PUBLIC COMMENT ON AGENDA ITEM: Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 Al Manzano urged Council to move forward with the election and not appoint anyone to the City Council District 1 vacancy. Kris Wright stated the voters of District 1 should be allowed to vote for their representative. Vickey Syage spoke regarding the process of collecting the votes for a Special Election and urged Council not to appoint someone to fill the District 1 seat. Roseanne Bentley spoke against an interim appointment. Natalie Shapiro spoke in opposition to an interim appointment. Mary Anne Viney thanked the City Clerk's Office staff for their professionalism and the volunteers for their time to collect signatures. T.J. Childs thanked everyone for their time to collect signatures, and asked Council to amend the Municipal Code to include more choices for appointment vs. election. Michael Schertzer spoke in opposition to an interim appointment. Robin Hansen agreed with all speakers before her and spoke of loyalty to the citizens. DEPARTMENTAL AND CITY MANAGER REPORT: 1. CERTIFICATION OF SUFFICIENCY OF PETITION TO CALL A SPECIAL ELECTION TO FILL THE VACANCY IN CITY COUNCIL DISTRICT 1 AND DETERMINATION WHETHER TO PROCEED WITH THE APPOINTMENT PROCESS ESTABLISHED AT THE OCT. 22, 2019 CITY COUNCIL MEETING -Adoption of Resolution No. 2019-216 certifying the sufficiency of the petition submitted by the registered voters of the City of Carlsbad District 1 to call a Special Election to fill the vacancy in City Council District 1; and Adoption of Resolution No. 2019-217 calling and giving notice of a Special Election to be held in the City of Carlsbad on Tuesday, March 3, 2020 for the purpose of electing one Council Member to fill the vacancy in City Council District No. 1; and Nov. 8, 2019 Carlsbad City Council Special Meeting Page 2 Adoption of Resolution No. 2019-218 requesting that the Board of Supervisors of the County of San Diego consolidate the Special Election with the March 3, 2020, California Statewide Presidential Primary Election; and Adoption of Resolution No. 2019-219 approving regulations for candidates for elective office pertaining to candidates' statements submitted to the voters at the Special Election to be held in the City of Carlsbad on Tuesday, March 3, 2020; and Determine whether to proceed with the appointment process established at the Oct. 22, 2019, City Council meeting. (Staff contact: Celia Brewer, City Attorney & Sheila Cobian, City Clerk Services) City Manager's Recommendation: Adopt the Resolutions and determine whether to proceed with the appointment process established at the Oct. 22, 2019 City Council meeting. Motion by Council Member Schumacher, seconded by Mayor Pro Tern Bhat-Patel, to adopt Resolution Nos. 2019-216, 2019-217, 2019-218 and 2019-219. Motion carried unanimously, 4/0. Council Member Schumacher left the dais at 8:21 a.m. due to a potential conflict of interest. Council Member Blackburn requested a five-minute recess at 8:29 a.m. Mayor Hall reconvened the meeting at 8:32 a.m. Minute Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Blackburn, to not continue with the appointment process established at the Oct. 22, 2019 City Council Meeting. Motion carried, 3/0/1 (Schumacher -Absent). Council Member Schumacher returned to the dais at 8:35 a.m. ADJOURNMENT: By proper motion, the Special Meeting of Nov. 8, 2019 was adjourned at 8:37 a.m. ~~m~ Tamara R.
