HomeMy WebLinkAbout2012-06-20; Library Board of Trustees; MinutesApproved: ITEM #3 MINUTES MEETING OF: DATE OF MEETING: PLACE OF MEETING: LIBRARY BOARD OF TRUSTEES Wednesday, June 20, 2012 Carlsbad City Library Board Room 1775 Dove Lane, Carlsbad CA CALL TO ORDER: Chair Bob Benson called the meeting to order at 4:00 p.m. ROLL CALL: Present: Absent: Library Board Trustees Benson, Hinman, Hulsart, and Lignante Library Trustee Bradley Staff Present: Heather Pizzuto, Library & Cultural Arts Director Dave Curtis, Deputy Library Director Suzanne Smithson, Deputy Library Director Glynn Birdwell, Principal Librarian Jessica Padilla Bowen, Community Relations Manager Steve Didier, Library Management Analyst Paul Edmonson, Deputy City Attorney APPROVAL OF MINUTES: By proper motion (Hinman/Hulsart) and vote, the Board unanimously approved the minutes of the May 16, 2012 meeting ofthe Library Board of Trustees. MONTHLY LIBRARY REPORTS: Trustee Hulsart commented on the "Jedi Training Academy" physical fitness program that took place at the Cole Library and also noted that the statistics for e-book usage is up again from last month. Trustee Benson noted that the number of school-age children and programs were down and Deputy Library Director Curtis responded that the Library had decreased the number of programs from the previous year. Library Board of Trustees Page 2 Minutes of June 20, 2012 Meeting RULES OF CONDUCT: Chair Benson noted for the record that the Board had received a letter from a local resident offering concerns about the revised rules and polled the members ofthe Board as to whether or not they had read the letter. The Trustees responded that they had read the letter. After a brief overview of the process undertaken by the Library to revise the rules. Chair Benson opened the floor for discussion. Library & Cultural Arts Director Pizzuto introduced Assistant City Attorney Paul Edmonson who had conducted a review of the revised rules as well as the materials received from library law expert and attorney Mary Minow and was on hand to answer any legal questions and address any concerns the Board might have about the Rules of Conduct before them. Trustee Hinman opened the discussion referencing portions of the letter having to do with denying access to information and materials and also restriction of religious freedom, stating that neither of those seemed to fall within the purview of the Rules of Conduct. Library & Cultural Arts Director Pizzuto provided an explanation of current practices for handling informational needs in circumstances where a patron may be asked to leave as a result of a conduct issue. Trustee Hulsart asked if there are libraries within our local area and the state that have similar rules of conduct in place and if there had been any litigation against them. Library & Cultural Arts Director Pizzuto responded that the Library had done extensive research and along with recommendations from Mary Minow, library law expert and attorney, modeled the revised rules based on best practices, case law and legal opinions. Attorney Edmonson added that there have been cases where people have challenged rules of decorum in general and the courts have upheld that the City has the authority to establish rules of acceptable behavior and the rules do not have to reference only behaviors found in the penal code. As to the allegation that enforcement of the rules is subjective and violations are routinely ignored. Attorney Edmonson stated that a measure of discretion in the enforcement is allowed in that some conduct is more egregious than other and may or may not come to the attention ofthe staff. Trustee Lignante questioned how staff would be Instructed to enforce the rules, especially in cases where the individual who is in violation refuses to recognize their authority and acts aggressively. Library & Cultural Arts Director Pizzuto responded that the Library has many safeguards in place for the staff, including contacting the police department when the situation indicates that Library Board of Trustees Page 3 Minutes of June 20, 2012 Meeting assistance is needed. Staff is routinely trained on Library policies and procedures, particularly when they are updated or introduced initially. Chair Benson and Trustee Hulsart both expressed satisfaction that the Library had done due diligence in the research and review of the Rules of Conduct and recommendations for the revised document. By proper motion (Hulsart/Hinman) the Board unanimously approved the revised Rules of Conduct as presented this date. STRATEGIC INITIATIVES 2012-13: Library & Cultural Arts Director Pizzuto referenced the final list of Strategic Initiatives for Fiscal Year 2012-13 and advised the Board that the initiatives were In alignment with Council priorities for the next year. Missing from the final list was the upgrading of the City's intranet. That was subsidiary to a larger project to upgrade the City's website and dependent on other City Departments