p. m, in the Oilers' Room at Win IMS. Members present beside Chai-n
Sutton were C, D, McClellan, Robert Smith, I, H. Gronseth, H. H. Be*-
ter, J, Bo Bond, bnie Stranger, and Tom Aouna.
Minutes of the meeting of August 28th were read. Correotion
was made on Page 4, line 12, by insertion after the word RComiasion~,
of the words "all of the Industrial Tract, and", and on page 3, line
19, by changing the nap number from 16gl to 16k1, and on the same
page, line 31, sam correction, After such eormctions, the minutes
were approved.
Secretary Smith stated that he had consulted the City Attorney
as to procedure to be followed to oorreot erroneous aeauription in
the advertisement setting hearing on rezoning, .upon initiation of the
Planning Commission, of certain lands adjoining those described in
the Carlsbad Mutual Water Company's request for rezoning, The City
Attorney stated that the entire tract could not be considered at the
hearing on the 18th, due to the omission in the notice, and that 8
motion should be made to omit from the hearing on the 18th the land
described as wthe easterly 100 feet of the Santa Pe right-of-way
adjoining", The City Attorney further stated that if the entire
tract is to be considered, it will be necessary to set a hearing at a
later date.
Byor McClellan stated that he felt that property owners in
the immediate vicinity of the tract should be personally notified,
and suggested that Tom Acuna could do this,
Gol. Gronseth moved that a hearing be set on Thursday, Octo-
ber gth, at 7:OO p. m. in the Oilers' Room, on the rezoning to Wl
of the property located south of Oak Avenue, between the Saxrta Fe
Railway and Tyler Street, to the north line of Chestnut Avenue, known
as the Indistrial Tract according to Map 1743, this to include any ,u";
existing property which may have been zonsd to M-1, and the eastsr&f"
100 feet of the Santa Fs Railway right-of-way adjoining said €hilus-
trial Tract, Seconded by ET. Bond. All ayes, motion oarriajd,

A change of meeting place and meting night was discussed,

but it was decided to continue meeting at the same' place, on the same
evenings, for the time being,
Secretary Smith reviewed the petition of Cullen E, Hargett
requesting variance in side yard setback on the east side from 10
feet to 7 feet on property located at 1301 Pine Avenue, Being Lot
B of Patterson's Addition. There being no protests, Col, Gronaeth
moved that approval of the variance be recommended to the City Council,
Seconded by Mr. Stringer, All ayes, motion carried,
Secretary Smith read a memo from the City of Carlsbad stating
that a recommendation was made by the City Council to request the
Planning Commission to make a study ad prepare recommendations for
a sub-division ordinance; and to study the unzoned areas of the City
and make recommendationa for zoning present unzoned areas.
It was decided to ask the City Clerk to request of the League
of California Cities, copies of the subydivision ordinances of a
.half-dozen comparable cities; and to have copies made of Ordinance
366 (New Series) of the County of San Diego, for the study of the
members of the Planning Commission,
In discussion of the zoning of unzoned areas, Chairman Sutton
suggested that a letter be written to Mr. Cannon, the San Diego Gas
& Electric CO., the Kellys, Jay Hoffman, Tad Pahl, and other owners
of unzoned property, statiw that it is the desire of the Planning Com-
mission that they make known their wishes in regard to zoning of their
properties, within the nee 30 to 45 days, Mr. McClellan suggested
that a conference be arranged between officials of the San Diego Gas
& Electric Company and the Planning Commission, prior to taking any
other steps toward zoning that area, to discuss the possibility of
setting up a light industrial ZO~. Col. Gronseth moved that the
Chairman appoint a committee of three members to study arrd recommend
to the Planning Commission, regulations conoerning territories whiah
may be sub-divided within the City of Carlsbad; and that the Chairman
appoint a committee of three members to consider proper zoning of
territories within the City limits of Carlsbad not now zoned, and to
contact owners of property affected to ascertain their views and ob-
tain their recommendations, said committee to submit its findings -

