Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 PLEDGE OF ALLEGIANCE: Mayor Pro Tern Bhat-Patel led the Pledge of Allegiance. INVOCATION: None. APPROVAL OF MINUTES: Minutes of the Special Meeting held Sept. 10, 2019. Minutes of the Special Meeting held Sept. 12, 2019. Motion by Mayor Pro-Tern Bhat-Patel, seconded by Council Member Blackburn, to approve the minutes as presented. Motion carried, 4/0/1 {Hamilton -Absent). PRESENTATIONS: Presentation of proclamation in recognition of the retirement of Community and Economic Director Debbie Fountain. Council Member Blackburn read and presented the proclamation. Mayor Hall and Council Member Blackburn spoke about Ms. Fountain's career in public service and commitment to Affordable Housing. PUBLIC COMMENT: Glenn Bernard shared quotes in response to a news segment he heard regarding a comment Senator Bernie Sanders made about wealth. Cody Arguelles spoke about his struggles with finding affordable housing for purchase in Carlsbad. Mary Lucid spoke regarding her concern with the Senior Center. Kerry Siekmann spoke about her concerns with the Community Choice Energy program and requested Council consider responding to this issue at the state level. Tom Hersant, President of Carlsbad Sister City Ambassadors, representing a group: (Holly Guo; Charissa Feldmann; Polly Yu; Nicholas Richardson Loughrin), spoke about a trip to Japan in June 2019 that local high school students participated in. Lucile Lynch and James Walker, representing Beacons North County, explained their community partnership program and provided a handout (on file in the Office of the City Clerk) to City Council. Mr. Walker spoke about his experience participating in the program. CONSENT CALENDAR: Mayor Hall announced that Item No. 4 was returned to staff. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to approve Consent Calendar Item Nos. 1 through 3, 5 and 6. Motion carried, 4/0/1 (Hamilton -Absent). 1. COMMUNITY FACILITIES DISTRICT NO. 1 ANNEXATION -POINSETTIA 61 -Adoption of Resolution No. 2019-186 certifying the results of an election and adding property to Community Facilities District No. 1. (Staff contact: Kevin Branca, Administrative Services) 2. COMMUNITY FACILITIES DISTRICT NO. 1 ANNEXATION -SUMMIT SENIOR CARLSBAD - Adoption of Resolution No. 2019-187 certifying the results of an election and adding property to Community Facilities District No. 1. SETTLEMENT OF WORKERS' COMPENSATION CLAIMS OF GREGORY RYAN -Adoption of Resolution No. 2019-188 authorizing settlement of the workers' compensation claims of Gregory Ryan in the amount of $350,000.00. ADVERTISE FOR BIDS FOR THE TRAFFIC SIGNALS AT POINSETTIA LANE AND CASSIA ROAD AND POINSETTIA LANE AND ORIOLE COURT/SKIMMER COURT -Adoption of a Resolution approving the plans and specifications and authorizing the City Clerk to advertise for bids for the traffic signal at Poinsettia Lane and Cassia Road and the traffic signal at Poinsettia Lane and Oriole Court/Skimmer Court, Capital Improvement Program (CIP) Project Nos. 6329 and 6330. (Staff contact: Jonathan Schauble, Public Works) 5. ADVERTISE FOR BIDS FOR THE FISCAL YEAR 2019-20 BRIDGE PREVENTIVE MAINTENANCE - Adoption of Resolution No. 2019-189 approving the plans and specifications and authorizing the City Clerk to advertise for bids for the Fiscal Year (FY) 2019-20 Bridge Preventive Maintenance, Capital Improvement Program (CIP) Project No. 6066-19. (Staff contact: Emad Elias, Public Works) 6. RE-CERTIFY SEWER SYSTEM MANAGEMENT PLAN (SSMP)-Adoption of Resolution No. 2019- 190 authorizing the Legally Responsible Official (LRO) to re-certify the Sewer System Management Plan (SSMP) and submit to the State Water Resources Control Board (SWRCB). AMENDMENT TO THE CARLSBAD MUNICIPAL CODE TO AUTHORIZE ENFORCEMENT OF DESIGNATED ELECTRIC VEHICLE CHARGING STATIONS IN PUBLIC PARKING AREAS-Adoption of Ordinance No. CS-360 amending Title 10, Chapter 10.40 of the Carlsbad Municipal Code by adding Section 10.40.190 to authorize enforcement of designated electric vehicle charging stations located in public parking areas. (Staff contact: Sheila Cobian, City Clerk Services) City Manager's Recommendation: Adopt Ordinance No. CS-360. City Attorney Celia Brewer titled the Ordinance. