Date of Meeting: October 19, 2009 Place of Meeting: Calavera Hills Community Center CALL TO ORDER Chairperson Lyons called the Meeting to order at 530 p.m, ROLL CALL Present: Chairperson Lyons, Commissioners Comstock, Cooper, Martyns, Farley, and Proulx Absent: Commissioner Craig ANNOUNCEMENTS None APPROVAL OF MINUTES ACTION: On motion by Commissioner Farley, the Minutes of the regular meeting held on September 21,2009 were approved. AYES: Chairperson Lyons, Commissioners Comstock, Cooper, Martyns, Farley, and Proulx NOES: None ABSTAIN: None ABSENT: Commissioner Craig INTRODUCTIONS None PRESENTATIONS None PUBLIC OPEN FORUM Jacque McKelvey of Carlsbad spoke on an item not on the agenda. Her issue addressed the tennis program in Carlsbad. She is concerned about the residents having to pay to play tennis in order to generate revenue to build a clubhouse. Parks and Recreation Commission AMENDED October 19, 2009 CONSENT CALENDAR 1. AB # 1009-1 SUMMARY REPORT - (ACTION) To accept, approve and file the September 21, 2009 Parks and Recreation Commission Meeting Summary Report. ACTION: On motion by Commissioner Cooper, AB #1009-1 of the consent calendar was approved. AYES: Chairperson Lyons, Commissioners Comstock, Cooper, Martyns, Farley, and Proulx NOES: None ABSTAIN: None ABSENT: Commissioner Craig DEPARTMENTAL REPORTS 2. AB # 1009-2 DEPARTMENT REPORT (ACTION) Jim Elliott, Deputy City Manager, reported on recent and upcoming events and project work in the Department which include the following: New item: Update on the recruitment process of the Parks & Recreation Director Drought responselwater conservation as related to irrigating City properties Alga Norte Community Park - general overview Poinsettia Park - tennis complex & update on the request for increased policelsecurity presence after hours Pine ParkIMadison property - history overview Leo Carrillo barn restoration update - on grant submission Department training - disaster service worker City Manager realignment proposal Department personnel changes - promoted Recreation Specialist to Recreation Supervisor at Leo Carrillo Ranch (LCR) Donations - LCR Film Festival Series, Adopt-A-Trail, Opportunity Grants Events completed last month Upcoming events ACTION: On motion by Commissioner Cooper, AB #1009-2 to accept a report from the Deputy City Manager was approved. AYES: Chairperson Lyons, Commissioners Comstock, Cooper, Martyns, Farley, and Proulx NOES: None ABSTAIN: None ABSENT: Commissioner Craig Parks and Recreation Commission - AMENDED 3 - October 19. 2009 3. AB # 1009-3 FISCAL UPDATE AND 10 YEAR FORECAST - (INFO) Lisa Irvine, Finance Director made a presentation on this item. She presented an update of the City's Fiscal Year 2009-10 Operating Budget, Capital Improvement Program (CIP) as well as an overview of the 10 year forecast. Ms. lrvine explained that the City has legal spending limits as dictated by the following: Prop 4 (aka GANN - 1979) w Prop H (1 982) - set expenditures limit at $1 million w Prop G (1989) -authorized spending more than limit on certain recreational projects w Prop C (2002) -authorized spending more than limit on certain projects She further explained the following authorized projects: Prop G Prop C - 2 golf courses - Pool complex - Multi-court tennis complex - Trails linkages and open space - 2 multi-purpose fields - Citylsafety training center - Enclosed soccer fields - Cannon Rd. east Ms. lrvine stated that the City of Carlsbad has received an AM rating from "Standards and Poor's" for managing their funds with only 14 cities within the State of California have received this type of rating. Questions and discussions were as follows: CIP funds for desalination plant Surpluses to be used for emergencies [Commissioner Martyns left the meeting at 6:35 p.m.] 4. AB # 1009-4 OPTIONS FOR THE USE OF RADIO OR REMOTE CONTROLLED AIRCRAFT, CARS, OR SIMILAR DEVICES IN PARKS AND BEACHES - (ACTION) Mick Calarco, Recreation Services Manager, made a presentation on this item. He presented four possible alternatives for addressing changes to section 11.32.030 (31) of the Carlsbad Municipal Code for the use of radio or remote controlled aircraft, cars, or