reconmendations to the Planning Commission. Seconded by Tom Acuna.
All ayes, motion carried.
Chairman Sutton appointed Arnie Stringer, chairman, and Col.
Smith and H. H. Barter members of the Sub-Division Committee; and
Col. Oronaeth, chairman, and Tom,Acuna and J. B. Bond melribers of the
zoning Commit tee'.
Secretary Smith read the third recamendation contained in
the memo from the City of Carlabad, that a survey be made of possible
violations of present zoning, but it was decided that this was out-
side the duties of the Planning Commission and no action was taken.
Secretary Smith read the application of A. L. Nevares of 3147
Roosevelt Street for side yard variance, nmth side, from 5' to 33*,
and from center line of street to property line, from 50* to 3O*,
on pmFerty described as Lot 24, Block 32, Town of Carlsbad. Col,
Gronssth stated that he had inspected the property, and that the ap-
plicant was enlarging a garage to make a dwelling; that the building
did not meet minimum spaoe requirements of 360 aquare feet, nor the
plumbing and electrical specifications, and that he had advised the
applicant to request a variance, after which, if granted, he could
rebuild the building in accordance with Code requirements. Mr. Mc-
Clellan moved that a hearing be set on Mr. Nevaresc application on
September 25th, at 7:OO p. m, in the Oilerst Room, provided he will
agree to suspend all work on the building until the application is
heard and action is taken by the City Counoil on same. Seccnded by Mr. Stringer. All ~es, motion carried.
Secretary Smith read the applioation of Marvin S. Humphries,
for variance in side yard setback from lo* to 7' on the north side,
and Zrom 10' to 7' on the solrth side, on property described as a
mion Of Lots 4 am3 5, Block B, portion of Resubdivision of Alles
Avocado Acres, according to Map 2057, located on the east aide of
Herding Street be$ween Megnolia Street and Palm Avenue. Mr. Stringer
moved that a hearing be set on the application of Marvin So Humphries
for variance in side yard setback, on September 25th, at 7 p. m. in
the Oilers* Room. Seconded by Col. Smith. All ayes, motion carried.
Secretary Smith read the petition of Joe B. Cockrill, et al,
for reclassification of property from R-4 and C-1 to R-1. Stringer - 3-
moved that a first hearing be aet on the above applications on Octo-
ber 9th, at 7 p. m. in the Oilers' Room, for reclassification to R-1
of the described property in Buena Vista Gardens, exoepting from lot
area requirements Lots 10 and l7A. Seconded by Mr. Acuna. All ayes,
motion carried.
Seoretary Smith read the petitldh of George F. N. Miley and
Josephine Dailey for reclassification from E-2 to R-1 certain proper-
ty at Highland Drive and Chestnut Avenue. During the discussion of
this application, during which objections of a neighbor, A. E.
Humphries, were heard, Secretary Smith read a letter from City Attorney
Smith regarding minimum frontage requirements which could be made by
the Planning Commission. Col. Gronseth moved that a hearing be set
on October 9th, at 7:OO p. m. in the Oilerst Room, to cmsider the
petitions of George F. No and Josephine Daileg, and Anthony Allam-
prese, for reclassification to R-1, and that this include proposed
zoning change at the initiation of the Planning Commission of all
of the territory now zoned E-2, lying west of a line parallel with ad
easterly 150 feet from the east line of Highlad Drive, Hillside Drive
and Park Drive, from the north line of Chestnut Avenue, to an inter-
section with the easterly boundary of Bella Vista Bdap 2152, thence
along said easterly boundarg'of Bella Vista to the most southerly
corner of Lot 8, Block D, Bella Vista, and lying easterly of Califor-
nia State Highway XISD2B; and that no lot in this are8 shall have a
frontage of less than 75 feet upon a dedicated street, ad no dwelling
mag be constructed on any lot not abutting on a street Bo dedicated.
Seconded by b¶r. Bond. All ayes, motion carried. Mr. Bond reported that he had investigated the complaint of
George Williams, 2906 Madison Street, concerning the unsightly and
hazardous condition created by eucalyptus trees on city property
adjoining his lot, and that he did not cmsider the trees a particular
hazard but did feel that they should be replaced by trees that are
more acceptable. After discussion, it was deaided to get three more
members from the citizenry on the cornittee and obtain their opinions
before making a recommendation to the City Council.
There being no further business to come before the Commission,

ayes, meeting adjourned.
