COMMISSIONERS
CALL TO ORDER;
The meeting was called to order by Chairperson Dahlquist
at 4:37 p.m.
ROLL CALL:
Present: Commissioners Dahlquist, McFadden, Donovan,
Conti, Popovich, Cochran and Wright.
Absent: None.
Also present:
David Bradstreet, Director of Parks and Recreation
Doug Duncanson, Parks Superintendent
Lynn Chase, Recreation Superintendent
APPROVAL OF MINUTES;
Commissioner Cochran asked that his name be included as
present at the December 13, 1982, meeting. Commissioner
McFadden was not present at the December 13 meeting, and
asked that her name be removed from those present.
The Minutes of the Regular Meeting, December 13, 1982, were
approved as amended.
UNFINISHED BUSINESS;
YMCA/CITY SUB-LEASE - Middle Agua Hedionda Lagoon. Staff
prepared and submitted sub-lease to YMCA officials.
YMCA has returned the lease with revisions. Commission
to review and comment. Attachment A is copy of Subleas
Marsha Backlund, Administrative Assistant, gave the staff
report. The contract expired in 1972 and was not renewed.
Since last July staff has been meeting with the YMCA, trying
to get a contract. Attention was called to the following
items: Page 1 - under 2. Use, the last sentence. The word
"exclusive" would exclude the City. In the original the
wording was "non-exclusive". Page 3, under No. 12, she
explained the fees. There are two rates charged to the
public. There is one rate for YMCA groups which is a
reduced rate, just the actual cost of the facility. Another
rate is charged to the general public. They are going to
charge us as a "Y" charge, May to October, which is prime
time. The rest of the year would be half of the regular
price. Page 4, under 14, the liability is a problem, if
outside groups are allowed to use the facility. Also on
page 4, Item (b) regarding the lifeguards, we can provide
lifeguards if they go through the "Y" orientation program.
On the same page, (c) Reservations, we have up to one year
to reserve a date for use of the facilities. These are the
major changes.

COMMISSIONERS
The Commissioners discussed the problem of the City having
access to the water, but no access to the property
surrounding the water. Also, it was questioned just how
advantageous this lease is to the City. The possible
duplication of programs offered by the City and the YMCA
was discussed and the rates charged for the use of the
facilities at the Lagoon.
After a lengthy discussion, the Commission adopted a motion
to table this matter until next month and find out the rates
proposed and charged; and also, get something about the
income from these facilities.
The Commissioners expressed the opinion that they felt there
should be no need for money to change hands; that there
should be a mutual trade-off between the parties.
A motion was made that at the expiration of the lease with
SDG&E, that we do not renew. The motion was withdrawn for
lack of a second.
NEW BUSINESS:
Commissioner Conti commented about the Parks and Recreation
Commission meeting not being listed in the newsletter the
City Manager issues, and wondered whether the Commission
is taken seriously. Chairperson Dahlquist called attention
to the giant strides the Commission has made the last four
or five years and the fact that the Commission does want
to be part of the process. Council Member Lewis agreed that
the Commission has made great progress and that the Council
certainly does give credence to the recommendations this
Commission sends to them. Commissioner Wright commented tha
the Commission revised the Element and he was proud to have
been a part of that and felt there was a lot of weight given
to what this Commission said. Commissioner Conti said he
felt very reassured.
A motion was made stating that all park construction and
major improvement programs must be coordinated with traffic
access improvements or deferred until access is improved.
The motion died for lack of a second.
The Commission passed a motion to adopt an agenda for each
meeting and any new items must be presented ten days before
the meeting date so Dave Bradstreet can include them on the
agenda. New items for discussion or action will be voted
on at the beginning of the meeting before the approval of
the Minutes.
COUNCIL REPORT;
Council Member Lewis reported on the most recent meeting
between the School Board Representative and the Council.
It is going back to the Council and the School Board and
hopefully the swimming situation will be resolved by the
next meeting.
COMMITTEE REPORTS;
Commissioner Wright reported on senior citizens volunteering
for tutoring of students. The basketball cl inics at the high
school has about 140 children involved in it.

