Chairman Rombotis called the Meeting to order at 5:OO
p .m.
ROLL CALL:

DEPARTMENTAL
1) RP 86-16 - OLLIES'S OYSTER AND SEAFOOD BAR - Request
for a minor redevelopment permit to allow expansion of
an existing restaurant at 2975-8 Carlsbad Boulevard.

Chris Salomone, Community Redevelopment Manager, gave the
introduction to the above item and deferred to Mr.
Hunter.
Brian Hunter, Assistant Planner, addressed the Board and
gave the presentation of the above item as contained in
the staff report. Wall maps were shown and described by
Mr. Hunter of the site and its location. Mr. Hunter
pointed out that two of the parking spaces back straight
out onto the street and are unacceptable. Total parking
that would be required for the project is 18 spaces.
There are only 9 parking spaces on site acceptable, and
four spaces off site. Staff cannot justify the expansion
because of the inadequacy of the parking.
Member McCoy inquired regarding the illegal deck of the
project. Mr. Salomone stated that technically the deck
did not require a building permit, but it did require
parking spaces. He further pointed out that some of the
conditions of the original permit have also not been met.
The landscaping is not extent, and the parking is
different.
Mr. Salomone pointed out that the applicants have been
notified in writing and have been provided a copy of the
staff report. In response to a question whether the City
Attorney had written them a letter, Mr. Salomone stated
that that would follow the Board's action tonight.
Dan Hentschke, Assistant City Attorney, stated that the
City Attorney's office has not taken any enforcement
action with regard to this project. Normal enforcement
practices is to try to bring them into compliance with the
existing law, and if they do not comply, then institute
proceedings to revoke the permit and shut down the
restaurant.

Member Holmes inquired whether he does this without any
instruction. Mr. Hentschke responded that the City
Manager is responsible under the code for the enforcement
of all permits and code sections. That enforcement
authority has been delegated to the various departments.
The City Attorney's Office responds to a request from the
department.
Member McCoy inquired whether the restaurant was
considered the same as the delicatessen that was in there.
Mr. Salomone replied that the delicatessen was originally
looked at as a restaurant on the original RP 82-10.

The Design Review Board adopted the following Resolution
denying RP 86-16 and that the Ollie's Oyster Bar permit be
reviewed to see whether they are in compliance with the
various conditions that might create a problem and that
they be given a 30-day letter indicating that they come
into compliance with those; if they do not meet those,
that this be brought back for hearing for whether or not
they are in compliance:

the Board and gave a brief introduction of the item.

the staff report. Staff is recommending approval of the

Member Holmes inquired on the exact location of the site.
Mr. Salomone stated that it is essentially the southeast
corner of the commercial center.
Rick Puttkarnmer, on behalf of the applicant Rick Midlick,
3110 Camino Del Rio South, San Diego, addressed the Board
and offered to answer any questions.
The Design Review Board adopted the following Resolution
approving RP 86-17:
RESOLUTION NO. 084 APPROVING A MINOR REDEVELOPMENT PERMIT
TO ALLOW INTERIOR IMPROVEMENTS AND USE CHANGE AT AN
EXISTING BUILDING LOCATED AT 2564 STATE STREET TO A DELIVERY AND CARRY-OUT PIZZA ESTABLISHMENT.

Chris Salomone, Community Redevelopment Manager, requested
the Board to consider a sign permit on Elm Avenue. The
Boll-Weeval has applied for a business licensse to go into
the space which was Tony's Seafood at Big Bear Shopping
Center.

APPROVAL OF MINUTES
The Design Review Board approved the minutes of September
3, 1986 with a minor correction (Rick Ryberg's name was
misspelled).
Mr. Salomone informed that the Rick Engineering senior
project which was approved is not going to be built as
such. The Engineering Company has come in and are
requesting to build an office on that site instead; site
plans have been submitted.