participation and the need to delay the project was made at the City level. APPOINTMENT OF BOARD CHAIR & VICE: The Board unanimously agreed to table the selections of officers until the next regular Board meeting. APPOINTMENT OF REPRESENTATIVE TO CLAF BOARD & GALLERY COMMITTEE: Trustee Hulsart volunteered to continue as liaison to the Carlsbad Library and Arts Foundation (CLAF) and the appointment of a representative to the Gallery Committee was tabled until the next regular Board meeting. DIRECTOR'S REPORT: Deputy Library Director Smithson reported that the Summer Reading Program is only in its third day and there are already 1,729 participants signed up, adding that by the end ofthe program the number of participants usually reaches 5,000. Library & Cultural Arts Director Pizzuto brought the Board up to date on the following: Budget for FY2012/2013 - The Library has not received any questions about the submitted budget and it is scheduled for adoption at the next City Council Meeting. Library Board of Trustees Page 4 Minutes of June 20, 2012 Meeting Brownley funds - Margaret Brownley, long-time member ofthe Friends and library supporter, designated her property as a gift to the city to establish the George and Margaret Brownley Fund. The gift was subject to a life estate for longtime caretaker Barbara Hallman, who recently passed away. Use ofthe gift was to be determined bythe City Council, with preference for library services. As part ofthe 2012-13 budget adoption, the Council will have an opportunity to segregate the funds for improvement ofthe Cole Library, which is the staff recommendation. They may also elect to retain the funds undesignated, within the General Fund. Space redesign - The Library continues to work with architectural consultant Carrier Johnson, to finalize possible space reconfigurations. Once general concepts are finalized, cost estimates will be received and presented to the City Manager team. The proposed layout is expected to be finalized by July or August. Ziegler rock - The Council voted for the deassession ofthe non-working fountain and following the Council meeting the Library heard from several individuals interested in taking possession ofthe rock. However, none of those offers have been formally presented in writing. The plans remain to have it removed this summer. Donations - The Library has received a $1,000 donation from the Carlsbad Lions Club which will be used to replace the assisted listening devices in the Schulman. The Literacy program has also received a donation of $802 from the San Diego Council on Literacy on behalf of the Union Tribune's 2 cent Sunday subscription fund raiser. There were 115 new subscriptions collected on behalf of our Literacy program. Also pertaining to donations, the Library only recently created a wish list on Amazon.com and has already received a donation as the result. Restructure - Human Resources is finalizing the Librarian classification study to determine the correct classification for the collection development librarian position. Some modifications to the job description and title have been made to a current Police Training Coordinator that if approved by Council next week will allow the Library to recruit for the second approved position. Library Training Coordinator. Recruitments - The City has recently migrated to NeoGov which is an on-line application process for all recruitments. 50 Shades of Gray - The staff reviewed the Collection Development Statement, discussed the appropriateness of the book, and decided to add copies to the collection according to established quantity standards. Library Board of Trustees Page 5 Minutes of June 20, 2012 Meeting FOUNDATION REPORT: Trustee Hulsart reported that the main topics of discussion were the opportunity drawing and mini-golf. Cultural Arts Manager Peter Gordon also shared the TGIF Jazz schedule with the Foundation Board. FRIENDS OF THE LIBRARY REPORT: Trustee Hulsart announced that the Better Books Sale brought in a little more than $1600 and also that the Friends are again providing free books, during the first two weeks ofthe program, for registrants in the Summer Reading Program this year. NSDC GENEALOGICAL SOCIETY: Board Liaison Marg Kealey brought the Board up to date on past and future programs as well as the beginner and refresher genealogy classes beginning again June 16^*^. LIBRARY BOARD COMMENTS: None. PUBLIC COMMENT: None present. ADJOURNMENT: By proper motion (Hulsart/Hinman) and vote the meeting was adjourned at 4:50 p.m. Cissie Sexton Administrative Secretary ITEM #4 Monthly LIBRARY Reports for MAY 2012 Systemwide... 1. The annual celebration honoring the service ofthe Library's hourly employees took place on May 11th. Milestone years of service were achieved by 48 of our over 150 hourly employees. 2. The Library began a mentoring program for hourly employees who have recently graduated with their Master's Degree in Library Science. Four recent graduates who are Library Technicians were selected to begin training and working as Substitute Reference Librarians. 