COMMISSIONERS
Commissioner McFadden reported she has been appointed
to the Traffic Circulation Element Committee.
ADDITIONAL BUSINESS;
The February Meeting date of February 21, 1983, falls on
Washington's Birthday. The Commission changed the date to
February 28, 1983, at 4:30 p.m., at the LeVante Center.
Dave Bradstreet, Director of Parks and Recreation, gave a
report on Standard Pacific, which was carried over from the
December meeting, in order to make a decision on the park
property. A map was used showing the proposed project and
another map showing Quail Ridge Park and Elm Beautification
Project.
Mr. Bob Allen, representing the developer, explained the
proposal where they will put in a multi-purpose field and
a tennis court in exchange for taking 2.9 acres back from
the City. This area has an ocean view and the developer
felt it would make an excellent park area. The City would
be responsible for maintaining this area and the landscaping
they would put in on the entranceway and median. It was
noted that the median as planned by the developer, did not
meet City standards. The plan for this development was
described as something they would build, and the City would
then take over the maintenance--at a cost of approximately
$10,000 per year. The Commissioners felt the City had
nothing to gain by allowing a neighborhood park to be built,
where maintenance would be a factor. The open space would
allow people to go up there and enjoy the view.
The Commission adopted a motion to deny the Quail Ridge
Park and Elm Avenue Beautification Projects.
DIRECTOR'S REPORT
A. Jefferson School
Dave Bradstreet reported the plans are completed and reviewec
by Engineering. February 1, the City Council will authorize
and it will be done in 90 days.
B. Landscape Manual
The Manual is going through editing at this point, and it is
going to be a good Manual.
C. City/School District Agreement
Council Member Lewis alluded to a City School District
agreement. He is working with the Superintendent of Schools
for the use of the pool and for free use of the cultural
art center.

2. Youth groups will not be permitted to use the facility without adequate
adult sponsorsliip and supervision (at le^st a 1 - 10 ratio) .
3. All groups using "Y" 7q\jtatic Park must be covered by their cwn appropriate
insurance, both liability and accident and must provide a Certificate of
Insurance in the amount of $1,000,000 coverage.
4. All groups will agree to hold the Y.M.C.A. free and harmless from any
liability and accident, or damage to personal property occurring during
their use of the "Y" Aquatic Park.
5. There will be no liquor or alcoholic beverages allowed on the premises.

C. VATER SAFETY S EQUIPMENT USE • - . ' •
. 1. There must be a certified lifeguard on duty at all times when there is
swimming or boating. We will provide a lifeguard for you at $H.OO per
hour, which you pay directly to lifeguard. There is a six hour minimum.
per day, so be sure to indicate at least six consecutive hours on your
reservation foi^m. Seven day notice is required for us to provide a guard.
2. All .participants when using boats or kayaks must wear a life jacket. •
3. All boats, paddleboards, kayaks and swimmers must bo kept away from all
rocks, out of the channel and away from the highway bridge. Please do
not let boats and paddleboards ram against each other.
4. Please instruct all members of your -group not to play on or land on any
of the private property located on the north side of the lagoon. This is
most important. Also, since all of our floating equipment is not to be
south of our "Y" pier, this really means that the only place the row boats
,— and paddicboard users can land is on the east side of the lagoon near the
freeway and our own Y.M.C.A. site.
5. Kayaks or boats are not to be beached on East side of lagoon or dragged
Jicross the dirt or gravel area. Kayaks are .to be carried to/ from the
boothoujii! at all times.

Dear Dave:
As for your request, we at Sonrise Fellowship would like to make a pro-
posal to the Community Center concerning the use of the facility.
Currently, we are renting the center on Sundays. We would like to ex-
change our weekly rent for the purchasing of a new piano. The piano
now in the center is very old and becoming unfunctional. Also, to my
understanding it does not belong to the center.
We would like to purchase a piano for the center in exchange for rent.
Dollar for dollar. We have investigated piano's at Giacoletti's piano
store on Elm, and we've seen several good commercial piano's at around
the $2,500.00 to $3,000.00 range.
We would like to buy the piano on time and make monthly payments.
Knowing that you do not want to be overly committed to a church for
longer than 3 months at a time, we can understnad your reticence on
wanting to agree to this. We are willing, however, to take the risk
of being bumped.

