The first meetine of the Planning Commission was called to order
at 7:05 by Robert Sutton, chsirman, at the Oiler's Room of the Twin
Inns, Carlsbad, Members present beside Chairman Sutton were C. 0,
McClellan, J, 8. Bond, and I, W. Gronseth, Absent, Robert M, Smith,
In the absence of Secretary Smith, Chairman Sutton asked that 301.

by Xr. Bond. Ayes, four, noes, none, Motion carried.
Col, Cronseth stated that, he had had a verbal request from Cole
George F. N, Dsiley .for re-zoning of his prophrty from 3-2 to R-1,
No action was taken on the matter at this time,
Chairma-n Sutton read the pet.i.i-,ion of Anthony Vito Allamprese of
3955 Highland Drive, Carlsbad, for variance 01- reclassi.ficatJ.on of
his property to permit the brection of a second residence on the prop-
erty, containins 1,2 acres, in an E-2 zone which requires one acre
per residence, Mr. hllamprese was present and outlined h-is plan to
build an 800-square-foot hone to live 1.n and rent the present resi-
dence, Mr, Alfalnprese sGatp3d that a dist8nce of 60 feet would separ-
ata the two hcmses, that all sethack requirements would be met, and
that h.e knew of' no close neighbors who would ol~jt3ct. Mr, McClellan
suggested that the applicant make up a plot plan showing where the
present hous& stands and where the new house Is to be erected and the
dimensions of the houses, Cole Cmnseth moved that a hearing be set
on the application of Xr, Allarnprese on Thursday, August 28th, at
7 p. M. in the Oiler's Room, and that the property owners within the
legal distanca of 300 feet be noti.Fied by publicatdon of the time
and place of such hearins. The applicznt was advised to appear at
that time and present his plot plan to the board, Motion seconded
by Mr. Bond, Ayes, four, noes, none, blotion carried,
Chairman Sutton read 2 letter. From Xr, Ronald E. Loomer, 3133
Lincoln Street, Carlsbacl, asking that the Building Inspector investi-
gate a matter of encroachment upon his property, stating thal; a build-
ing erected in 1948 or 1949 on adjoining property extends onto his lot,

as surveyed by James A. Isbell, a licensed surveyer in Oceanside,
Applicant stated this encroachment interfered with his plans to build
a multiple garage and workshop, with living quarters above, five feet,
fmm the rear lot line, and he .asked that the owner be compelled to
move the building, Col. Gronseth informed the applicant that ;his
proposed bui3.d.i.ng would have to comply with the residence rear yard
setback of 25 feet because of the apartment above. The property is
in a C-1 zone, Chairman Sutton stated that if the applicant would
make application for a variance it would be given consideration, but
that on the facts presented there was nothing the Commission could
act on. Col. Gronseth stated that he would make a further investiga-
tion of the matter,
Chairman Sutton read an application for zone varimce by Andrew
Barone, Route 2, Box'267&, Carlsbad, on property described as part of
Tract 119, on the east side of Elmwood Street south of Highland Drive
intereection. The request is for a side yard variance of from 10 feet
to 9 feet on the south side, and from 10 feet to 7 feet on the north
side. Mr. Barone appeared in support of his application and stated
that the building inspector had stopped the building when he was called
to make an inspect'ion of the forms, as it did not comply with the code
with reference to side yard setback, due to the fact that the property
runs at an angle and the plans had been drawn so that the face of the
house paralleled Elmwood Street, Mr. Espano was present and stated
that as owner of an adjoining lot, he would give his consent to a var-
iance, Mr. Bond moved that in view of the urgency of the case, a
special meeting of the Planning Commission be held next Thursday even-
ing, August 21st, at 7 p. m. in the Oiler's Room', at which time a'hear-
4ng on this matter will be set, and that owners within the legal dis-
tance of 300 feet be notified of the time and place of such hearing by
postoard, Seconded by Col. Gronseth, Ayes, four, noes, none. Motion
carried. Chairman Sutton stated that it was the recommendation of the
Planning Commission that Mr. Barone have a survey made prior. to the
hearing next week, to determine definitely what variance he needs.
Mr. McClellan suggested that the C ommission investigate the matter
of fees to be charged on applications for re-zoning, as there is steno-
graphic and other expense in connection with such applications.

