D, McClellan, J, B, Bond, Arnie Stringer, and I, H. Gronseth; and City Attorney T, Bruce Smith, Absent, Tom Acuna. Minutes of special meeting of August 21st were read and approved, Chairman Sutton reviewed the request of Anthony Vito Allamprese of 3455 Highland Drive for reclassification or variance to permit the erection of a second residence on property zoned E-2, The question of whether this request should be considered as a request for reduc- tion in lot area, which would classify as a variance, or as a zoning change, /The feeling of the Commission was definitely against spot was discussed. zoning and toward the idea of considering a general zone change in that area. Arnie Stringer pointed out that good planning would re- quire some roads being cut through eventually, and that it would be poor policy to allow building where roads should be laid out. Mr. Allamprese stated that the matter was not urgent and he would be satisfied to wait until more study could be given to rezoning of a larger area. Mr. Bond moved that the second notice on the Allamprese hearing be withdrawn. Seconded by Col. Smith, All ayes, motion carried, The necessity of setting up a minirnum frontage requirement, was discussed, and Secretary Smith was requested to give the City Attorney a written memo to prepare a recommendation on the matter as soon as possible. Chairman Sutton reviewed the application of Ona Williams for re- duction in lot area from 6000 to 5000 square feet on her property on Walnut Avenue between Lincoln and the Santa Fe Railway. Col. Gronseth moved that the Planning Commission recommend to the City Council that the variance be granted. Seconded by Mr. Bond. All ayes, motion carried, Chairman Sutton explained that due to an error, a notice of hear- ing for this date h.ad been published on the application of Don T, Williams for zone change from R-1 to C-1 on Lots 3 and 4, Block C, Resubdivision of a portion of Alles Avocado Acres, for the purpose of -1- establishing a trailer court. Chairman Sutton read a letter from Frank R. Smith of 1042 Chestnut Avenue, protestin2 the granting of a zone change on the grounds that trailer parks should be confined to the outskirts of the city, and that spot zoning is unfair to other residents of the area., Mr, Smith was present And stated that in his opinion it wold-d be possible ~.th good planning to confine trailer camps to areas which have not been built up, and that the Commission. should, before taking action on any rezorlj.ng, make certain that the general public receives notification of it, He suggested that an item be printed in the Carlsbad Journal calling attention to the importance of reading the legal- notices. Another protest from the floor pointed out that a C-1 zone in the vicinity of the school would permit operation of pool halls and other businesses undesirable in a school area. George W, Williams, of 2906 Madison Street, was present and com- plained that eucalyptus trees on city property near his home created an extremely unsizkjtly condition on his property, due to their year- round dropping of leaves, bark, etc. He stated he would like to have them removed, and would be willing to have them taken out and replaced with trees that leave less debris. He also stated that some of the limbs hang over his house and it’was his intention to ask the City to assume responsibility of any damage to his house which might; result fkorn a falling limb, The setting UF of a committee to investigate complaints and pass on the condition of health of the trees and the degree of hazard, was discussed, and the City Attorney gave the opinion that the Board is entitled by law to emay experts for advisory pur- posesI Col, Gronseth moved that a committee be appointed, consist- ing of Mr, Bond and Mr, Stringer a.nd three other members to be select- ed from the citizenry, to survey conditions of trees on street proper- ties in the city of Carlsbad, where complaints.’