similar devices in parks and the beach area west of Carlsbad Boulevard, between Palomar Airport Road and Solamar Drive. Option 4 was approved by the Commissioners, stated as follows: Amend section 11.32.030 (31) of the Carlsbad Municipal Code as follows, "No person shall operate any radio controlled vehicle on any artificial turf field within any park. Recreational use of electric radio controlled mode airplanes will be permitted on park baseball fields only if a scheduled league game or practice is not occurring; provided, however, they meet the Academy of Model Aeronautics (AMA) definition of a "Park Flyer Model:" No person shall operate any radio controlled model airplanes within the park unless they are a member of the AMA Park Flyers Program and they obey the AMA National Safety Code." Parks and Recreation Commission -4- October 19, 2009 AMENDED Commissioners included the condition of an 8:00 a.m. - 2:00 p.m. time use frame, Sonya Scofield of Carlsbad spoke on the use of remote control airplanes in the City parks. She expressed her concern on the enforcement of the ordinance for remote control airplanes. She stated that she has had to call the Police Department once for someone using a remote control airplane early in the morning. Gus Calderon of Carlsbad spoke on the use of remote control airplanes. He stated that he recorded the sound measurements taken by a certified meter at Poinsettia Park. He gave the commissioners a copy of his findings. He also stated that citizens sometimes mistake the noise of remote control airplanes with actual airplanes. Jan Bayer of Carlsbad spoke on the use of remote control airplanes. She expressed concern regarding the safety of the radio controlled airplanes at the beach area west of Carlsbad Boulevard, between Palomar Airport Road and Solamar Drive. Corinne Wong of Carlsbad spoke on the use of remote control airplanes. She is concerned about maintaining safety in the parks. She explained that she is a jogger and thinks it is dangerous to allow remote control airplanes in a densely populated area. Charles DuShay of Carlsbad spoke on the use of remote controlled airplanes. He stated that he has built model airplanes for several years and has never witnessed an individual getting struck by one. He suggested that people be encouraged to be a member of Academy of Model Aeronautics. He stated that the insurance is very inexpensive because there have been very few incidents. Chip Greely of Carlsbad spoke on the use of remote controlled airplanes. He stated he flys gliders with no propeller and that it weighs about 13 ounces. He enjoys going to the beach area west of Carlsbad Boulevard, between Palomar Airport Road and Solamar Drive also know as Dave's Beach because of the wind for lifts for the remote controlled airplanes. He suggested having a co-existing plan in place for everyone to enjoy the parks. ACTION: On motion by Commissioner Cooper, AB #I 009-4 to accept Option 4 with an 8:00 a.m. - 2:00 p.m. time use frame in parks and no changes to Dave's Beach which is located at the beach area west of Carlsbad Boulevard, between Palomar Airport Road and Solamar Drive AYES: Chairperson Lyons, Commissioners Comstock, Cooper, Farley, and Proulx NOES: None ABSTAIN: None ABSENT: Commissioners Craig and Martyns Parks and Recreation Commission -5- October 19, 2009 AMENDED 5. AB # 1009-5 LOCATION OF FUTURE COMMISSION MEETINGS - IACTIONJ Sue Spickard, Recreation Services Manager, asked the Commissioners if they would like to continue rotating the location of future commission meetings to the different community centers or go back to the Council Chambers and rotate to different community centers on a quarterly basis. Commissioner Comstock commented that the meetings held at the Council Chambers could eventually be televised and we might miss an opportunity if we do not hold meetings there. He suggested that if there is a hot topic that the meetings could be held at the appropriate community center. ACTION: On motion by Commissioner Cooper, A6 #1009-5 to return to the Council Chambers monthly with the flexibility of scheduling a meeting in a specific quadrant when a certain hot topic arises.
