Meeting called to order by Chairman Robert Sutton at 7:15 p. m.
in the Oilers' Room, Twin Inns. Present beside Chairman Sutton were
members H. H. Barter, I. H, Gronseth, J. B. Bond, Tom Acuna, C . D.
McClellan, Arnie Stringer and R. M. Smith.
Minutes of the meeting of September 25th, and of the special meet-
ing of September 3Oth, were read and approved.
Secretary Smith reviewed the request of the PNnning Commission
for rezoning to M-1 of the property located south of Oak Avenue, be-
tween the Santa Fe Railway and Tyler Street, to the north line of
Chestnut Avenue, known as the Industrial Tract according to Map 174.3,
to include any existing property which may have been zoned to M-1, and
the easterly 100 feet of the Santa Fe Railway right-of-way adjoining
said Industrial Tract. Chairman Sutton explained to several residents
of the area who were present, the purpose of the rezoning, ad the uses
permitted and those prohibited under M-1 zoning. Present on behalf of
the Santa Fe Railway were E. L. McDonald, Division Engineer, and C. L.
Conolly, Assistant Engineer, Coast Lines. There being no protests,
Col, Gronseth moved that a recommendation be made to the City Council
that the request for rezoning to M-1 of the Industria1 Tract, as ad-
vertised, be granted. Seconded by Mr. Acuna. All ayes, motion carried. . Secretary Smith reviewed the application of Joe B. Cockrell, et al,
for rezoning of Buena Vista Gardens and the entranceway thereto from
R-4 and C-1 to R-1, and to limit to single-dwelling units the property
described in the petitions, excepting from lot area requirements Lots
10 and l7-A, Buena Vista Gardens. The possibility of Zone R-2B being a
better reclassification for the area was discussed, and the suggestion
made that the' matter be tabled until I&. Cockrell, who was present,
could contact as many of the Owners as possible to &earn their desires
in this respect, but Mr. Cockrell stated that some apprehension existed
that some multiple-unit building might get under way, aril he felt it
urgent to act on the applications immediately. Col. Gronseth moved
that the Planning Commission recammend to the City Council the rezoning
of Buena Vista Gardens and the entrance thereto, a8 requested, to
Zone R-1, but that the exceptions requested be not granted. Seconded

by Col. Smith. All ayes , motion carried.
Secretary Smith reviewed the application of George F.. N. Dailey
and Josephine N. Dailey for rezoning from E-2 to R-1 of a portion of
Tract 24.0; of Irving Cummings and Ruth S. Cummings, portions of Tracts
236 and 237; and Harry J. Stone and hrgaret C. Stone, portion of
Tract 236, of Thum Lands, according to Map 1681; and the request of
the PlanningmCommission for rezoning from E-2 to R-1 of an area which
includes those properties, as advertised. Col. Dailey was present and
explained the purpose of his request and his plan to sell the property
in three parcels, divl'ded by a private road. IIfr. Art Humphries, an
adjoining property Owner, protested the granting of the Dailey request,
objecting to the proposed subdivision of lots facing a dead-end private
road, and stated that most of the neighboring residents felt as he did
and were prepared to petition against it. After considerable discussion,
Col. Smith mved that the Planning Commission recammend to the City
Council the reclassification from E-2 to R-1 of the area as advertised,
with the restrictions as advertised for the area. Seconded by Mr. String-
er. All ayes, motion carried,
A change of meeting night and place was discussed, and Col. Gron-
seth moved that hereafter meetings of the Planning Commission be held
on the second and fourth Mondays of each month, beginning November 10,
1952, at 3075 Harding Street, except on holidays. Seconded by Mr.
Stringer. All ayes, motion carried,
Secretary Smith read a letter from the City of Carlsbad, signed
by.Edward G. Hagen, City Clerk, requesting that the Planning Commission
take steps toward the issuance of an additional conditional permit for
the City's use of the leased property at 3075 Harding Street as a fire
station. Mr. Stringer moved that a hearing be set on October 23rd, at
7:OO p. m. in the Oilers' Room, on the request of the City of Carlsbad
for a special use permit to allow use of the building at 3075 Harding
Street as a fire station. Seconded by I&, Bond. All ayes, motion car-
ried.
Secretary Smith read the petition of Bernard I,. Robinson and Anita
Robinson, and George H. Williams, for reclassification from R-3 to C-1
of property described as Lots 23 and 24, Seaside Lands. Mr. Stringer
moved that a hearing be set on November 10th at 7:OO p. m. at the City

