CALL TO ORDER:
Commissioner Bender called the meeting to order at 5:00 p. m.
ROLL CALL:
Present: Commissioners Bender, Boone, Nelson
Absent: Commissioners Geidner and Sander

APPROVAL OF MINUTES
• The minutes of special meeting held October 23, 2017 minutes were approved
(Nelson/Boone and vote 3, 0, 2, 0) with Commissioners Geidner and Sander absent.
• The minutes of special meeting held August 21, 2017 and the regular meeting held on
September 11, 2017 were not approved due to lack of quorum who were at those
meetings.
PUBLIC COMMENT
None
ELECTION OF CHAIR AND VICE CHAIR
The commission moved to postpone the election of Chair and Vice Chair until a new
commissioner has been appointed. (Nelson/Boone and vote 3, 0, 2, O) Commissioners Geidner
and Sander absent.

The commission moved to change the regular meeting date of November 12, 2018 to
November 5, 2018 due to the Veterans Day Holiday. {Boone/Nelson and vote 3, 0, 2, O)
Commissioners Geidner and Sander absent.
HISTORIC PROP ERTY INVENTORY
The inventory is being coordinated with the ordinance revisions. See next agenda item.
ORDINANCE REVISIONS FOR THE MUNICIPAL CODE
Commission Liaison Smithson updated the commissioners about the potential revisions to the
Municipal Code. She received final revisions by Special Counsel to the City Attorney, Pete
Grover, from the City Attorney's office this afternoon but they have not yet been reviewed by
Liaison Smithson and Assistant City Attorney, Ron l<emp. When they are ready, the nine page
revisions will be mailed out to the commissioners. The plan is to bring the approved revisions to
the March meeting and then prepare to send the updates to City Council. Liaison Smithson will
write up the staff report with the help from Historic Sites Manager, Mick Calarco and Assistant
City Attorney, Ron l<emp.
PROPERTIES OF CONCERN
Commissioner Laurie Boone commented that Magee House has had issues with homeless
people sleeping at the park. Commissioner Boone shared that there have been more patrols
around the area and the Homelessness Outreach Team {H .O.T.) is trying to get a handle on the
problem. Commissioner Boone attended a presentation by Interim Community & Economic
Development Director, Debbie Fountain, in which she spoke about what the H.O.T. committee
is and what their plan is to help with the homelessness in our area. Commissioner Jack Nelson
stated this is not an Historic Preservation Commission issue, but Commission Boone stated that
it becomes an issue when it is affecting historic properties because they are more vulnerable.
Commissioner Kevin Bender asked if the third-grade tours are getting more comfortable in
Magee Park now. Commissioner Boone said they are more comfortable with the third-grade
tours because the City of Carlsbad has had the park tables and restrooms sanitized making it
cleaner and safer for those who come to the park. The park ranger program has also been very
helpful.
Commissioner Boone also commented that it would be a good idea to stay on top of it by
hearing what's happening and by listening to the statistics and going by the park and see how
the rules are being enforced.
Commission Liaison Smithson notified the Commission that there is a property on Adams Street
which the owner's daughter, Catherine Bryan, would like to have listed as a historic property.
Ms. Bryan sent a packet to the City Attorney who then forwarded it to Liaison Smithson. Liaison

Smithson shared that she replied to Ms. Bryan clarifying next steps. These steps, according to
the current municipal code, include that Ms. Bryan needs to provide additional information, the
Historic Preservation Commission would need to hold a public hearing with fourteen days
published notice, and notification sent to all property owners including financial institutions.
The Commission's role would be evaluating the submitted materials and recommending historic
designation or not. To address this property at the March Commission meeting, Ms. Bryan
would need to have the required materials submitted by early February.
Commissioner Boone remembers being at the council meeting where Ms. Bryan made her
presentation. She said code enforcement would like to condemn the property. The property is
in very poor condition.
Commissioner Boone reported that there is a eucalyptus tree on Chestnut which had a branch
fell off and crushed a car. Then one tree at Holiday Park had a branch fall and killed a person.
She is concerned that the trees will be cut down in fear of branches falling. But she feels that
the eucalyptus trees are an important part of the Carlsbad heritage.
After this discussion of historic trees, Liaison Smithson shared the Commission's former project,
the Heritage Tree Report with the Commissioners who were not on the Commission at the
time. Arborist Mark Wisniewski surveyed the area in the village and surrounding area for the
Heritage Tree Report which was done in two phases. The report can assist in determining if a
tree has been identified to be of a historic nature. This report was approved by the Historic
Preservation Commission in 2010 then sent to Parks & Recreation to be included in the
Community Forest Management Plan. It has yet to be presented at the Parks & Recreation
Commission due to unresolved sewer lateral concerns. Trees included in this survey included
privately owned trees visible from public areas and city trees.
CARLBAD HISTORICAL SOCIETY UPDATE
No current update
COMMISSION LIAISON ANNOUNCEMENTS
Liaison Smithson updated the commission on the Street Tree Removal Request Form. At a prior
meeting of this Commission, the Commissioners asked if the question "is it a historic tree?" be
added to the form. Parks Services Manager Kyle Lancaster agreed that it will be considered to
add that question to the form
Liaison Smithson shared with the commissioners of upcoming training for Boards and
Commissions for protocol and the Brown Act.
Liaison Smithson notified the commission that the Cultural Resource Guide was accepted on
October 24, 2017 by council and a link is on the City's web site for viewing.

Commissioner Boone shared a picture of the tree on Chestnut just before Tyler Street that was
removed.
Commissioner Bender asked about sending a letter to Mr. Capp and Mr. Majer thanking them
for their response and interest. Liaison Smithson responding that letters have been drafted to
send to both Mr. Capp and Mr. Majer.
