Minutes of the Regular Meeting held on Sept. 17, 2019
Council Member Hamilton asked to have the Minutes of the Regular Meeting held on Sept. 17,
2019 returned to staff to add a verbatim transcript of her comments under Council Commentary.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to approve the
Minutes of the Regular Meeting held on Sept. 10, 2019 as presented. Motion carried
unanimously, 5/0.
PRESENTATIONS:
Presentation of proclamation in recognition of Public Safety Month.
Council Member Blackburn read and presented the proclamation to members of the Carlsbad
Police Department and the Carlsbad Police Explorer Program.
PUBLIC COMMENT:
Larry Posner spoke regarding a video of a Carlsbad Police incident. He also thanked the Carlsbad
Fire Department and Police Department for their service.
Arnie Cohen spoke regarding the City Council staff report presentation process. He requested that
members of the public be given an opportunity to comment following City Council questions to
staff.
Hope Nelson spoke regarding the County of San Diego purchase of property at the Carlsbad
Airport. She requested answers to various questions she asked regarding the purchase.
Meghan Malony spoke in support of functional medicine.

Richard Van Every spoke about the dangers of 4G/5G cell phone antennas.
Karen Rich spoke regarding the dangers of wireless radiation.

1. APPROVAL OF A MEMORANDUM OF UNDERSTANDING FOR A WARD'S WEED ERADICATION
PROGRAM AND AN AGREEMENT WITH ACS HABITAT MANAGEMENT FOR IMPLEMENTATION
OF THE PROGRAM Adopt Resolution No. 2019-194 approving the Memorandum of
Understanding for a Ward's Weed Eradication Program between the City of Carlsbad, Nature
Collective, County of San Diego, and Center for Natural Lands Management and taking related
actions to implement the program. (Staff contact: Rosanne Humphrey, Public Works)
2. AGREEMENT WITH PROS CONSULTING FOR PARKS & RECREATION DEPARTMENT MASTER
AND STRATEGIC PLANNING SERVICES -Adopt Resolution No. 2019-195 awarding a
professional services agreement to PROS Consulting for Parks & Recreation Master and
Strategic Planning Services, in an amount not to exceed $199,000; and, approving a carry-
over of $250,000 from the Fiscal Year 2018-19 General Fund Budget Surplus to the Fiscal Year
2019-20 Parks & Recreation Administration Operating Budget. (Staff Contact: Mick Calarco,

3. AWARD OF CONTRACT FOR THE CROSSINGS GOLF COURSE LAKE LINER REFURBISHMENT
PROJECT -Adopt Public Financing Authority Resolution No. 80 awarding a construction
contract to Canyon Springs Enterprises for the Crossings at Carlsbad Municipal Golf Course
Lake Refurbishment Project (Contract No. PWS 19-807 PKS) in an amount not to exceed
$625,000 and appropriating $835,500 to the Golf Course Lake Refurbishment Project, CIP
Project No. 4084, and $94,500 to the Golf Course Operation Budget from the Golf Course

Mary Anne Viney asked for staff to answer her questions regarding the weed eradication
program. She asked how will the program protect public health, how will it prevent runoff,
and will it harm any of the wildlife in the area.
Jason Giesson spoke in support of the weed eradication program. He spoke about the dangers
of Ward's Weeds including increased fire risk and decay of native habitats.
Carolyn Martus spoke in support of the weed eradication program.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to approve
Consent Calendar Item No. 1. Motion carried unanimously, 5/0.
ORDINANCES FOR INTRODUCTION:
4. AMENDMENTTO THE CARLSBAD MUNICIPAL CODE TO UPDATE STAFF ROLES FOR REVIEWING
AND APPROVING PLANS AND SPECIFICATIONS FOR TRAFFIC CONTROL DEVICES AND
CONSTRUCTION PROJECTS -Introduction of Ordinance No. CS-361 amending Carlsbad
Municipal Code Chapter 3.28, and Sections 5.29.040 and 10.08.060 regarding review and
approval of plans and specifications for traffic control devices and construction projects; and,
Adopt Resolution No. 2019-196 delegating authority to additional positions to review and
approve plans and specifications for traffic control devices and construction projects. (Staff

Deputy City Manager, Public Works Paz Gomez, City Traffic Engineer John Kim, and Deputy
City Attorney Amanda Guy presented the report and reviewed a PowerPoint presentation (on
file in the Office of the City Clerk}.
City Attorney Celia Brewer titled the ordinance.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to introduce
Ordinance No. CS-361 and adopt Resolution No. 2019-196. Motion carried unanimously, 5/0.
5. RESOLUTION TO ESTABLISH THE CLEAN ENERGY ALLIANCE THROUGH A JOINT EXERCISE OF
POWERS AGREEMENT AND INTRODUCTION OF AN ORDINANCE TO IMPLEMENT A
COMMUNITY CHOICE AGGREGATION PROGRAM -Adopt Resolution No. 2019-197 approving
and authorizing the execution of the Joint Exercise of Powers Agreement creating the Clean
Energy Alliance, a Community Choice Aggregation Joint Powers Authority; and,
Introduction of Ordinance No. CS-362 authorizing the implementation of a Community Choice
Aggregation Program; and,
Appoint two City Council Members to the Clean Energy Alliance Board of Directors
(primary/alternate}, representing the City of Carlsbad, in accordance with Section 4.1 of the
Clean Energy Alliance Joint Powers Agreement. (Staff contact: Jason Haber, City Manager