3. The volunteer orientation on May Sth brought 9 new volunteers. Another two volunteers were referred to us from the city volunteer coordinator for a total of 11 new volunteers. CCL, Dove Lane... 4. The Children's Division provided a Cinco de Mayo Celebration on May Sth. Alina Mendez presented Mexican music and dance and the 24 attendees also got to make mini, edible sombreros. 5. On May 6th, San Diego-based New York Times bestselling author Susan Vreeland spoke about her latest book, Clara and Mr. Tiffany, in the Schulman Auditorium. Ms. Vreeland took many questions from an engaged audience of about 50 and also signed her books. 6. On May 12th, the Library's Cinema Series featured the independent film Sweet Land in the Schulman Auditorium and 112 people attended. Many stayed for a lively post-film discussion. 7. On May 16th, the Library hosted a staff emergency preparedness training exercise and set up a Local Assistance Center (LAC) in the courtyard, Gowland Meeting Room and Schulman Auditorium. An LAC is a centralized facility to assist residents and businesses in recovering from damage sustained during a large-scale, man-made or natural disaster, such as an earthquake or fire. The exercise was part of a state-wide earthquake training to assess emergency operation plans, policies and procedures at the local, regional and state levels. In addition, about five Library staff members participated in a May 15th exercise of the City's Emergency Operations Center (EOC), which would be set up at the Safety Center to manage the City's emergency response at the start of a large-scale disaster. 8. 25 library users took advantage ofthe computer and mobile device classes provided in May. 9. Teen Services Librarian Darin Williamson had a busy month providing three Games and Refreshment events with 41 teens attending and the Pizza and a Movie program featuring the Academy Award nominee Hugo with thirteen attending. Darin also organized the Rock the Library Concerts featuring the band Monomood that drew 35 attendees and Tragic Waste that drew 55. Monthly Library Reports for May 2012 Georgina Cole... 10. The May 20th Magee Park Poets workshop at Cole Library was led by San Diego poet and teacher Georgette James. Twenty-six people attended and many left the class with wonderful poems written during the three-hour session. 11. Carlsbad History Room Librarian Amy Davis represented the Library sharing information, early Carlsbad stories, and answering questions about the History Room at the Spring Fiesta on May Sth and at the Wild West Fest at the Leo Carrillo Historic Ranch Park on May 19th. 12. Cole Reference Staff taught 41 students in various computer and e-book classes held at the Library Learning Center. 13. Cole Children's Division and the Carlsbad History Room presented tours and information for six 3rd grade elementary school classes in conjunction with the CityStuff program at City Hall. 14. Cole Children's Library Assistant Amy Jordan shared Summer Reading Program information at a Hope Elementary School assembly reaching over 600 children. Librarian Missy Shaw, along with Community Outreach Supervisory Lizeth Simonson attended Jefferson Elementary School's open house where over 250 children and parents stopped by the library's table to learn more about the Library and Summer Reading Program. 15. Star Wars Day (May 4) was celebrated with "Star Wars Jedi Training Academy" where 72 children participated in the physical fitness program of Jedi training. 16. Additional May Children's programs included a visit from the Birch Aquarium with tubs of tide pool critters (71 participants), and a child safety program presented by the Carlsbad Police Department for National Police Week with a K-9 demonstration (85 participants). 17. Genealogy Library Technician Ann Montgomery taught the Focus On American Ancestors classes on May 1 and 15. American Ancestors is the web site of the New England Historic Genealogical Society and includes hundreds of databases focusing on New England, the Mid- Atlantic, and the Mid West. 18. Genealogy programs included "Using Dropbox in Genealogy" (78 attendees), the Wednesday Evening Beginning Genealogy Classes (total of 45 people attended) and "Women's Roles in the Civil War" (84 attendees) presented by Gena Philibert Ortega. Learning Center... 19. The All Star Readers Club for children in grades 1-5 held their last meeting ofthe school year. This year 61 participants received awards for a total of 1006 hours of reading. 