COASTLINE PARKS (CARLSBAD AND SOUTH CARLSBAD)
The last meeting regarding what the State Park Planners call
the State Beaches' "General Plan" was held here on October 25,
1982. At that meeting the City and public expressed their
opinions and concerns. The following list was compiled by the
State Park Planners:
CARLSBAD STATE BEACH
-- Dredge lagoons for sand to keep beaches supplied and lagoons
open.
-- Carlsbad Boulevard widening should include safety and recrea-
tion consideration.
-- Surf conditions threaten new road development.
-- Provide for beach sand replenishment before starting new
development projects.
-- Use combination of beach stabilization techniques and
sand replenishment to restore beach.
-- Look to Army Corps of Engineers to help fund studies/
implementation of beach restoration.
-- Is there background information from similar beach dep-
letion problems elsewhere that can be applied to San
Diego coast?
— Look at carrying capacity of beach areas before planning
parking lots. There must be sand on beach before devel-
opment occurs.
SOUTH CARLSBAD STATE BEACH
-- Develop beaches fcr comfort of beach user, not for parking
comfort.
-- Less parking intensity will create more beach area per
person, lessen impacts on resources, and provide better
recreation experiences.

-- Parking lot developments will only generate additional
cars at beach areas.
-- Create satellite parking areas and use other forms of
transportation to reach beaches (buses and bicycles).
-- Phase parking lot development.
-- Look at other alternatives for beach areas where there
is no beach (i.e., landscaping/buffer zone or other,
to complement scenic highway).
— Consider drainage problems at proposed maintenance area
and erosion at access points.
— Current parking situation creates dust problem for local
residents.
-- Pay parking will deny some users access to beaches.
— Curved Palomar Road is a safety hazard, especially if
campground is proposed for this area.
-- Are maintenance facilities compatible with adjacent
residential areas? High water table at this location.
-- Don't sacrifice beach areas for parking lots. Limit
parking to non-beach areas.
— Buffer zones need to be implemented prior to facilities,
so they will be functional when facilities are constructed.
— Boat launching area is needed.
Park planners are now preparing preliminary plans for all nine State
Park units, including Carlsbad and South Carlsbad State Beaches.
They expect to present these plans at public workshops during the
spring of this year.

There are nine beautiful State Park System units on the San Diego County coastline. They exist side by side with county and city
beaches, offering us spectacular scenery, historic perspectives, and natural qualities unique to the State of California.
State Park System planners are developing a plan to guide the future of these important seashore units — a plan to provide
countless opportunities for fun and enjoyment while maintaining the qualities that make them so attractive.
This plan must fulfill many public expectations — not just those of the people of today, but the needs of generations of visitors
to come.

The department held three public workshops in October 1982. The purpose of these meetings was to obtain public reactions to
a number of alternative actions the department can take to meet present and future recreation and preservation needs. The
meetings were held in Carlsbad on October 25, Del Mar on October 26, and Coronado on October 28.
Because of your participation in these meetings, the staff is now ready to begin preparation of the preliminary general plans.
Once again, we want to share with you what was said at these public meetings. The public comments presented here are taken
from notes recorded at the three sessions. In some cases, the comments have been combined or paraphrased for clarity.
CARLSBAD STATE BEACH
Dredge lagoons for sand to keep beaches supplied and lagoons open.

— Less parking intensity will create more beach area per person, lessen impacts
on resources, and provide better recreation experiences.
Parking lot developments will only generate additional cars at beach areas.
Create satellite parking areas and use other forms of transportation to reach
beaches (buses and bicycles).
— Phase parking lot development.
Look at other alternatives for beach areas where there is no beach (i.e., -
landscaping/buffer zone or other, to complement scenic highway).
Consider drainage problems at proposed maintenance area and erosion at access
points.
Current parking situation creates dust problems for local residents.
Pay parking will deny some users access to beaches.
Curved Palomar Road is a safety hazard, especially if campground is proposed
for this area.
Are maintenance facilities compatible with adjacent residential areas? High

Development needed for entire area (teen center, picnic area, ballfield).
Bad element at beach; not safe for children.