Assistant City Manager Jason Haber presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
Ellie Haviland spoke in support of the JPA.
Gretchen Newsom spoke about labor concerns regarding the JPA committee.
Arnie Cohen spoke regarding solar uses and SDGE's Electric Vehicle Tier Program.
Paige DeCino spoke in support of the JPA program.
Natalie Landes representing a group {Carlsbad High School Green Club), spoke in support of
the JPA committee and the positive effects of community choice energy.
Kerry Siekmann spoke regarding the need for more clean energy.
Lane Sharman spoke about the need for a business plan for the JPA committee.
City Attorney Celia Brewer titled the ordinance.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to introduce
Ordinance No. CS-362. Motion carried unanimously, 5/0.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt
Resolution No. 2019-197. Motion carried unanimously, 5/0.
Mayor Hall suggested that he be appointed as the primary and Council Member Schumacher
as the alternate.
Council Member Schumacher suggested that she be made the primary instead.
Mayor Pro Tern Bhat-Patel also suggested that she would like to be the primary.
Council Member Blackburn made a motion to recommend appointing Council Member
Schumacher as the primary and Mayor Hall as the alternate to serve on the Clean Energy
Alliance Board of Directors. Motion carried, 4/1 (Bhat-Patel -No)

6. MIRACOSTA TECHNOLOGY CAREER INSTITUTE ANNUAL UPDATE -Receive a presentation on
the MiraCosta Technology Career Institute. (Staff contact: Christie Marcella, Community &
Economic Development)
City Manager's Recommendation: Receive the presentation.
Economic Development Manager Christie Marcella and MiraCosta College Executive Director
of Community Education & Workforce Development Linda Kurokawa presented the report
and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
ACTION: City Council received the Presentation.
Mayor Hall announced that Item No. 8 would be heard ahead of Item No. 7
Council Member Schumacher recused herself from Item No. 8 and left the dais at 7:56 p.m.
8. CITY COUNCIL MEMBER REQUEST TO APPOINT COMMUNITY MEMBER TO FILL UPCOMING
CITY COUNCIL VACANCY AND FOR PREPARATION OF AN ORDINANCE AMENDING CARLSBAD
MUNICIPAL CODE SECTION 2.04.030 -Consider Council Member Hamilton's request to fill
the upcoming City Council vacancy (Gov. Code, §36512, subd. (e)) and for preparation of an
Ordinance amending Carlsbad Municipal Code (CMC) Section 2.04.030 to give the City Council
the ability to fill a City Council vacancy by both appointing an interim replacement and calling
for a special election. (Staff contact: Celia Brewer and Cindie McMahon, City Attorney
Department)
City Manager's Recommendation: Consider the request.
Nadine Bopp spoke in support of a special election to fill the upcoming District No. 1 City
Council vacancy.
Arnie Cohen spoke in support of appointing a resident from District No. 1 to fill the upcoming

direct staff to bring back options to amend the Carlsbad Municipal Code relating to City
Council Vacancies -Motion Carried 3/1/1. (Hall -No, Schumacher -Absent)
Council Member Schumacher returned to the dais at 8:56 p.m.
7. APPROVE AGREEMENT WITH PATROL MASTERS, INC. -Adopt Resolution No. 2019-198
approving a one-year contract with Patrol Masters, Inc. in an amount not to exceed $368,352
for adult crossing guard services. (Staff contact: Cindy Anderson, Police)
City Manager's Recommendation: Adopt the Resolution.
Police Lieutenant Christie Calderwood and Senior Management Analyst Cindy Anderson
presented the report and reviewed a PowerPoint presentation (on file in the Office of the City
Clerk).
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to adopt
Resolution No. 2019-153. Motion carried unanimously, 5/0.
9. APPOINT THREE MEMBERS TO THE PARKS & RECREATION COMMISSION -Adopt Resolution
No. 2019-199 appointing Nikole Pearson, Resolution No. 2019-200 appointing Amy Allemann
and Resolution No. 2019-201 appointing Brad Thorp to the Parks & Recreation Commission.

commission.
Motion by Council Member Hamilton, seconded by Mayor Pro Tern Bhat-Patel, to adopt
Resolution No. 2019-199 appointing Nikole Pearson to the Commission. Motion carried
unanimously, 5/0.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Hamilton, to adopt
Resolution No. 2019-200 appointing Amy Allemann to the Commission. Motion carried
unanimously, 5/0.
Motion by Mayor Hall, to adopt Resolution No. 2019-201 appointing Brad Thorp to the
Commission. Motion carried unanimously, 5/0.
COUNCIL REPORTS AND COMMENTS:
Council Member Schumacher spoke about her involvement with the San Onofre Nuclear
Generating Station (SONGS) Task Force.
Council Member Hamilton announced that she is amending her resignation to be effective
immediately.
CITY MANAGER COMMENTS: City Manager Scott Chadwick congratulated the City of Carlsbad's
Information Technology Department for earning the 2019 award for Excellence in Information
Technology Practices from the Municipal Information Systems Association of California. He also
congratulated City Clerk Services Manager Sheila Cobian on earning her Master Municipal Clerk
Certification from the International Institute of Municipal Clerks.
CITY ATTORNEY COMMENTS: None.
CITY CLERK COMMENTS: City Clerk Barbara Engleson requested Council Member Hamilton
submit her resignation in writing to the City Clerk Department.
