PLACE OF MEETING: City Council Conference Room CALL TO ORDER: Chairman Bizieff called the meeting to order at 5:30 p.m. ROLL CALL: Present: Commissioners Bizieff, Jones, Valenti, and Muth. Also Present Were: Geoff Armour Jane Mobaldi Bailey Noble APPROVAL OF MINUTES: The minutes of the meeting held March 10, 1997, were unanimously approved as presented. DISCUSSION OF REVISIONS TO HISTORIC PRESERVATION ORDINANCE: Mr. Armour opened up this continued discussion. Deputy City Attorney Jane Mobaldi was in attendance and handed out copies of Minutes from the Departmental and City Manager Reports of May 11,1993, which gave direction to the commission on what the council wanted the commission to accomplish. Mr. Armour asked the commission if they wanted to keep the basic document and change the language to make it clearer or if it should be something redone entirely. Ms. Mobaldi said she thought it was the Council direction to rewrite the entire ordinance. Sections of discussion were: It was decided that the wording "Compliance with this ordinance shall be voluntary" be moved under Purpose and Intent (Section 22.02.020). Ms. Mobaldi said it should be W APRIL 14, 1997 HISTORIC PRESERVATION COMMISSION Page 2 the first statement, "because you are really declaring your intent that it will be voluntary." It also was decided that Historic District Designation Procedures (Section 22.060.040 (c) "If written consent of two-thirds of the owners of property... " be rewritten to read "If written consent of 100% of the owners of property..." Ms. Mobaldi mentioned that if an individual didn't want to comply they could be taken off the list. Section 22.02.040 (5) "Historic District" means any area which contains one or more historic resources or landmarks..." should be rewritten to read "Historic District" means any area which contains more than one historic resources or landmarks. . ." Chapter 22.10, Penalties (22.10.040). It was agreed to eliminate this section entirely. Section 22.04.020 (1) Composition-Appointment was changed to read "who has a background or interest" and it was mentioned that you must be a Carlsbad resident. In the Minutes of May 11, 1993, it read "Council member Kulchin suggested that written permission of the property owner be required before a property is listed on the inventory; and that a property owner should have the right to withdraw their property from the inventory at any time." Ms. Mobaldi suggested that under Permit Procedure (22.08.020) you could say any property owners being on the list is strictly voluntarily. Establishment of Historic Resources Inventory (22.06.010) could repeal the old list (inventory) and leave a clause in stating that only people who wanted to be on the list would be on it. It would read "The City shall establish and adopt a voluntary historic resources inventory." This would repeal the old list and establish the opportunity for a new voluntary list. Ms. Mobaldi mentioned that the City Attorney is asking that the old list be repealed because it is not valid anymore. The existing list/inventory would be used only as informational resource, but repealed as a legal binding document. Letters should be sent to all owners of properties on the list explaining the changes. Ex Officio Bailey recommended calling it a "list of historical inventories for historical purposes only." Ms. Mobaldi suggested repealing the old list and starting all over again. These revisions will have to go to council and have a resolution that goes with the new ordinance. It was also decided to delete paragraph (e) and part of paragraph (f) Section 22.06.03 Historic Landmark Designation Procedures. The following paragraph was APRIL 14, 1997 HISTORIC PRESERVATION COMMISSION Page 3 recommended for deletion: "If the commission determines that the improvement warrants inclusion in the historic resource inventory or the owner has not consented to designation as a historic landmark, the commission may recommend that the resource be designated a historic point of interest." The following sentence, "No permit shall be required to work on a historic point of interest," was changed to read "Permit fees shall be established by resolution of the City Council." Ms. Mobaldi suggested that the committee pick up costs, and that this be taken into consideration for permit costs. It was also suggested that the fee shall be determined by the city and in a schedule to be set by the city council, that way it can be changed without changing the ordinance and if the council wants to make it free, they can make it free. Ms. Mobaldi mentioned that there is no cost to research your property to see whether it does or doesn't qualify to be historical, and this it already set up so that permits are determined by resolution of the council and building department. Section 22.08.040 Duty to Keep in Good Repair. Last paragraph should be changed to read "Upon recommendation of commission, failure to keep property in good repair may result in removal/revoked designation from historical landmark or site inventory." Mr. Armour closed this item discussion informing commission members that the second draft would be prepared. PLAQUES FOR HOSP GROVE AND FOR ST. MICHAEL'S EPISCOPAL CHURCH Ex Officio Bailey^gave his presentation on St. Michael's plaque saying that the wording on the last line of the plaque will read "Far from being a relic of the past, the chapel is used for regular Sunday and weekend services as well as for weddings and funerals." Chairman Bizieff will have the wording formatted for the next meeting. Chairman Bizieff updated the commission on the Hosp Grove plaque. He presented two formats, 8 Yz by 14 formatted or 11 by 17 formatted. The commission has selected the larger format. He will have formatted copy done and get cost. He doesn't have the stone yet but will send out to get cost, and will wait to see how it will be mounted. CERTIFIED LOCAL GOVERNMENT PROGRAM Mr. Armour recommended that the commission no longer be certified in the program because there are no real benefits and grants that are available are very small and c APRIL 14, 1997 HISTORIC PRESERVATION COMMISSION Page 4 involve a local 60-40 match. Also, significant proposed changes in the ordinance, particularly the voluntary aspects, and specialized requirements such as specific educational backgrounds for commissioners would reduce the commission's flexibility. The commission concurred with this change. THIRD GRADE ART CONTEST Mr. Armour informed the commission that the judging will be held Saturday, May 3rd, showing art work from 3rd grades in Carlsbad schools. Judi Schwei and Susan Pynes from the Arts Commission are taking a lead in this, and have arranged for displays in all three libraries between May 14-28. Historic Preservation Week runs from May 11 - 17, and Mr. Armour has made arrangements with the City Manager and City Council to reserve time at the Council meeting of May 13th for the presentation of a Proclamation. There will also be a presentation for the winners of the art contest. Shortly thereafter, there will be a celebration out in the courtyard with refreshments for the children and their parents. ANNUAL TRAINING PROGRAM FOR MEMBERS OF BAORDS AND COMMISSIONS Mr. Armour informed the commission of the annual group workshop and training session that will be held April 29th in the evening at the Safety Center. Dorothy Muth will attend. SIGN FOR KELLY BARN GRAIN BIN Mr. Armour displayed the sign he received from Planning Department. It came from the Kelly barn at the site of an old Carlsbad stagecoach stop and is made from salvaged wood. The depot was built in the 1880s but used only for a few years. The stage coach line ran from San Diego to Los Angeles. When the Kelly barn was demolished, the developer of Evans Point in this area was required to preserve a small shed made of the original wood on the site and to identify it with a sign. The developer has done this, so the commission decided to ask the Carlsbad Historical Society to preserve this sign for future displays at the Magee House. ANNOUNCEMENTS/COMMITTEE REPORTS There was general discussion about recent actions taken on the Barrio Plan. It was noted that the issue, as with the original Historic Preservation Ordinance, came down to private property rights and perceptions about how a specific plan would restrict those rights. /***<' APRIL 14, 1997 HISTORIC PRESERVATION COMMISSION Page 5 I ficio Battey updated the commission on Carrillo Ranch. He said that the Master Plan for the 18 acre site has been approved. Mr. Armour informed the commission of the twenty-second annual California Preservation Conference being held in Pasadena May 29 - June 1, and encouraged any commissioners who wanted to attend to send in reservations. PUBLIC COMMENTS NONE ITEM FOR NEXT AGENDA Historical Preservation Ordinance.