SUBLEASE
THIS SUBLEASE, made and entered into as of
by and between CITY OF CARLSBAD, a municipal corporation ("Sublessor")
and North Coast Family YOUNG MEN'S CHRISTIAN ASSOCIATION, a non-profit
corporation ("Sublessee").
WITNESSETH:
WHEREAb, Sublessor is the lessee of that certain real property of Rancho
Aqua Hedionda Middle Lagoon Waters which is hereinafter described and is willing
to sublease the same to Sublessee; and
WHEREAS, Sublessee is desirous of hiring and subleasing the said described
property from Sublessor for certain recreational purposes;
NOW, THEREFORE, in consideration of the performance of the terms and
conditions hereof, the parties mutually agree as follows:
1. Demised Premises.
For and in consideration of the payment of the rents and performance
by Sublessee of the covenants hereinafter contained. Sublessor hereby lets and
Sublessee hereby hires and leases from Sublessor those certain premises more
particularly described in Exhibit "A" attached hereto and incorporated herein by
reference (the "Property").
2. Use.
The Property shall be used by Sublessee for the general purposes of
recreation, sporting, fishing, and other purposes connected with Sublessee's
recreational camping program, which use shall at all times be under the competent
and effective supervision of agents, servants, and employees of Sublessee.
Sublessee shall not use the Property for any commercial or business venture.
Sublessee's use of the Property shall be exclusive.
3. Term. '
The initial term of this Sublease shall be for a period of ten (10) years
commencing on the day of , 1983, and ending on the
day of , 1993. This Sublease shall automatically be
renewed for three (3) successive five (5) year terms unless either party gives the

other written notice at least sixty (60) days prior to the end of the initial
term or any successive term that the Sublease is to terminate at the end
of such term.
1. Rent.
Sublessee agrees to pay to Sublessor the sum of ONE DOLLAR ($1.00)
per year for the use and occupancy of the Property, receipt of which rent
for the first (1st) year of the initial term of this Sublease is hereby acknowledged.
5. Improvements.
Sublessee shall have the right, subject to the approval of San Diego
Gas £ Electric Company, -to construct and repair any recreationally related im-
provement upon the Property, including, but not limited to, a combined boat
and fishing pier. Sublessee agrees to keep the Property free and clear of
any and all liens at all times.
Upon the termination of this Sublease, either by its expiration or upon
notice. Sublessee agrees, upon receipt of written request from Sublessor, to
remove, at Sublessee's own expense, any and all structural or other improvements
which may have theretofore been erected or constructed on the Property by
Sublessee. The removal thereof shall be accomplished within sixty (60) days
from and after the date of expiration or termination of this Sublease.
6. Subordination. - •
This Sublease is subordinate to that certain written lease between
Sublessor and San Diego Gas & Electric Company, dated March 4, 1957, a copy
of which is attached hereto, marked Exhibit "B" and incorporated herein by
reference, as amended on April 1, 1962, a copy of which Amendment is attached
hereto, marked Exhibit "C" and incorporated herein by reference.
7. Waste.
Sublessee shall not commit, suffer,.or permit any waste, nuisances, or
unlawful acts on the Property and shall at all times maintain the same in a clean
and sanitary condition in compliance with all applicable laws, rules, regulations,
and ordinances respecting health and safety of the City of Carlsbad,