" Hall, 3075 Harding Street, on the petition of Bernard L, Robinson and
Anita Robinson, and George H. Williams. Seconded by Mr. Bond . All
ayes, motion carried.
Seuretary Smith read the petition of Jose J. Rodriguez and Reyes
F. Rodriguez for reclassification from R-2 to C-1 of property described
as the Vesterlg seventy feet of Lots 17 and 18, Block 41, Town of
Carlsbad, Map 535, Col. Smith mwed that a hearing be held on November
10th at 7:OO p. m, at the City Hall, 3075 Harding Street, on the peti-
tion of Jose J. Rodriguez and Reyes F. Rodriguez. Seconded by Mr.
Acuna. All ayes, motion carried.
Chainnan Sutton read a letter from the County of San Diego invit-
ing inenibers of the Planning Commission to a proposed dinner meeting at
which a plan for organizing a San Diego County Planning Conwess would
be discussed, and asking for a list of evenings in late October or
early November which would not be convenient for such a meeting. Mem-
bers expressed the feeling that such a plan might be very helpful, and
the Secretary was instructed to reply to the letter, supplying the in-
formation requested,
Secretary Smith read copy of letter, signed by Mayor McClellan,
to Mr. Clarence Reischel of Bellflower, notifying him that the proposed
erection of outdoor advertising structures on Highway 101 within City
limits violated the City zoning ordinance, and that penalties would be
enforced if the signboards were erected. Mayor McClellan suggested two
plans which might be adopted to prevent such violations; to request the
Division of Highways not to give permits until zoning requirements had '
been cleared by the applicant; or to write to the several outdoor ad-
vertising companies asking for their voluntary co-operationa htr, Barter
was requested to make a survey of outdoor advertising structures within
the City limits, getting the names of the companies to present for the
consideration of the Commission at the next meesing.
Mr, Stringer reported that he had investigated the trees which
Miss Gretchen Tuthill had requested be trimmed or topped, and found that
there were five laterals which could endanger her property if they are
brittle, He also stated that if the wind were blowing in the right
direction, there would be considerable danger to power lines, and sug-
gested that the power company might possibly do this work. The matter

8 was discussed, and Mr. McClellan pointed out that the trees were there
and in approximately their present condition when the building was
built, and that perhaps an arrangement could be mde whereby the City
could do the work and charge the property owner. Mr. Stringer moved
that the Planning Commission recommend to the City Council that Miss
Tuthill be advised that permission would be given her to have the trees
trimmed, or that the City of Carlsbad will do the work at her expense;
that the Planning Commission has inspected the trees and comiders them
dangerous and would recommend that some action be taken, Seconded by
Mr. Bond. All ayes, motion carried,
Mr. Stringer stated that Elwood Trask had offered to serve on the
tree coxnittee if he were asked, and Chairman Sutton stated he would
secure two or three additional members for the committee,
Secretary Smith read the application of J, Re Barter for variance
in east side yard setback from 10 feet to 5 feet, and in front yard
setback from 50 feet to 33 feet on property described as a parcel of
Tract 239, Map of Thum Lands 1681. Col. Smith moved that a hearing be
set on the application of J. Re Barter for variance, on October 23rd
at 7:OO p. m, in the Oilers' Room. Seconded by Mr. Stringer, All ayes,
motion carried,
1301, Qronse$h reported that the Zoning Committee had consulted
with the San Diego Gas & Electric Company and has their recommendations,
and expects to see the other owners shoBtly;/ Allan Kelly would like to that
have his property remain as is,
Chairman Sutton announced the Convention meetings of the League of
California Cities on Monday and Tuesday in San Diego, and Mr. McCleIlan
stated that he would be going down to several of the sessions and would
be very glad to take any of the members.
Mr. Stringer announced a meeting of the Subdivision Committee in
Bruce Smith's office Thursday evening, the 16th, at 7:30 p. m,
There being no further business to come before the meeting, Col,
Smith moved for adjournment, Mr. Bond seconding, All ayes, meeting
adjourned ,