20. A Scavenger Hunt was held at the Learning Center to create excitement for the Summer Reading Program. During the event over 50 children, teens and parents enjoyed an afternoon with raffles, prizes and art activities. Everyone has the right to use library services and resources provided his or her behavior does not unreasonably interfere with the rights of others to do the same. Carlsbad City Library users are expected to conduct themselves in a lawful, orderly and considerate manner. Persons who violate the following rules will be asked to stop such actions and may be asked to leave the Library. PROHIBITED CONDUCT: 1. Smoking in the Library and within 20 feet of all entrances. [California Gov't Code § 7597.] Smoking outside of designated smoking area. [Carlsbad Municipal Code § 6.14.030.] Other uses of tobacco are not allowed inside the Library. 2. Accosting library users on Library property for the purpose of begging or soliciting alms. [California Penal Code § 647 (c).] It is not permitted to solicit library users for money for any purpose on Library property unless part of a Library approved activity. 3. Behaving in a manner that is unsafe or that interferes with library users or staff who are engaged in lawful activity. Someone refusing to leave after being directed by a library supervisor or peace officer is guilty of a misdemeanor. [California Penal Code § 602.1 (b)] 4. Bringing bicycles in the Library; riding skateboards or similar forms of transportation in the Library or on Library property. [Carlsbad Municipal Code § 10.58.030.] 5. Theft, abuse, vandalism, or mutilation of Library facilities, equipment, or materials. [California Penal Code §§ 490.5 & 594.] 6. Use of restrooms for other than intended purposes. 7. Entering library facilities without being clothed including shirts and shoes or other footwear, in accordance with public health and safety concerns. 8. Leaving a child unattended. See Unattended Children Policv 9. Bringing animals into library facilities, except for animals assisting library users with a disability, as specified and in compliance with the Americans with Disabilities Act. 10. Sleeping in the Library or on Library property. Revised 2/2012 11. Eating or drinking in areas where food and drink is prohibited. See Food and Beverage Policy. 12. Using electronic devices or other personal equipment that is disruptive to others. 13. Bodily hygiene that is offensive so as to constitute a nuisance to other persons in the Library. 14. Leaving belongings unattended. The Library is not responsible for lost or stolen items. 15. Blocking aisles, seating areas, exits or entrances with personal items. Persons who violate these rules will be asked to stop such actions and may be asked to leave the Library. Persistent violations of these rules may also result in suspension of use of Library facilities, programs, resources and services. Suspensions will be for a definite time period. The length of suspension will be determined by the Library & Cultural Arts Director or other designated staff and will apply at all City of Carlsbad Library facilities. Police will be called in cases of criminal or legal violations. Appeal of any suspension may be made in writing to the Director within five (5) business days of its issuance. The suspension will remain in effect during the appeal process. The Director shall render a decision within ten (10) business days of the date of receipt of the request for an appeal. The applicant may appeal the Director's decision to the Assistant City Manager within five (5) business days of the Director's decision. The Assistant City Manager or designee shall render a decision within ten (10) business days. The Assistant City Manager's or designee's decision shall be final. Revised 2/2012 Rules of Conduct CARLSBAD CITY LIBRARY To keep the Library safe and pleasant for everyone^ the following activities and behaviors are prohibited: 1. Smoking in the Library (Carlsbad Municipal Code 6.14.030). 2. Soliciting or panhandling either inside the Library or on the surrounding City property [California Penal Code 647(c)]. • 3. Assault on patrons or staff (California Penal Code 242). 4. Threatening, disturbing, offending, intimidating, or harassing others. Including staff [California Penal Code 602.1(b)]. 5. Bicycles in the Library and riding skateboards or similar forms of transportation in the Library or on the Library property (Carlsbad Municipal Code 10.58.030). 6. Theft, abuse, vandalism, or mutilation of Library facilities, equipment, or materials (California Penal Code 490.5 & 594). 7. Misusing restrooms for purposes of bathing or washing clothes. 8. Being in the Library without wearing shoes and shirt. 9. Leaving children unattended by a parent or authorized adult. 10. Bringing animals into the Library except those certified to assist a patron with a disability. 11. Lying on the floor or sleeping. 12. Bringing luggage, bedrolls, or large containers unrelated to Library use. Any items not prohibited should not block aisles or seating areas. 13. Food or drink In restricted areas or that disturbs others. 14. Use of cell phones that disturb others. 15. Bodily hygiene that Is offensive and disturbing to others. Persons who violate these rules will be asked to stop such actions and may be asked to leave the Library. Persistent violations of these rules may also result in suspension of Library privileges.