the County of San Diego, and the State of California.
8. Sanitary Facilities.
As further consideration for this Sublease, Sublessee agrees, at
Its own expense, to erect, provide, maintain, and service such suitable sanitary
facilities as may be required for the comfort and needs of the persons entering
upon or using the Property.
9. Hazards.
Both parties recognize and agree that due to the operation of the tides,
the flow of waters, and other causes not under the control of either party, certain
subsurface obstructions,shoals, bars, and other potentially dangerous conditions
may develop from time to time in and under the surface of the waters contiguous
to the Property and Sublessee, its agents, servants, employees, permittees,
licensees, invitees, and other persons using and entering upon said waters do so
with specific knowledge and express notice, which notice Sublessee undertakes
to give to all such persons of such conditions, and Sublessee and such persons
specifically release and hold Sublessor harmless from and against any and all
claims, demands, and liabilities for damages or injuries occasioned by or resulting
from such subsurface conditions. This release is in addition to such other release
and indemnification as is provided below.
10. Right of Entry.
Sublessor reserves the right to enter upon the Property at any time
for the purpose of viewing the same to see if Sublessee is faithfully complying
with the terms and conditions of this Sublease.
11. Rights of Sublessee.
Sublessee shall have no right nor acquire any interest in or to the
Property other than as provided in this Sublease.
12. Assignment.
Sublessee shall not assign this Sublease nor sublease the Property;
provided, however. Sublessee may allow other persons to use the Property for
a fee. '
In the event that Sublessee allows the City of Carlsbad Parks and
Recreation Department ("Parks") to use the Property, the following provisions
and conditions shall apply:
(a) Fees.
During prime-time months (as hereinafter defined) Parks shall
be charged the same rate charged to YMCA Croups for use of the "Property".

During non-prime time months (as hereinafter defined) Parks shall be charged
one-half (1/2) of the prime-time rate for use of the Property. "Prime time" as
hereinabove used shall include the months of May through October and all federal,
state, county, and city school vacations, and all federal, state, county, and
city holidays. "Non-prime time" as hereinabove used shall include all months,
days, and times which are not prime time.
(b) Lifeguards.
Sublessee shall not require Parks to employ Sublessee's lifeguards
If, but only if. Parks' lifeguards complete Sublessee's orientation program and
agree to, and in fact do, follow and uphold all of Sublessee's rules.
(c) Reservations.
Parks and Parks' groups have the right to reserve dates for use
of the Property up to one (I) year prior to the date of the actual use.
13. Waiver.
Any waiver by Sublessor of any breach of one or more of the terms,
covenants, and conditions of this Sublease shall not be a waiver of any subsequent
.other breach of the same or of any other term or condition hereof.
14. Indemnity.
Sublessee hereby agrees to indemnify, save, and hold Sublessor harmless
from any and all loss, damage, injury, and claims resulting from any act or omission
of Sublessee, its employees, agents, licensees, permittees, invitees, or other persons
upon the Property with or without the consent of Sublessee, to the person or persons,
or property or properties of any person, including injury to or death of any person
In any way arising from use and occupancy of the Property by Sublessee, its agents,
servants, employees, and other persons.
Notwithstanding any of the above to the contrary. Sublessee shall not be
responsible for and does not hold Sublessor harmless from any act or omission,
which act or omission constitutes negligence (whether direct, vicarious, or imputed)
on behalf of Sublessor, its employees, or its agents.
15. Attorneys' Fees.
In the event either party shall be required to commence any action or
proceeding against the other by reason of any breach or claimed breach of any
provision of this Sublease, to commence any action in any way connected with this
Sublease, or to seek a judicial declaration of rights hereunder, the person pre-
vailing in such action or proceeding shall be entitled to recover from the other
person or to be reimbursed the prevailing person's actual attorneys' fees and
costs including, but not limited to, expert witness fees, witness fees, and any

and all other fees and costs, whether or not the proceeding or action proceeds
to judgment.
16. Construction.
Whenever used in this Sublease, as the context requires, the singular
number shall include the plural, the plural number shall include the singular,
the masculine gender shall include the feminine and neuter, the feminine gender
shall include the masculine and neuter, and the neuter gender shall include the
masculine and feminine.
17. Headings and Captions.
The headings and captions at the beginning of the various paragraphs
and subparagraphs of this Sublease shall not be construed to be a substantive
part of this Sublease and shall not in any way define, limit, expand, or affect any
provision of this Sublease.
18. • Notices.
Notices to be given hereunder from one party to the other may be
served in person or sent by certified mail to:
