittee. Motion carried unanimously, 5/0.
13. FORMATION OF AN AD-HOC CITY COUNCIL EXPRESSIVE ACTIVITIES ORDINANCE
SUBCOMMITTEE -Adopt Resolution No. 2019-135 authorizing the formation of an Ad-Hoc
City Council Expressive Activities Ordinance Subcommittee. (Staff contact: Jason Haber, City
Manager Department)
City Manager's Recommendation: Adopt the Resolution.

Yusef Miller expressed support for the Ad-Hoc subcommittee.
Motion by Council Member Blackburn, seconded by Council Member Schumacher, to adopt
Resolution No. 2019-135 appointing Council Member Blackburn and Council Member

14. FORMATION OF AD-HOC CITY COUNCIL NORTH COUNTY HOMELESS ACTION PLAN
SUBCOMMITTEE -Adopt Resolution No. 2019-136 authorizing the formation of an Ad-Hoc
City Council North County Homeless Action Plan Subcommittee. (Staff contact: Jason Haber,
City Manager Department)
City Manager's Recommendation: Adopt the Resolution.
Assistant to the City Manager Jason Haber presented the report.
Chris Megison representing a group (Diane Rivera; Richard Hostetter; and Janell Cannon)
encouraged the Council to utilize previous models used to find solutions to homelessness such
as the Housing First Vision Plan. He also thanked the Council for pioneering the effort to solve
the homelessness issue.
Motion by Council Member Schumacher, seconded by Council Member Blackburn, to adopt
Resolution No. 2019-136 appointing Mayor Hall and Council Member Schumacher to the
subcommittee. Motion carried, 4/1. (Hamilton -No)
15. FORMATION OF A STANDING CITY COUNCIL LEGISLATIVE SUBCOMMITTEE-Adopt Resolution
No. 2019-137 authorizing the formation of a standing City Council Legislative Subcommittee.

City Manager's Recommendation: Adopt the Resolution.

Motion by Council Member Schumacher, seconded by Council Member Blackburn, to adopt
Resolution No. 2019-137 appointing Mayor Hall and Mayor Pro Tern Bhat-Patel to the
subcommittee. Motion carried unanimously, 5/0.

and subcommittees of which they are members.

CITY ATTORNEY COMMENTS: City Attorney Celia Brewer introduced the new Assistant City
Attorney, Cindie McMahon.
