3. AB #53 - APPE?L OF DESIGN REVIEW BOARD DECISION
REGARDING RP 84-3A CAIiLSBAD INN.
Chris Salomne, Camunity Redevelopent Manager, gave
the staff report as contained in the Agenda Bill,
using a transparenq to shw the site and wall mps
shming the buildings contained in this project.
In answer to Council query regarding possible location
for the 23 additional parking spaces to be provided by
the applicant, staff stated that preliminary studies
were generating some alternatives including the
,possibility of closing Garfield Street and mking that
area a public lot. The applicant could be mde to pay
his share of that lot. Also, he could find property to purchase nearby and hild a parking lot.
Conmissioner Lewis asked if it muld nut ke ketter to
have the traffic study in the Redevelopment Area
campleted before any action was taken an this
request.
Marty Orenyak, Building Director, stated no work had been done m the proposed condominiums. Those
condominiums wuld sit on top of the existing parking structure. He stated there was a hold on issuing permits.
Staff, in answer to query, stated they intended to work on the problem of the additional 23 parking spaces and within three n-onfhs muld have this back
before the conmission.
Conmissioner Casler opened the Public Hearing at 6:48
p.m., and issued the invitation to speak.
Jim Watkins, 355-14th Street, Del Mar, the applicant,
addressed the cormcission describing the Carlsbad Inn
project. He added they had received hilding permits for exactly what they were doing as far as their
project. They had worked with staff and had provided
all parking requirements. He stated they wanted -le
parking and good service and there were 198 spaces for
the condominiums and hotel rmm; 49 spaces for
Fidel's, and 34 spaces for the retail area, making a total of 281 parking spaces.

Mr. Watkins stated he agreed to provide the additional
23 spaces, but he did not feel this was as rm& a
problem as the City visualized. He stated the people
staying at the hotel would use the restaurant there
and the restaurant across the street. The code states
with retail establishments, there are m additional
parking spaces required. "his proposed establis-t
is half retail and half food. He stated that Fidel's
is not open for breakfast, so that is 49 spaces that
are available for parking from Fidel's. During the middle of the day, the people will 90 to the recreational areas, so the period frm 1O:OO a.m. to
4:OO p.m. would be vacant time for the parking lot.
Mr. Watkins hoped to have 75% occupancy, but that
would still leave 25% vacant, vhich would be 49 spaces
available at nicjht. Because those spaces are nunbered
and assigned, it would be possible to have the valet
service note the spaces that are available and park
cars in those unoccupied spaces.
Mr. Watkins further stated the tourists staying at
their resort would be staying a week and muld be
spending mney in Carlsbad. They must provide breakfast facilities for those tourists. It is not
practical for mom service ta be provided, and the
Grunion Run muld provide that breakfast. This also would be a retail area with items for sale.
Cdssioner Lewis asked whether this restaurant was
part of the original plan, and Mr. Watkins stated in
his letter of January 4, 1984, the proposed plan
included a mrplex of interesting shops, boutiques,
major restaurants, terrace vim dining and a sidewalk
cafe to better serve the mmty and the general
public.
Marty Orenyak stated this was discussed at staff
level, and at that tim the corranent was mde by staff
that there rmst be mre parking if there was anofher
restaurant.
Fbger Peterson, 180 Cherry Avenue, spoke in cppsition
to a waiver of the additional parking requirement, as
he understood from last June that City Council was to
alleviate parking and circulation for the kach area.
Hap L'Heureux, 1731 Kalava court, President of the
Carlsbad chamber of Cormerce, stated they support the
conpranise offered this evening for a nuniber of reasons. Obviously, the hrden is placed m the applicant to solve the situation of the additional
parking spaces, by not allwing them to proceed with
the mndominium units. This will provide an additional 43 spaces over and dbove the 23 parking
spaces needed. He felt that was adequate protection. The ultimate decision should be deferred until the traffic circulation study has keen done.

Mary Melideo, 159 Hemlock, stated this was a beautiful
project and she mrrplhted Mr. Watkins for it.
Hcrwever, she stated they should continue with their
original project, because at no time was another
restaurant mtioned. She felt that Once the
restaurant was opened the situation might not Ix solved.
Richard Pitchford, 2409 JaCJtaranda, General Manager of
Carlsbad Inn, addressed the Conmission, stating in
view of the number of spaces Mr.Watkins was willing to
give to the City and the mnditions under which this
was controlled by the City, he felt this request
should be approved. He stated that steps had been
taken to mntrol tlze underground parking and the
signage would be in before the end of the week
indicating the underground parking. All efforts wuld
be mde to utilize all available spaces. With the
system they have at the Bont desk, they will blcck
off certain spaces and those will be available to
people corning to the retail area and the Grunion Run
Restaurant.
Daniel Digiovanni, mer of Henry's restaurant,
addressed the Camission stating there is a mjor parking problem in that area. He stated he is an
independent restaurant mer and the spaces in their parking lot are needed for their ,oatrOns. He stated
he is willing t~ 9 along with the Carlsbad Inn mers
because they do have a @ relationship with them, but it is very important that the spaces in his
parking lot be saved. for his patrons and not bz used
by beachgoers or people going to the restaurants in
the Carlsbad Inn mnplex. He asked the Conmission to
think very seriously abut this request, and stated
there are approximtely 260 qloyees in that entire
corner area, as well as the I=eachgoers, and &ere will
they all park.
Carol Watkins, 35 14th Street, Del Mar, stated she did
not see the parking as a problem. The Grunion Run
would be a place to shop as well as eat. Mrs.
Watkins stated it muld be a hardship if they were not
allowed to wen the Grunion Run.

Richard Goldberg, co-mner of Henry ' s , asked to go on
record as favoring the opening of the Grunion Run Restaurant. He had talked with JW. Watkins , and the
problem is parking. He stated their main problem is
nicjht time, because it is easier to use Henry' s lot
than use the underground parking. He said the project
should be given approval.
Since no one else wished to speak on this item, the
Public Hearing was closed at 7 : 24 p.m.
Conmissioner Kulchin stated the 23 s,Paces needed muld
be offset by 66 spaces for the uribuilt condominiums,
giving a surplus of 43 spaces. She supported the
alternative staff had presented.

Conmissioner Lewis stated he felt Mr, Watkins had this
type of restaurant in mind &en *e original application was filed, and expressed concern that he proceeded when the original +Dproval did not include
the second restaurant.
Conmissioner Pettine concurred with Comnissioner
Lewis, and added the problem should be solved m. He felt this item should be mntinued for 90 days to get the parking problem solved.
Conmissioner Chick agreed with Catmissioner Kulchin
and felt the additional spaces auld be found,
Conmissioner Casler stated we have control over
everything and the CUP could be for a period of me
year. She stated she had no problem with the
recomndation that Mr. Salomne had suggested, putting a hold on the cr>ndominium building permits until an agreeable parking area is provided.
The Housing and Redevelopment corranission directed the
City Attorney to return with documents granting the
appeal, approving the staff recomndation to issue no
building permits for the 66-unit mndominium building
until the parking requirement is Et for an additional
23 parking spaces for the Grunion Run Restaurant, and
approving the CUP for a period of me year.
City Attorney Vincent Biondo stated the City
Attorney's Office wuld return with the necessary
Resolution to amend the previously approved
Redevelopment Permit and set out in detail the intent
of mtion to approve. Also, to get an agreement to
those tern from Mr. Watkins before placing this back
on the Agenda.