Enrique Campa appeared before the 'Commission to request that he
be allowed to proceed with electric wiring for whiiih he had obtained
a permit from the County of San Dieeo, Col. Gronseth reported that
the applicant had asked for a wiring inspection, which he did not ap-
prove on the basis of illeeal use of the property. He stated that
applicant has two separate houses on the lot, located in an R-2 zone,
zoned for duplex construction; that both houses had been wired from
the same meter but applicant had obtained a permit to bring the wiring
into the other house through a separate meter, Mr. Tarango, the ap-
plicant's son-in-law, stated that both houses had been built at the
same time, about 1939, and the smaller house was rented out for liv-
ing quarters, The leea1 angles were discussed and City Attorney Smith
expressed the opinion that the facts presented did not show violation
of the electrical code. Chairman Sutton stated that it was the judg-
ment of the Commissi.on that the applicant might proceed with his wir-
ing, so long as it complied in all respects with the electrtcal code,
Chairman Sutton read an application of Donald T. Williams and
Mary E, Williams of 3482 Harding Street, Carlsbad, .for reclassifica-
tion of property described as Lots 3 and 4, Block nCTr, resubdivision
of a portion of Alles Avocado Acres, in the town of Carlsbad. Rezoning
was requested from R-1 to C-l to permit development of the property as
a trailer park, Mrs. Williams appeared in support of her application
and presented facts concerning the unsuitability of this area as a
strictly residential district, due to the proximity of the freeway.
Mr. McClellan suggested that since the construction of the freeway will
raise this zoning problem generally, it might be well to wait until a
true picture could be obtained of the whole situation. Chairman Sutton
stated that it was the opinion of the Commission that this application
should be considered as a part of the over-all picture and studied
very carefully in connection with other applications which were expect-
ed to be filed, and that the applicatj.on be tabled Qor future consider-
ation.
Father Anthony Kaspar made a request for re-zoning of property
belonging to the Catholic Church, situated on the west side of Harding
Street between Oak and Elm Streets, now zoned R-2. He said he had
had two offers, both from mortuaries, to purchase the property, but had

t with opposition from nearby homeowners, and now had an opportunity
lease the premises to a Mr. BmrseWe for the purpose of operating WREW
a sandvdch business during the period of the freeway construction.
The question of a temporary re-zoning order was discussed, to permit
the Church to make this lease and pt the revenue from it, but no
legal provision could be found for such action, Chairman Sutton
stated tht it would be necessary that the applicant file a formal ap-
plication with the City Clerk, on a form available at that office,
after which the Commission would set a hearing and send out notifica-
tion to neighboring residents of the time and place.. . of such hearing,
Chairman Sutton read a.irequest for the vacatinz of a portion of
the west end of Ponderosa Drive in Terramar, signed by the owners of
adjoining property, Col. Gronseth moved that a recommendation be
made to the City Council that the north 70 feet of the west end of -
Ponderosa Drive on a line with the west side line of Sumach Road, in
Terramar, be vacated, and that the subdividers of Terramar be required
to do the necessary paving to the satisfaction of the Public Works
Director, Seconded by Mr. Bond, Ayes, four, noes, none. Motion
carried,
Chairman Sutton read the petition of Irving Cumnlings for reclass-
ification from E-2 to R-2 of property described as a portion 0.f Tract
236 of Thum Land.s lying westerly of California Division of Highways’
freeway right of way. Mr. McClellan outlined the reasons for the re-
zoning request and stated that the matter was reasclnably urgent. The
possibility of re-zoning the entire area back to the R-2 boundary was
discussed fully, but it was considered that such action initiated by
the Commission, instead of by the owners, might create resentment,
The suggestion was made that Xr. Robert Garland of the Carlsbad Jour-
nal be asked to print a news itern that the Plannirls Commission is
contemplating a reclassificat,ion of the territory surrounded by Mag-
nolia, Jefferson, Tamarack Streets and the Santa Fe tracks, from
E-2 to R-2, and would appreciate hearing from interested persons,

Chairman Sutton stated that inasmuc’h as the fourth Thursday in
November is Thanksgiving and the fourth Thursday in December is

those two months.
Chairman Sutton read a request from Ona M. Williams, for a var-
iance in lot area from 6000 feet to 5000 feet on property described
as 100' x 100' on the north side of Walnut Avenue, between Lincoln
Street and" the Santa Fe Railway, to enable to owner .to sell the west
half of the property.. Nr. .Bond reported that he had investigated
the property and would recormend that a hearing be set on the a.ppli.-
cation. Col. Gronseth moved that a hearing be set on the applica-
tion of Ona M. Williams for a reduction in lot area, on August ZFfth,
at 7 p. m. in the Oiler's Room, and that owners withln the legal dis-
tance of 300 feet be notified by publication of the time and place
of such hearing. Seconded by Mr. Bond, Ayes, four, noes, none.
Cash Karket, P. 0. Box 864, Carlsbad, stating that they have an oppor-
tunity of leasine; their property at 2716 State Street, but that nego-
tiations were contingent upon permission being granted for use of the
building as a cabinet shop, Mr. Bond moved that a hearing on this ap-
plication be set for August 28th, at 7 p. m. in the Oiler's Room,
and that notice by publication be given all interested parties.
Seconded by 'C'ol, Gronseth. Ayes, four, noes, none. Motion carried.
The rllstter of unzoned propzrty was discussed, and Chairman Sut-
ton suggested that this rwtt,er be further discussed at the next meet-
ing, and in the meantime the suggestion he made to the City Council
that all owners of unzoned property should make their desires known
to the City Council as soon as possible.
Mr. McClellan suggested that the Plannin; Cornnission consider a
sub-division or:tinance as soon as possible.
There being no further business to c9me before the aeeting, Mr.
McClellan moved its adjournment. Seconded by Mr. Bond. Ayes, four,
noes, none. Motion carried and the meetins was adjourned.