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt Ordinance No. CS-360. Motion carried 4/0/1 (Hamilton -Absent). PUBLIC HEARINGS: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 8. COMMUNITY FOREST MANAGEMENT PLAN UPDATE -Adoption of Resolution No. 2019-191 approving an update to the Carlsbad Community Forest Management Plan and appropriating a total of $345,000 of ongoing funds to the Parks Maintenance operating budget for implementation of the Plan's goals, strategies and recommendation. (Staff Contact: Kyle Lancaster, Parks & Recreation) City Manager's Recommendation: Adopt the Resolution. Parks Superintendent Tim Selke and Parks & Recreation Director Kyle Lancaster presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Glenn Bernard, spoke about regulations regarding trees and the distance to the street. He also provided a Saving the Streets Union Tribune news article handout (on file in the Office of the City Clerk) to Council. Dianne Nygaard, representing North County Advocates, spoke in support of the plan with the addition of including the enhancement of the urban tree canopy, addressing tree requirements in relation to new development, and providing a guideline for tree placement. Howard Krausz, representing North County Advocates, spoke in support of the plan with the request that the goal and strategy of point 2.A. ·be changed from "or" to "and." Mark Wishiewski spoke in support of the plan and shared about the history of the trees at the city's current Parks and Recreation building. Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt Resolution No. 2019-191. Motion carried, 4/0/1 (Hamilton -Absent). UPDATE ON CARLSBAD BOULEVARD, COLLEGE BOULEVARD AND TAMARACK AVENUE TRAFFIC CALMING ENHANCEMENTS -Receive an informational presentation regarding requested traffic calming measures on three corridors of interest: Carlsbad Boulevard, College Boulevard and Tamarack Avenue. (Staff Contact: John Kim, Public Works) City Manager's Recommendation: Receive the presentation. Deputy City Manager Paz Gomez and Senior Engineer John Kim presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Mayor Hall, Senior Engineer John Kim explained the capabilities of speed feedback signage. He confirmed that the data received from the signage is relayed to the Police Department so they can focus their enforcement in certain areas. In response to an inquiry from Council Member Schumacher, City Manager Scott Chadwick explained if Council gave direction, staff can review other potential options available, and if a modification or exception to the mobility element is required, they can bring it back for Council's consideration. In response to an inquiry from Mayor Hall, Police Chief Neil Gallucci explained the data and enforcement efforts by the Police Department to address traffic and safety concerns in the area along College Boulevard and Canon Road. Minute Motion by Council Member Schumacher, seconded by Council Member Blackburn, to direct staff to bring back to Council options and analysis, including any unintended consequences, on physical changes to the College Boulevard Segment, from Carlsbad Village Drive to Cannon Road. Motion carried, 4/0/1 (Hamilton -Absent). 10. APPOINT TWO MEMBERS TO THE SENIOR COMMISSION -Adoption of Resolution Nos. 2019- 192 and 2019-193 appointing two members to the Senior Commission. (Staff Contact: Tammy McMinn, City Clerk Services) City Manager's Recommendation: Adopt the Resolutions. Applicant Kathryn Rangus spoke about her experience, involvement in the community, and interest in the position. Applicant Robin Ferencz Kotfica spoke about her experience, involvement in the community, and interest in the position. Motion by Mayor Hall, seconded by Council Member Blackburn, to adopt Resolution No. 2019-192 appointing Kathryn Rangus to the Senior Commission. Motion carried, 4/0/1 (Hamilton -Absent).