.have been made to the Planning Commission, and to recommend to the Planning Commission the removal and replacement of such trees as may be deemed expedient and necessary, and further to formulate recommendations for long term plans concerning the planting of trees and shrubbery for the beautifi- cation of the city. Seconded by Col. Smith, All ayes, motion carried, -2- Chairman Sutton read the application of Cullen E. Hargett of 1301 Pine Avenue, for variance in east side yard setback to 7 feet. Mr. Hargett was present and explained his plans for adding two rooms to the east side of his house. Mr. Bond moved that a hearing be set for September 11th at 7:OO p. m. in the Oiler's Room at Twin Inns on the applicat-ion of Cullen E. Hargett. Seconded by Mr. Stringer, All ayes, motion carried. Chairman Sutton reviewed the application of C . H. and Dorothy Walker for a permit tooperate a cabinet shop on their property at 2716 State Street, in a C-l zone. Neither applicant was present, and no one appeared in protest. Col. Gronseth moved that the Planning Commission recoriunend to the City Council that the application of C. H. and Dorothy Walker be granted, with the proviso that the activi- ties on said premises do not interfere with the peace and quiet after the regular day-time working hours, and that the premises are main- tained in a reasdnably fire-safe condition. All ayes, motion carried. Chairman Sutton read the application of Margaret We Coats of 3229 Valley Street for zone change from E-2 to R-2 on a portion of Tract 123, Carlsbad Lands, according to Map 1681, After considerable discussion, it was the judgment of the Commission that it would not be good practice to grant the request as made, and that Miss Coats should be given an opportunity of revis3ng her request for change to R-1 instead of R-2, as being more possible of accomplishment, Chairman Sutton volunteering to contact Miss Coats on the matter, It was also decided to initiate, upon revision of the Coats' request, rezoning to R-1 of a larger area, Col. Smith moved that a hearing be set on September 18th, at 7:OO p. m., in the Oiler's Room, on the applica- tion of Miss Margaret Coats for reclassification of a portion of Tract 123, Carlsbad Lands, and, at the initiation of the Planning Commission, all of those portions of Tracts 122 and 12.3 of Carlsbad Lands according to Map ls, and of Lots 23, 24 and 25, Patterson's . Addition, according to Map 565, lying easterly of a line parallel with and distant 150 feet easterly at right angles from the easterly line of Highland Drive; provided that Miss Coats changes her request for rezoning to an R-1 classification; and in the event the applica- tion is not changed to an E-1 classification, that a hearing be held -3- .- "" . .. . . . . . ~ . . . Further, if Miss Coats withdraws her applica- tion, no hearing is to be held and the City Clerk is requested to re- turn her deposit, Seconded by Mr. Stringer. Ayes, five, Col. Gron- Seth having been excused. Motion carried, Chairman Sutton read the applicstion of Carlsbad Mutual Water Company, by Don P, Johnston, Secretary-Manager, for reclassification from R-3 to M-1 of the NorZheast GO feet of Lot 2, Industrial Tract, Map 1743, Mr. Bond moved that a hearing be set for September 18th at 7:OO p. m. in the Oiler's Room, on the application of Carlsbad Mutual Water Company for rezoning of said property, and at the initi- ation of the Planning Commission, the easterly 100 feet of the Santa Fe right-of-way adjoining, Seconded by Nr. Stringer, All ayes, motion carried, Mr, McClellan reminded the Commission that it would be wise to consider and prepare to recommend to the City Council the adoption of a subdivision ordinance, and suggested that copies of the San Diego County ordinance could be obtained and studied, Chairman Sutton reviewed the petition of Irving Cummings for reclassification from E-2 to R-2 of a portion of Tract 236, Thum Lands, lying westerly of California Division of Highways freeway right-of-way, on which a hearing had been erroneously set for Septern- ber 12th. Mr. Bond moved that a hearing be set on September 18th to consider the Cummines application, also including, upon initiation of the Planning Comnksion, all property bounded by the freeway, Santa Fe tracks, Tamarack and Magnolia. Streets not owned by Irving Cummings, Seconded by Col, Smith. All ayes, motion carried. Chairman Sutton stated that there was available from the Print- ihg Division, State of California, at #l.OO per copy, a book on Laws Relating to Conservation and Planning, which might be very helpful to the Commission in its planning work. Col, Smith was asked to request the City Clerk to write for a copy of the 1951 edition, There being no further business to come before the Commission, Mr. Stringer moved for adjournment, Mr. Bond seconding. All ayes,
